Provisions on the administration of foreigners' participation in radio, film and television program production activities

Article 1 In order to promote the healthy and orderly development of radio, film and television exchange activities between China and foreign countries and regulate foreigners' participation in radio, film and television program production activities, these Provisions are formulated in accordance with relevant national laws and regulations. Article 2 Foreigners mentioned in these Provisions refer to the following persons who do not have China nationality:

(a) foreigners who have been approved to work in China and their foreign relatives living in China;

(2) embassies and consulates in China personnel from various countries;

(3) Staff members of foreign enterprises and institutions in China and their accompanying families;

(4) Personnel of international organizations in China and their accompanying families;

(five) foreigners invited to China to participate in the production of radio, film and television programs;

(6) Foreign students and other temporary visitors to China. Article 3 The production activities of radio, film and television programs mentioned in these Provisions include radio and television program production (including special topics, variety shows, foreign language teaching, etc.). ), TV series and movies, as well as various cultural performances for the purpose of making radio and television programs. Article 4 Foreigners may be hired to participate in the production of radio, film and television programs due to special needs or lack of relevant personnel in China.

Foreigners employed to participate in radio, film and television program production activities must have relevant work skills, professional qualifications or work experience. Article 5 Units that employ foreigners to participate in the production of radio, film and television programs are limited to radio and television program production units such as the central government and all provinces, autonomous regions, municipalities directly under the Central Government, capital cities and cities under separate state planning, as well as film studios and units with film production licenses or television production licenses. Article 6 The employment of foreigners to participate in the production of radio, film and television programs shall be examined and approved by the administrative department of radio, film and television.

Invite foreigners to participate in the production activities of radio, film and television programs for free for the time being, and report to the administrative department of radio, film and television for the record.

If it is employed by the central department, it shall be reported to the State Administration of Radio, Film and Television for approval and filing; The employment of departments below the provincial level (including the provincial level) shall be reported to the provincial radio and television (film and television) department (bureau) for approval and filing.

Hiring foreigners to participate in film production activities must be reported to the General Administration of Radio, Film and Television (the Film Bureau) for approval and filing. Article 7 Radio stations and television stations shall not employ foreigners to host news programs, including news, news commentary and news topic. Article 8 If a radio station or television station is approved to hire foreigners as experts to participate in foreign language teaching programs and pay remuneration, it will be included in the management series of hiring foreign cultural and educational experts, and relevant procedures will be handled in accordance with relevant state regulations. Article 9 A unit holding a TV drama production license or a film production license may, upon approval, employ foreigners to participate in the production of TV dramas or films. The employment of foreign cast members in Chinese-foreign cooperative production of TV dramas and films shall be implemented in accordance with the relevant provisions on cooperative production of TV dramas and films. Article 10 To employ foreigners who have signed employment contracts with other units to produce radio, film and television programs, it is necessary to obtain the consent of the foreigner's work unit or the centralized management department in advance and report it to the radio, film and television administrative department for examination and approval. Eleventh in principle, foreign students are not allowed to participate in the production of radio, film and television programs. If foreign students are invited to participate in the production of temporary radio, film and television programs due to the need of program production, the production unit shall obtain the consent of the school where the foreign students are located in advance. Twelfth radio and television stations to invite foreign embassies and consulates in China personnel to participate in radio, film and television program production activities, in accordance with the "Regulations on the administration of foreign affairs of local radio, film and television systems". Thirteenth radio stations and television stations shall not broadcast radio, film and television programs produced in violation of the above provisions. Fourteenth in violation of the above provisions, the State Administration of Radio, Film and Television or the provincial administrative department of radio, film and television may, according to the seriousness of the case, give the following administrative penalties:

Fifteenth in violation of the above provisions, if the circumstances are serious, it shall apply for engaging in the above business within two years from the date of implementation, and shall not be approved. Article 16 The State Administration of Radio, Film and Television shall be responsible for the interpretation of these Provisions. Seventeenth the provisions shall come into force as of the date of promulgation.
