Regulations of Huanren Manchu Autonomous County on Water Safety Management

Article 1 In order to strengthen water safety management, maintain water safety order, and ensure the safety of people's lives and property, these Regulations are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on the Administration of Inland River Traffic Safety and other laws and regulations, combined with the actual situation of Autonomous County. Second units and individuals engaged in water navigation, berthing and operations and other activities related to water safety within the administrative area of Autonomous County shall abide by these regulations. Third Autonomous County Department in charge of transportation is responsible for the administrative area of water safety management.

Township people's governments (street offices) involved in water safety shall strengthen the supervision and inspection of water safety in their respective jurisdictions and assist relevant departments to perform their duties of water safety management according to law.

The villagers' committee shall cooperate with the Township People's government to do a good job in water safety management. Article 4 Autonomous County People's governments and their relevant departments, Township People's governments and sub-district offices shall organize publicity activities on water safety laws, regulations and safety knowledge, strengthen drowning prevention safety education, prohibit wild bathing, and raise public awareness of water safety. Article 5 Transport vessels, official vessels and production vessels shall meet the following conditions before sailing:

(1) A ship inspection agency recognized by the maritime administrative agency conducts inspection according to law and holds a qualified ship inspection certificate.

(2) Having been legally registered by the maritime administrative agency and holding a ship registration certificate.

Article 6 Fishing vessels shall be inspected by the fishing vessel inspection department and registered with the competent fishery department according to law before they can be launched for operation. Article 7 Ships without factory name, ship number, ship certificate and port of registry (hereinafter referred to as "three-no" ships) and ships that should be forcibly scrapped according to state regulations are prohibited from sailing, berthing and operating. Eighth Autonomous County People's Government shall, according to the needs of water traffic safety, demarcate routes and prohibited waters according to law, and announce them to the public.

No vessel or floating facility may sail, berth or operate in the prohibited waters; If it is necessary to enter the waters under special circumstances, it shall be approved by the Autonomous County People's Government. Ninth Autonomous County People's government should integrate all forces, strengthen the construction of water safety law enforcement team, strengthen law enforcement, and form a joint force of law enforcement. Tenth the following matters shall be determined by the competent department of the Autonomous County People's government:

(a) to conduct industry safety supervision and management of water sightseeing, rafting and other business activities in tourist attractions.

(two) the safety supervision and management of water sports and leisure projects in city parks.

(3) Water safety supervision and management related to fishing boats and fishery production operations.

(four) the supervision and management of the registration of special equipment for water recreation facilities and the investigation and handling of safety accidents.

(5) Port safety supervision and management.

(six) to supervise and manage the water safety of Longhu Lake, Huilong Lake, Jinlong Lake, Fengming Lake and Hunjiang River within the administrative area of Autonomous County. Eleventh Autonomous County People's government departments in charge of transportation shall guide and urge the departments in charge of fishery, cultural tourism, housing and urban and rural construction, market supervision and management to establish and implement the responsibility system for water traffic safety management, and investigate and deal with the "three noes" ships according to law. Twelfth autonomous county drinking water source protection areas prohibit cage culture, tourism, swimming, fishing, planting crops and other acts. Article 13 The public security organs of the Autonomous County People's Government shall be responsible for the public security management of ferries, docks and ships, and investigate and deal with illegal acts that hinder public security and water traffic order and destroy water traffic facilities according to law. Fourteenth Township People's governments shall perform the following duties in the management of water safety:

(1) Establish and improve the ship safety responsibility system for administrative villages and ship owners.

(two) the implementation of ferry ships, crew and passengers quota safety management responsibility system.

(three) the implementation of the ship water traffic safety management of specialized personnel.

(four) to urge the ship owners, operators and crew members to abide by the laws, regulations and rules relating to inland river traffic safety.

(five) other duties as prescribed by laws and regulations. Article 15 Ferry operators shall bear the main responsibility for the safety of ferries and ferries, and shall set up bulletin boards at obvious positions of ferries to indicate the passenger quota and safety precautions. Sixteenth ferries shall be transported in accordance with the approved routes, and shall not be overloaded; When ferrying, the passing ships shall be avoided and shall not be forced to cross. Article 17 The wharf operator shall bear the main responsibility for wharf safety, and shall arrange berths with sufficient water depth, length and corresponding facilities for ships to berth according to the channel conditions and the designed berthing capacity of the wharf. Article 18 A ship shall sail on the prescribed route and be used for the prescribed purposes, and the number of passengers and cargo shall not exceed the approved number of passengers and cargo weight. Article 19 The owner or operator of a ship shall bear the main responsibility for the water safety of his ship and perform the following obligations:

(a) to establish and implement safety production and safety management systems and measures.

(2) Set up a safety management organization as required, provide safety management personnel, and formulate the system and operating rules for the use, repair and maintenance of the ship to ensure the seaworthiness of the ship and the competency of the crew.

(3) Equipped with necessary facilities and equipment for ship navigation safety in accordance with relevant regulations.

(four) the development of water safety emergency plan, and regular exercise.

(five) to ensure the capital and technical input required for safe production and safety management.

(six) other obligations stipulated by laws and regulations.
