Chapter 1 General Provisions

Chapter 2 Vehicles and Drivers
Article 8 The traffic management department of the public security organ may implement road traffic flow control on motor vehicles based on the road traffic conditions and vehicle ownership.

Article 21 Without affecting the passage of pedestrians and vehicles, the traffic management department of the public security organ, together with the relevant administrative departments, may designate parking spaces within the scope of urban roads.
Under any of the following circumstances, the designated parking spaces shall be removed:
(1) The parking spaces have affected the passage of pedestrians and vehicles;
(2) Parking lots (garages) around the road can meet parking needs.
Article 22 Blind paths and sidewalks should be kept safe and smooth. No unit or individual may occupy or damage blind paths and supporting facilities, or damage or occupy sidewalks or non-motorized lanes without authorization, unless otherwise provided by laws and regulations.
Chapter 4 Road Traffic Regulations
Article 23 Fuel-fuelled vehicles are prohibited on roads in Shangcheng District, Xiacheng District, Xihu District, Gongshu District, Jianggan District and Binjiang District of this city. Article 32 Non-motor vehicle drivers shall abide by the following regulations:
(1) Driving at night or in low visibility conditions such as fog, rain, snow, hail, sand, etc. Under certain circumstances, people driving electric bicycles or motorized wheelchairs for disabled people should turn on the lights;
(2) When entering a roundabout, you should drive in the direction indicated by the traffic signal and give way to vehicles already in the intersection;
(3) Non-motorized vehicles are not allowed to be driven for business;
(4) Motorized wheelchairs for disabled persons are not allowed to be driven by persons with non-lower limb disabilities;
(5) Driving an electric bicycle shall not exceed the driving speed prescribed by the state.
Chapter 5 Traffic Accident Prevention
Article 33 The municipal, district, county (city) people’s governments shall prevent and reduce traffic accidents and ensure safe and smooth road traffic. In principle, organize the formulation of emergency plans to deal with natural disasters, severe meteorological conditions, environmental pollution and other emergencies that affect road traffic safety.
Public security, transportation, environmental protection, health, urban management and other departments should formulate their own specific implementation plans based on emergency response plans. When the situation stipulated in the emergency response plan occurs, all relevant departments should immediately activate the emergency response plan, cooperate closely, communicate and feedback information in a timely manner.
Article 34 State agencies, enterprises, institutions, social groups and other organizations shall establish and implement their own road traffic safety management responsibility system and abide by the following provisions:
( 1) Educate the personnel of the unit to abide by road traffic safety laws and regulations, and establish a system for the daily use, maintenance, repair, and inspection of motor vehicles in the unit;
(2) When hiring drivers to drive motor vehicles, they must inspect Their driving qualifications and road traffic safety training;
(3) Accept traffic safety supervision and inspection by the traffic management department of the public security organ.
A road transport operating unit shall have its legal representative responsible for traffic safety work. Chapter 6 Law Enforcement Supervision

Article 36 The traffic management department of the public security organ and its traffic police shall enforce the law in a fair, strict and civilized manner, and shall not abuse their power, neglect their duties, engage in malpractice for personal gain, accept bribes, or make things difficult for those responsible for road traffic safety management. .
Chapter 7 Legal Responsibilities
Article 37 The traffic management department of the public security organ and its traffic police shall promptly correct violations of road traffic safety and comply with the Road Traffic Safety Law , the Implementation Regulations of the Road Traffic Safety Law, the Provincial Measures for the Implementation of the Road Traffic Safety Law and the provisions of these Regulations shall be punished. However, if the road traffic safety violations listed in this chapter are minor and do not affect road traffic, the violation shall be pointed out and a verbal warning shall be given. Release.

Article 38 Anyone who violates the provisions of these Regulations and falls under any of the following circumstances shall be given a warning or a fine of not less than five yuan but not more than fifty yuan by the traffic management department of the public security organ:
( 1) Driving electric bicycles or motorized wheelchairs for disabled people without turning on the lights at night or in low-visibility conditions such as fog, rain, snow, hail, sand, etc.;

(3) Modifying or dismantling the speed limiter of an electric bicycle;

Article 39 Anyone who violates the provisions of these regulations and drives an electric bicycle exceeding the speed prescribed by the state shall be fined 50 yuan by the traffic management department of the public security organ.
Article 40 If a motor vehicle driver commits any of the following circumstances, the traffic management department of the public security organ shall impose a fine of fifty yuan:
(1) Failure to use lights in accordance with regulations ;
(2) Passenger taxis, school buses, and company buses do not park temporarily in accordance with regulations;
(3) City public passenger vehicles do not enter the station in accordance with regulations;
(4) Vehicles engaged in urban-rural passenger transport do not follow designated routes or stop to pick up and drop off passengers.
If a motor vehicle driver commits any of the following circumstances, the traffic management department of the public security organ shall impose a fine of one hundred yuan:
(1) Lending or using another person’s motor vehicle driving license;

Article 41 In violation of the provisions of Article 10 of these Regulations, units and individuals use motor vehicles not registered in this city to engage in road operations, or recruit drivers holding driving licenses not issued by this city to engage in road operations. If motor vehicle driving work is not registered, the traffic management department of the public security organ shall order the driver to make corrections within a time limit. If the driver fails to make corrections within the time limit, he shall be fined not less than RMB 500 but not more than RMB 2,000.
Article 42 Anyone who violates the provisions of Paragraph 1 of Article 11 of these Regulations and fails to register as required when selling non-motor vehicles shall be ordered by the traffic management department of the public security organ to make corrections within a time limit. Anyone who violates the provisions of Paragraph 2 of Article 11 of these Regulations and produces or sells electric bicycles that do not meet national technical standards shall be punished by relevant departments in accordance with the law.
Article 43 Anyone who violates the provisions of Article 13 of these Regulations by driving a vehicle or machine that is not legally registered on the road shall be fined not less than 20 yuan but not more than 200 yuan by the traffic management department of the public security organ. Fines may be imposed, and vehicles or machinery may be detained until the parties provide corresponding legal certificates.
Article 44 Anyone who violates the provisions of Article 14 of these Regulations by installing or using devices that impede traffic safety on a vehicle shall be forcibly removed by the traffic management department of the public security organ and the illegal device shall be confiscated and the vehicle shall be inspected. Motor vehicle drivers will be fined 200 yuan, and non-motor vehicle drivers will be fined 50 yuan; if the vehicle owner or manager is responsible, the vehicle owner or manager will be punished.

Article 47 Whoever violates the provisions of Article 34 of these Regulations by failing to establish and implement a road traffic safety management responsibility system, or who violates the regulations by implementing a road traffic safety management responsibility system, shall be responsible for the traffic management of the public security organ. Article 48 Violates the provisions of Article 23 of these Regulations by driving a fuel-powered moped, a three-wheeled motorcycle, a human-operated tricycle and other vehicles specified by the traffic management department of the public security organ in prohibited areas. If the vehicle is driven on the road, the traffic management department of the public security organ may detain the vehicle and handle it in accordance with the provisions of the later paragraph, and impose a fine of not less than 20 yuan but not more than 50 yuan on the driver.
Vehicles detained in accordance with the provisions of the preceding paragraph shall be purchased, replaced or consigned back to their place of origin by the municipal, district, county (city) people's government. The costs associated with consignment are borne by the vehicle owner. If the license was originally issued by the relevant municipal department, the original issuing department shall cancel the license in accordance with the law. If the purchase, replacement or consignment is not accepted within the time limit, the traffic management department of the public security organ will handle the matter in accordance with the law.
Article 49 Anyone who drives a motor vehicle or non-motor vehicle to engage in illegal operations shall be punished by the road transportation management agency, and the public security agency shall cooperate. Specific measures will be formulated separately by the Municipal People's Government.
