Interim Measures for Settlement of Travel Expenses of Foreign Travel Agencies

article 1 these measures are formulated in order to settle the travel expenses of foreign travel agencies in time, prevent foreign travel agencies from defaulting on their debts and going bankrupt, and ensure that the legitimate economic interests of China's travel agencies are not harmed. Article 2 China's travel agencies engaged in soliciting and receiving foreign tourists must adhere to the principle of "charging first, then receiving" in the settlement of travel expenses of foreign travel agencies. Article 3 The settlement methods for the expenses of foreign travel agencies organizing tours to China shall be handled according to the following provisions:

(1) Foreign travel agencies must send the travel expenses payable by the tour group to our travel agency account in China Bank before the tour group enters China.

(2) The expenses that increase income due to the increase of travel items during the tour group's trip in China shall be settled before the tour group leaves China.

(3) If a foreign travel agency delays payment for any reason, it must obtain the consent of the person in charge of our travel agency. If the delivery is delayed beyond the time limit for payable travel expenses stipulated in the first or second paragraph of this article, a late fee will be added. The overdue fine shall be collected according to the outstanding amount of foreign currency for foreign exchange preservation and the overdraft interest rate of this foreign currency published by the Bank of China.

(4) the settlement of travel expenses of foreign travel agencies must adhere to the principle that foreign travel agencies should prepay in groups and our travel agencies should calculate in groups. Article 4 Our travel agency must sign a contract or agreement when establishing business contacts with foreign travel agencies. The contract or agreement shall, in accordance with the requirements of these Measures, make specific provisions on the terms of payment for travel expenses, payment period and overdue fine for arrears and other relevant accounts settlement by foreign travel agencies. Article 5 For foreign travel agencies that fail to keep their reputation and are in arrears with travel expenses, resulting in economic losses to our travel agency, our travel agency that is damaged shall promptly report to the local tourism bureau and the National Tourism Administration. The National Tourism Administration will inform the whole country. Domestic tourism departments and units shall not establish business relations with notified foreign travel agencies. If business relations have been established, measures must be taken to clear up the accounts and interrupt their business dealings. If you continue to communicate, you should investigate and deal with the responsible person of the unit. Article 6. If accounts are in arrears due to personal negligence, resulting in bad debts and other economic losses, the responsible person shall be given administrative sanctions and fines according to the nature of negligence and the degree of damage; Those who violate the criminal law shall be investigated for criminal responsibility by judicial organs according to law. Article 7 As of the date of promulgation of these Measures, all travel agencies engaged in soliciting and receiving foreign tourists shall follow these Measures when signing contracts or agreements with foreign travel agencies. Article 8 The National Tourism Administration and the tourism bureaus of provinces, autonomous regions and municipalities directly under the Central Government shall conduct supervision and inspection in accordance with these Measures. Article 9 The tourism administrative departments of all provinces, autonomous regions and municipalities directly under the Central Government may formulate specific implementation plans according to these Measures and report them to the National Tourism Administration for the record.
