Measures for the Protection and Development of Tourism Resources in Linfen City

Article 1: In order to strengthen the protection and development of tourism resources and promote the healthy development of the tourism industry, these Measures are formulated in accordance with the provisions of relevant laws and regulations and in combination with the actual situation of this city. Article 2 These Measures shall apply to the protection, development, supervision and management of tourism resources within the administrative region of this city. Article 3 The protection and development of tourism resources shall adhere to scientific planning, priority in protection, rational development, and the unification of ecological, social and economic benefits. Article 4 The municipal and county (city, district) people's governments shall strengthen the organization and leadership of the protection and development of tourism resources, incorporate the protection and development of tourism resources into the national economic and social development plans of their respective administrative regions, and establish and improve the protection and development of tourism resources. Develop working mechanisms to coordinate and resolve major issues in the protection and development of tourism resources.

The township (town) people's government and sub-district offices assist relevant departments in the protection and development of tourism resources. Article 5 The tourism authorities of the municipal and county (city, district) people's governments shall, in accordance with the provisions of relevant laws, regulations and these Measures, be responsible for the guidance, coordination, supervision and management of the protection and development of tourism resources.

Other relevant departments of the municipal and county (city, district) people's governments shall do a good job in the protection and development of tourism resources in accordance with their respective responsibilities. Article 6: Encourage and guide social forces to participate in the protection and development of tourism resources.

The legitimate rights and interests of investors are protected in accordance with the law. Article 7 The municipal and county (city, district) people's governments shall commend and reward units and individuals that have made outstanding achievements in protecting and developing tourism resources. Article 8 The tourism authorities of the municipal and county (city, district) people's governments shall, in conjunction with relevant departments, conduct a general survey and qualitative classification of tourism resources, establish a tourism resource database, and publish tourism resource data information to the public. Article 9 The municipal and county (city, district) people's governments shall strengthen the protection and development of key tourism resources such as Hukou Falls, Taosi ruins, and large locust trees.

Encourage the development of humanistic and natural resources with Linfen characteristics such as history, culture, revolutionary traditions, folk customs, and forest ecology. Article 10: Municipal and county (city, district) people's governments shall organize the preparation of special plans for the protection and development of tourism resources in their respective administrative regions.

The county (city, district) special plan for the protection and development of tourism resources shall comply with the municipal tourism development plan and the special plan for the protection and development of tourism resources. Article 11 When developing tourism resources that cross administrative regions and are suitable for overall development and utilization, the relevant county (city, district) people's governments shall negotiate and prepare a unified special plan for the protection and development of tourism resources, and submit it to the municipal people's government for approval before implementation. If the Municipal People's Government deems it necessary to prepare uniformly, it shall organize the preparation. Article 15 Detailed plans for tourist attractions (spots) to be prepared and revised shall be submitted to the local county (city, district) tourism department, reviewed by the county (city, district) tourism department in conjunction with relevant departments, and reported to the people's government at the same level. Article 16 The people's government of the county (city, district) where the tourism resources are located shall delimit the scope of tourism resource protection and construction control zones in accordance with the special plan for the protection and development of tourism resources. Article 17 The development and utilization of tourism resources shall comply with the tourism development plan and the special plan for the protection and development of tourism resources, and environmental impact assessment shall be conducted in accordance with the law. Article 18 Tourism resource developers shall prepare a tourism resource protection and development plan before applying for project approval and construction permits. After obtaining project establishment and construction permits, tourism resource developers shall submit the development plan and construction permit to the tourism authorities where the tourism resources are located for filing within thirty days.

The protection and development plan should include protection measures during the development process of tourism resources as well as tourism resource protection measures for tourist attractions (spots) after completion. Article 19 If key tourism resource development projects involve new construction land and comply with the overall land use plan, they should be prioritized within the city's annual land use plan indicators. Article 20 When developing tourism projects using cultural resources such as ancient ruins, celebrity relics, historical memorial sites, and ancient temple buildings, their unique traditional patterns and historical features shall be protected and shall not be rebuilt, relocated or demolished without authorization.

When developing tourism projects using natural resources, the integrity and stability of the ecosystem should be protected, and the ecology should not be damaged or the environment polluted.

When developing tourism projects, facilities that hinder or damage the overall effect of the landscape must not be constructed within tourist attractions (spots). Article 21 The development and operation of state-owned tourism resources shall implement the separation of management rights and operation rights. The transfer of tourism resource management rights shall follow the principles of openness, fairness and impartiality, and shall be conducted in accordance with the law through bidding, auction and other methods.

People's governments at or above the county level should establish a tourism resource development withdrawal mechanism to revoke or take back the tourism resource management rights in accordance with the law for projects that seriously damage tourism resources or have been left idle for a long time. Article 22: Municipal and county (city, district) people's governments shall allocate funds for the protection and development of key tourism resources, and increase them year by year based on economic development and the needs for tourism resource protection and development.
