Interim Measures for the Administration of Tourism Market in Fujian Province

Chapter I General Provisions Article 1 In order to meet the needs of the socialist market economy, promote and develop the tourism industry in this province, standardize market behavior, and protect the legitimate rights and interests of tourists and tour operators, these measures are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this province. Article 2 The people's governments of states, cities and counties (districts) where conditions permit shall incorporate tourism into their local national economic and social development plans and take measures according to local conditions to promote the development of tourism. Article 3 Enterprises, institutions, economic organizations or individuals conforming to these Measures are encouraged to engage in tourism business activities in this province. Article 4 The Fujian Provincial Tourism Bureau is the tourism administrative department of the Fujian Provincial People's Government, and implements industry management on the tourism market of the whole province according to law.

State, city and county tourism administrative departments shall, according to the needs of the tourism industry, implement the tourism market industry management within their respective jurisdictions under the leadership of the people's government at the same level and the guidance of the tourism administrative departments at higher levels. Fifth industry and commerce, public security, construction, price, health, planning, foreign trade, transportation, culture and other relevant departments should cooperate in the management of the tourism market according to their respective responsibilities. Sixth tour operators must operate according to law, consciously abide by the rules and norms of the tourism industry, and follow the socialist professional ethics of customer first and quality service.

Tourism operators must strictly implement the national and provincial regulations on tourism safety management to ensure the personal safety and property safety of tourists. Article 7 A tourism enterprise shall, according to the characteristics of the tourism industry, conduct on-the-job training and assessment for its managers, technicians and service personnel. Eighth tourism administrative departments to implement the announcement system for tourism operators. Announcements are divided into opening announcements, renaming announcements, and license revocation announcements. Ninth tourists should consciously protect the tourism resources and take good care of the tourist reception facilities. Tenth tourists and tour operators who damage their legitimate rights and interests have the right to complain to the tourism administration department or other relevant departments. Eleventh tourism enterprises can coordinate tourism prices through tourism industry associations, fraternity and other legally established organizations. Chapter II Tourist Areas Article 12 The construction of tourist areas shall be incorporated into the medium-and long-term overall planning of the province's tourism industry, with overall arrangement and reasonable layout, and coordinated with the local land for infrastructure construction, land for economic development and the overall planning of urban and rural construction. Thirteenth in addition to the provisions of national laws and regulations such as scenic spots, new tourist areas must be approved by the tourism administrative department, and then reported for approval according to the prescribed procedures. Fourteenth tourist area planning shall include the following contents:

(a) the nature and function of the tourist area;

(two) the scope of the tourist area and its peripheral protection zone;

(three) tourism resources development projects or artificial landscape construction projects, and environmental resources protection measures;

(four) the reception capacity and safety and fire control facilities in the tourist area;

(5) Traffic, communication and corresponding supporting facilities in tourist areas;

(six) rest places, sanitary toilets and other service facilities in the tourist area;

(seven) other matters that need to be planned.

The planning of tourist areas shall be jointly reviewed by the tourism administrative departments and relevant departments. Fifteenth tourist areas are divided into one, two and three levels according to the tourist value, environmental quality, traffic conditions, facilities, management level and service quality, and are included in the international, domestic and provincial tourist routes for publicity and promotion.

The grading standards and evaluation methods of tourist areas shall be formulated separately by the Provincial Tourism Bureau and submitted to the provincial government for approval and implementation. Chapter III Travel Agencies Article 16 The business scope, start-up conditions, registered capital and examination and approval authority of travel agencies shall be implemented in accordance with the provisions of national laws and regulations. Article 17 An applicant for establishing a travel agency shall, after obtaining the Travel Agency Business License with the permission of the tourism administrative department, go through the registration formalities with the administrative department for industry and commerce within 30 days, and can start business only after obtaining the business license upon approval.

The travel agency shall put the business license and business license of the travel agency in a prominent position in the business premises. Eighteenth travel agencies and their branches shall operate the travel agency business in accordance with the scope specified in the travel agency business license.

Travel agencies shall not transfer or transfer the business license of travel agencies in disguised form. Nineteenth travel agencies should pay the deposit according to the Interim Provisions of the National Tourism Administration on the Quality Deposit of Travel Agencies and its detailed rules for implementation. Twentieth travel agencies to apply for outbound tourism business, must be audited by the Provincial Tourism Bureau, reported to the National Tourism Administration for approval.

Travel agencies applying for outbound travel agency business must be approved by the city (prefecture) level tourism administrative department and submitted to the Provincial Tourism Bureau for examination and approval.

Travel agencies applying for the establishment of outbound travel agencies must be approved by the administrative department of tourism at the prefecture level. Twenty-first travel agencies should provide services in accordance with the travel contracts or agreements signed with tourists and consciously safeguard the legitimate rights and interests of tourists.

Provincial Tourism Bureau formulates standard travel contracts for reference when travel agencies sign contracts with tourists. Twenty-second group travel agencies shall handle travel accident insurance for overseas tourists and tour guides. Twenty-third travel agencies to organize and guide overseas tourists to stay, eat and shop, should be arranged in overseas tourism designated units.

Travel agencies can conclude contracts with designated foreign-related shopping stores in accordance with the law and collect commissions, but both parties should record them truthfully.
