Regulations of Xinjiang Uygur Autonomous Region on Border Management

Chapter I General Provisions Article 1 In order to strengthen border management, safeguard national sovereignty and territorial integrity, safeguard security and stability in border areas, and promote economic and social development in border areas, these Regulations are formulated in accordance with relevant state laws and regulations and in light of the actual situation of the autonomous region. Article 2 All units and individuals who live, travel, produce or engage in other activities in the border areas of the autonomous region shall abide by these regulations. Article 3 Border management as mentioned in these Regulations includes border management and border area management; Border areas include border management areas, border zones and border restricted areas.

Border management area refers to the area under the jurisdiction of townships, towns and farms on the national border.

The border zone refers to the area within two kilometers near the national border, but the nearest place to the national border shall not be less than twenty meters.

The closed border area refers to the special control area designated in some areas of the border management area. Article 4 Public security frontier organs shall be responsible for border management. Border guards and foreign affairs departments are responsible for border management according to their respective responsibilities. Article 5 The people's governments of autonomous regions and people's governments at all levels in border areas shall strengthen their leadership in border management, bring them into the scope of comprehensive management of social security, establish and improve joint defense organizations, gradually increase investment in border facilities construction, and ensure border management funds such as border defense subsidies. Article 6 All units and individuals have the obligation to defend national borders, protect national border signs and border facilities, and maintain social order and security in border areas. Article 7 People's governments at or above the county level in border areas shall commend and reward units and individuals that have made remarkable achievements in border management. Chapter II Border Management Article 8 No one may enter or leave the country illegally, or engage in illegal transactions or other illegal activities on the land border or the boundary river (lake). Article 9 The establishment, maintenance or reconstruction of boundary markers, boundary markers or other permanent signs indicating national boundaries shall be carried out in accordance with the border treaties, agreements or protocols signed by the state and its neighboring countries.

No unit or individual may damage, move or dismantle border facilities and border signs. Article 10 No unit or individual is allowed to carry out activities and engineering operations that change or may change the direction of national boundaries, affect or may affect the stability of river courses in boundary rivers; If it is really necessary, it shall be implemented in accordance with the agreements reached between the state and neighboring countries and the relevant provisions of the state. Article 11 Entry-exit personnel, their luggage, articles, means of transport and the goods they carry shall pass through ports designated by the state or temporary transit passages agreed with neighboring countries, and shall be subject to entry-exit inspection, quarantine and inspection in accordance with state regulations. Twelfth border talks, conferences and other public officials and their means of transportation need to temporarily enter or leave the country, in accordance with the agreement reached between the state and neighboring countries. Thirteenth border residents to visit relatives, travel and trade activities in the border areas of neighboring countries, in accordance with the agreement reached between the state and neighboring countries and the relevant provisions of the state. Fourteenth in the state and the autonomous region approved the opening of border ports, you can delimit a certain range of port restrictions. Port restricted areas include border tunnels, port joint inspection places and vehicle inspection and monitoring places. The border tunnel is the area between the port joint inspection site and the national boundary.

The delimitation and management plan of the port restricted area shall be put forward by the public security frontier defense organ at the port location in conjunction with the port management department, and shall be implemented after being approved by the state people's government or the regional administrative office at the port location. Chapter III Management of Border Areas Article 15 The people's government of the autonomous region shall delimit and adjust the border management areas, border zones and border restricted areas according to the needs of border management, set up obvious signs and make them known to the public in a timely manner.

A special management system is implemented in the border closed area, and no one is allowed to enter without the approval of the people's government of the autonomous region. Article 16 Persons entering or leaving the border management zone shall hold resident identity cards or valid certificates as prescribed by laws and regulations and accept inspection by the public security frontier organs. Article 17 No unit or individual may organize or transport persons without valid certificates or those who illegally cross the border into or out of the border management zone; Do not hide or fund illegal border crossing personnel; Don't accept or place people without valid documents. Eighteenth China citizens who are not in the border management area shall go through the registration formalities in accordance with the relevant provisions of the state and the autonomous region when they enter the border management area for temporary residence or foreigners (including stateless persons) stay in the border management area. Nineteenth relevant administrative departments should strictly control the exploration, mining, logging, herb gathering, fishing, blasting and other production operations that must be approved according to law in the border management area, and seek the opinions of the public security frontier organs when examining and approving.

Units and individuals engaged in the activities mentioned in the preceding paragraph shall be carried out in accordance with the approved scale, scope and time limit, and shall be subject to the management of the public security frontier organs. Article 20 Foreigners (including stateless persons) are not allowed to enter the border areas except for entry and exit needs. Twenty-first in the border areas engaged in surveying and mapping, filming, scientific investigation, burning, etc., should be reported to the local public security frontier organs in advance, and within its designated scope. Twenty-second in addition to performing official duties, no guns may be fired in border areas. Twenty-third grazing in border areas should be guarded by special personnel and groups to prevent livestock from crossing the border.

If our livestock cross the border and enter the territory of neighboring countries, they should report to the local public security frontier defense organs in time, and the public security frontier defense organs will intervene to recover them. Individuals are not allowed to cross the border to catch up; Chinese livestock returned by neighboring countries shall be received by the public security frontier organs, quarantined by the animal husbandry department and dealt with according to relevant regulations.

Livestock from neighboring countries entering the vicinity of China's territory shall be expelled on the spot; Those who are far away from national borders shall be promptly sent to the local public security frontier defense organs or frontier defense forces, and shall be dealt with in accordance with relevant regulations, and shall not be hidden, served, traded or slaughtered.
