Xi Measures for the Supervision and Administration of Tourism Market

Article 1 In order to standardize the order of the tourism market, strengthen the supervision and management of the tourism market, and safeguard the legitimate rights and interests of tourists and tour operators, these Measures are formulated in accordance with the Tourism Law of the People's Republic of China, the Tourism Regulations of Shaanxi Province, the Tourism Regulations of xi and other relevant laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Measures shall apply to the tourism activities within the administrative area of this Municipality, the business activities of providing relevant services for tourism activities and the supervision and management of the tourism market. Third tourism market supervision and management adhere to the principles of territorial management, departmental linkage, industry self-discipline and social supervision, strengthen comprehensive management, establish and improve the supervision and management system. Article 4 The Municipal People's Government shall establish a joint meeting system for comprehensive supervision of the tourism market, notify the comprehensive supervision of the tourism market, coordinate major joint law enforcement actions, and study and solve major problems in comprehensive supervision and joint law enforcement.

County People's Government, Xixian New Area and Development Zone Administrative Committee are responsible for the organization and leadership of the supervision and management of the tourism market in this area, and establish and improve the comprehensive supervision mechanism such as comprehensive coordination of tourism, joint investigation and handling of tourism cases, and unified acceptance of tourism complaints. Article 5 The municipal tourism administrative department shall implement unified supervision and management of the city's tourism market, and coordinate relevant departments to conduct comprehensive supervision and management of the tourism market.

The county-level tourism administrative department is responsible for the unified supervision and management of the tourism market in this area, and coordinates the comprehensive supervision and management of the tourism market.

The relevant administrative departments of cities, districts and counties shall do a good job in the supervision and management of the tourism market in accordance with their respective responsibilities. Sixth relevant departments of the city, district and county shall perform the duties of supervision and management of the tourism market in accordance with the following division of labor:

(a) the tourism administrative department is responsible for supervising and investigating the illegal acts of travel agencies such as organizing unreasonable low-cost tours, forcing and disguised forced consumption, and violating travel contracts;

(two) the public security organs are responsible for maintaining public order in tourist attractions, tourist traffic stations and other areas where tourists are concentrated, and investigating and dealing with illegal and criminal acts such as forced trading and extortion that infringe on the rights and interests of tourists;

(3) The administrative department for industry and commerce is responsible for supervising and investigating illegal acts such as false advertising, unfair competition, operating without a license, selling fake and shoddy goods, and infringing upon the legitimate rights and interests of tourists by using the terms of the contract format;

(four) the traffic administrative department is responsible for supervising and investigating the illegal acts in the tourist passenger transport market;

(5) The competent pricing department is responsible for supervising and investigating the illegal acts of tourism prices such as the failure of tourism operators to implement government pricing and government-guided prices, failure to clearly mark prices according to regulations, fraud, low-price dumping, bundled sales of scenic spots tickets, illegal charges, etc., and accepting tourists' complaints and reports on price violations according to law;

(VI) The urban management department is responsible for supervising and investigating illegal acts such as setting up stalls, soliciting customers, chasing customers and selling, and publishing tourist advertisements in tourist-intensive places and around tourist attractions where urbanization management is implemented;

(seven) the administrative department of culture shall be responsible for the supervision and management of the tourism cultural market, and supervise and investigate the illegal acts such as tourism performances and cultural business activities in entertainment places;

(eight) the sports administrative department is responsible for the market supervision and complaint handling of high-risk sports in tourist attractions;

(nine) the network information department is responsible for cleaning up the false travel information on the Internet according to law, and investigating and dealing with illegal websites and accounts that publish all kinds of false travel information that mislead and defraud consumers;

(ten) religious, cultural relics, quality supervision, commerce, food and drug supervision, safety supervision and other administrative departments in accordance with their respective duties, responsible for the supervision and investigation of illegal acts related to tourism. Seventh tourism administrative departments should adopt various ways to issue early warning of illegal acts in the tourism market, improve public awareness of prevention, remind and guide tourists to consciously resist acts that disrupt the order of the tourism market.

Newspapers, radio, television, internet and other media in this Municipality shall strengthen the propaganda on the management of the tourism market order and supervise the acts that disturb the tourism market order by public opinion. Article 8 Self-regulatory organizations in the tourism industry shall strengthen the education of industry integrity, advocate standardized services, fair competition and mutual supervision among their members, and safeguard the legitimate rights and interests of tourism operators and employees. Article 9 Units and individuals are encouraged to complain and report acts that disrupt the order of the tourism market, such as unqualified tourism business, attracting tourists at unreasonably low prices, cheating and forcing tourists to spend.

The municipal tourism administrative department may establish a reward system to reward informants. Article 10 The municipal tourism administrative department shall improve the information and consulting platform of the city's tourism companies, and provide tourists with necessary information and consulting services such as scenic spots, routes, transportation, meteorology, accommodation, safety, medical first aid, passenger flow warning, service quality of operators, administrative penalties and so on free of charge. The relevant departments shall cooperate with the tourism administrative departments to improve the tourism public information and update it in time. Eleventh municipal tourism administrative departments should strengthen the construction of tourism standardization, jointly with relevant departments to formulate the standards or norms of the city's tourism service quality, tourism products, tourism management and other aspects, and organize their implementation. Article 12 The municipal, district and county tourism administrative departments shall establish a disciplinary system for dishonesty in the tourism industry and a publicity system for tourism credit information, and regularly announce the illegal, illegal and breach-of-contract behaviors of operators and employees who provide services such as sightseeing, transportation, accommodation, catering, shopping and entertainment for tourists in the process of tourism business services.

Tourism operators and employees in any of the following circumstances, the tourism administrative department shall be included in the public credit information platform of Shaanxi Province in accordance with the provisions:

(a) tourism operators and tourism professionals have been fined by administrative organs for violating the legitimate rights and interests of tourists;

(two) a major safety accident occurred in the tour operator, which belongs to the main responsibility of the tour operator;

(3) Tourism operators and tourism professionals are judged by the people's court to bear all or major civil liabilities because of infringement or breach of contract that damages the legitimate rights and interests of tourists, or refuse to implement the court's judgment;

(four) the main person in charge of the tourism business enterprise and the tourism professionals are sentenced to punishment by the people's court for infringing on the legitimate rights and interests of tourists;

(five) in the course of practicing, tourism professionals are subject to administrative punishment or court judgment for disturbing the order of public transportation, damaging public facilities, destroying cultural relics and historical sites in tourist destinations, and violating the social customs of tourist destinations;

(six) tourism operators and tourism professionals infringe upon the legitimate rights and interests of tourists, causing serious social adverse effects;

(seven) other circumstances in which tourism operators and tourism professionals violate laws and regulations.
