Notice of the provincial government on printing and distributing the Interim Measures for the management of tourism development around Taihu Lake in Jiangsu Province

Article 1 These Measures are formulated in accordance with the Law on the Protection of Cultural Relics, Regulations on Environmental Protection in Jiangsu Province, Regulations on the Administration of Scenic Spots in Jiangsu Province, Regulations on the Prevention and Control of Water Pollution in Taihu Lake in Jiangsu Province and other relevant laws and regulations in order to strengthen the protection of tourism resources and the management of tourism development and construction around Taihu Lake in our province, meet the growing tourism demand of the people and promote the sustainable development of tourism. Article 2 These Measures shall apply to all development and construction projects directly related to the development of tourism in the area around Taihu Lake in this province, mainly referring to tourism capital construction and technological transformation projects, including the new construction, expansion, restoration and transformation of tourist attractions (spots), artificial landscapes, amusement parks, ropeways, golf courses and water tourism projects; Public accommodation facilities such as hotels, training centers, resorts, guest houses and sanatoriums; Regional tourism development projects; Real estate projects such as villas, apartments and office buildings; Other development and construction projects directly related to the development of tourism. Article 3 The area around Taihu Lake includes the following areas:

(1) Taihu Lake Scenic Area;

(two) the lakeside zone of 65438 0 km along the coast of Taihu Lake;

(3) tourist resorts;

(4) Taihu Lake and its islands and peninsula. Article 4 The development and construction of tourism projects around Taihu Lake should be based on the premise of protecting resources, environment and landscape, and adhere to the principles of unified planning, rational development and coordinated development. It is strictly prohibited to destroy forests, cut mountains, build graves, reclaim land from lakes, destroy cultural relics and historical sites, cut down old and famous trees, over-develop and other activities that are not conducive to resource protection and sustainable development. Fifth tourism authorities at all levels are the competent departments of tourism around Taihu Lake. The competent departments of planning (economy), foreign trade, finance, construction, land, environmental protection, culture, transportation, opening to the outside world and the office of the Taihu Lake Scenic Area Construction Committee shall, according to their respective functions and duties, do a good job in the supervision and management of tourism resources protection, tourism environment improvement, tourism planning and tourism project development and construction around Taihu Lake. Article 6 Citizens, legal persons or other organizations around Taihu Lake shall abide by these measures, and have the responsibility and right to dissuade and educate the units and individuals who destroy the environment, resources, violate the planning and other illegal tourism projects until they report to the relevant government departments. Article 7 The tourism development plan around Taihu Lake in Jiangsu Province shall be compiled by the Provincial Tourism Planning and Construction Committee and implemented after being approved by the provincial people's government. The people's governments of Suzhou, Wuxi and Changzhou, according to the tourism development plan around Taihu Lake in Jiangsu Province, organize relevant departments to work out the tourism development plan around Taihu Lake in this region, and link it with the overall urban planning, the overall land use planning and the environmental protection planning. The tourism development planning around Taihu Lake within the municipality directly under the Central Government shall be compiled by the municipalities according to the overall land use planning, urban development planning, environmental protection planning and scenic spot planning. , and approved by the Provincial Tourism Planning and Construction Committee, reported to the local Municipal People's government for approval. The tourism development plan around Taihu Lake within the county (city) area shall be examined and approved by the local county (city) people's government after being examined and approved by the tourism authorities at the next higher level. Eighth tourism development and construction projects around Taihu Lake must conform to the tourism industry policy and the tourism development plan around Taihu Lake, and be handled in strict accordance with the project approval procedures stipulated by the state. Before the project is approved, the consent of the administrative department of tourism and environmental protection must be obtained. If it belongs to the Taihu Lake Scenic Area, it must obtain the consent of the competent department of the scenic area. Otherwise, planning (economy), foreign trade, construction, land, planning and other administrative departments at all levels shall not handle relevant procedures for them. Ninth Taihu Lake area shall not be built to destroy the environment, scenery, cultural relics and other tourism resources projects and low-level duplication, tourism projects. Strictly restrict the construction of the following projects in the lakeshore area along the lake 1 km:

Hotels, training centers, resorts, sanatoriums and other public accommodation facilities;

(two) villas, apartments, office buildings and other real estate projects;

(three) large and medium-sized artificial landscape and recreational facilities projects;

(4) House debris;

(5) General industrial projects and other productive projects. Tenth kinds of development and construction projects, according to the original management authority by the provincial, city and county (city) government departments for examination and approval. Where a project falls within one of the following ranges, it must be submitted to the Provincial Tourism Planning and Construction Committee for deliberation and approval before going through the formalities of project examination and approval:

(1) Projects within the scope stipulated in Article 9 of these Measures;

(two) the total investment of the project exceeds 30 million yuan, and the total investment of the project using foreign capital exceeds 30 million US dollars; Projects with an area of over 5 hectares or a construction area of over 10000 square meters;

(3) Other projects whose development should be restricted.

The projects listed in Item (2) of the preceding paragraph and regional tourism development projects shall be compiled in the overall planning of the project or regional development, and submitted to the Provincial Tourism Planning and Construction Committee for deliberation after expert argumentation, and improper means such as breaking up parts, building first and reporting later, and ultra vires examination and approval shall not be taken. Eleventh tourism development and construction project layout, height, volume, shape, color, etc. should be coordinated with the surrounding environment and landscape. Approved tourism construction projects are not allowed to arbitrarily change and increase the content, expand the scale, and change the nature and function of the project. The development and construction of tourism projects should try not to occupy or occupy less cultivated land.
