Tourism Regulations of Xishuangbanna Dai Autonomous Prefecture in Yunnan Province (revised in 2009)

Chapter I General Provisions Article 1 In order to protect and rationally develop tourism resources, standardize tourism order, safeguard the legitimate rights and interests of tourists, tour operators and tourism professionals, and promote the healthy development of tourism, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Regional Ethnic Autonomy, the Regulations on Tourism in Yunnan Province and other laws and regulations, combined with the actual situation of Autonomous Prefecture. Article 2 These Regulations shall apply to the tourism planning, tourism resources development, tourism management services, tourism activities and tourism supervision and management of Autonomous Prefecture. Article 3 The development of tourism should adhere to the principle of combining protection with rational development, coordinating social benefits, economic benefits and ecological benefits, give full play to regional advantages, and highlight the scenery of tropical rainforests and local ethnic cultural characteristics. Article 4 The people's governments of autonomous prefectures and counties (cities) shall increase investment and support for tourism, incorporate the development of tourism into the national economic and social development plan, and set up special funds to be included in the fiscal budget at the same level. Article 5 The tourism administrative departments of autonomous prefectures and counties (cities) shall be responsible for the guidance, supervision, management and service of the tourism industry within their respective administrative areas.

The relevant administrative departments of autonomous prefectures and counties (cities) shall, in accordance with their respective responsibilities, do a good job in the supervision, management and service of tourism, and promote the healthy development of tourism. Article 6 The people's governments of autonomous prefectures and counties (cities) shall strengthen the supervision and inspection of the tourism market order, and formulate plans for preventing and handling major tourism safety accidents. Article 7 The people's governments of autonomous prefectures and counties (cities) shall commend and reward the units and individuals that have made remarkable achievements in promoting the development of tourism. Chapter II Tourism Construction and Development Article 8 The tourism administrative department of the Autonomous Prefecture shall be responsible for compiling the tourism development plan of the Autonomous Prefecture, which shall be audited by the provincial tourism administrative department and submitted to the people's government of the Autonomous Prefecture for approval and implementation.

County (city) tourism administrative department is responsible for the preparation of tourism development planning and other special tourism planning within their respective administrative areas, which shall be submitted to the county (city) people's government for approval and implementation after being audited by the tourism administrative department of Autonomous Prefecture. Ninth Autonomous Prefecture to implement the system of paid use of scenic resources. The paid use fees of scenic resources collected from scenic spots (spots) are earmarked for protecting ecological resources and developing tourism. Tenth new construction, renovation and expansion of tourism projects shall conform to the tourism development plan. Tourism projects involving ethnic and religious contents shall solicit the opinions of the administrative departments of ethnic and religious affairs at the same level. Eleventh autonomous prefectures and counties (cities) people's governments shall formulate preferential policies to encourage various economic organizations and individuals to invest in the development of tourism projects and produce and operate tourism products with ethnic characteristics.

Tourism administrative departments and relevant administrative departments shall provide investors with tourism development plans and related information, and do a good job in service. Twelfth autonomous prefectures and counties (cities) people's governments should strengthen regional tourism economic cooperation, establish tourism promotion mechanism and inter-regional interaction mechanism, promote the development of tourism, and vigorously promote barrier-free tourism. Thirteenth tourism administrative departments should establish a tourism information forecasting system and a tourism early warning information release system. Chapter III Standards for Tourism Management Article 14 The tourism administrative department shall establish a warning system for tourism enterprises and an annual inspection and elimination system. Establish a coordination mechanism for retail prices of tourism products. Fifteenth tourism administrative departments to implement standardized rating management of tourism facilities and tourism service quality of tourism operators, and make an announcement to the public.

Travel agencies should choose qualified tour operators as service providers when receiving tour teams. Sixteenth tourism operators should conclude labor contracts with the tourism professionals they employ, pay wages and pay social security fees for them.

When hiring employees, tourism operators should give priority to local ethnic minorities under the same conditions. Seventeenth in the tourist attractions (spots) to prohibit the construction or organization of tourism projects and activities that are detrimental to national dignity and hurt national feelings.

The operation of special tourism projects such as passenger transport, ropeway, cable car, adventure, rafting and large amusement parks involving personal safety shall be approved by the relevant administrative departments before operation.

Tourism operators should regularly check facilities involving personal safety to ensure the personal safety of tourists. Twentieth tour operators prohibit the following acts:

(a) choose operators who do not have business qualifications as service providers;

(two) renting a car (boat) that has not obtained the qualification of tourist passenger transport to engage in tourism activities;

(three) the tourism team does not make a tourism plan;

(4) Hiring and appointing untrained and qualified personnel to engage in tourism services;

(five) to collect fees from tour leaders, tour guides and other tourism professionals, such as deposit and advance tour fees;

(six) the production and sale of fake and shoddy goods.
