Chapter 1 General Provisions Article 1 In order to further expand opening up to the outside world, develop and utilize our city's rich tourism resources, promote the transformation of our city's tourism industry from sightseeing to sightseeing and vacation, and accelerate the development of the tourism industry, according to The "Notice of the State Council on Issues Concerning the Pilot Operation of National Tourist Resorts" and relevant regulations formulate these measures. Article 2 Dalian Jinshitan National Tourist Resort (hereinafter referred to as the resort) is a comprehensive tourist resort established with the approval of the State Council of the People's Republic of China and mainly receives overseas tourists. Article 3: Resorts shall focus on developing high-foreign exchange-earning tourism industries and appropriately develop productive enterprises that serve the tourism industry.

Enterprises in the resort must be modern, export-oriented, high-earning foreign exchange, and high-efficiency enterprises. Article 4: Encourage foreign countries, Taiwan and Hong Kong. Enterprises and other organizations and individuals in Macao (hereinafter referred to as foreign investors) invest in resort areas, develop tourism facilities and operate tourism projects. Article 5 Enterprises, other organizations and individuals in the resort must abide by the laws and regulations of the People's Republic of China and the relevant provisions of Liaoning Province and Dalian City, and their legitimate rights and interests are protected by law. Article 6 The resort must strengthen planning and management, and the overall plan of the resort should be coordinated with the overall plan of Dalian Jinshitan National Key Scenic Area.

No unit or individual may damage the natural resources of Jinshitan Scenic Area. Chapter 2 Management Organization Article 7 The resort establishes a management committee (hereinafter referred to as the resort management committee) to implement unified management of the resort under the leadership of the Dalian Municipal People's Government. Article 8 The main powers of the resort management committee are:

(1) Prepare the overall plan and development plan of the resort and be responsible for organizing its implementation after approval by the Municipal People's Government;

(2) Implement national laws and regulations as well as relevant laws and regulations of Liaoning Province and Dalian City, and formulate and issue relevant specific management regulations for the resort;

(3) Examine and approve investments in the resort in accordance with regulations Project;

(4) Manage the finance, industry and commerce, labor and personnel, land and real estate, environmental protection, road traffic, public security and fire protection in the resort;

(5) Responsible for the resort Construction and management of various basic public facilities within the resort;

(6) Handling foreign-related affairs within the resort;

(7) Exercising other powers granted by the Municipal People's Government. Article 9 Customs, foreign exchange administration, banking, insurance and other departments shall, upon approval, set up branches or dispatched agencies in the resort to handle relevant business and provide convenience for investors. Article 10: Relevant departments of the Municipal People's Government should strengthen business guidance to the functional departments under the resort management committee and support the resort management committee in implementing unified management of the resort. Chapter 3 Investment and Operation Management Article 11 Enterprises, other organizations and individuals within and outside China may, upon approval, establish enterprises in resort areas through joint ventures, cooperation, sole proprietorships, etc., invest in the development of tourism facilities and operate tourism projects. Article 12 The resort encourages investment, development, construction and operation of the following projects:

(1) Tour and entertainment projects;

(2) Hotels, villas, catering and shopping and other service projects ;

(3) Production enterprises serving the tourism business;

(4) Public utilities, infrastructure and construction projects supporting the resort;

(5) Other tourism and service items. Article 13 Within the resort area, foreign exchange shops, duty-free shops or Sino-foreign joint ventures may be established with approval. Specific approvals shall be handled in accordance with relevant national regulations. Article 14 With the approval of the National Tourism Administration, a first-class Sino-foreign joint venture travel agency may be opened in the resort to operate overseas tourism business in the resort. Article 15 It is prohibited to build projects that pollute the environment in the resort area. Article 16 To establish an enterprise in a resort area, an application should be submitted to the resort management committee, and after approval, the industrial and commercial and tax registration management procedures should be completed in accordance with regulations.

If you need land for investment, construction and operation of tourism projects in the resort, you should apply to the resort management committee for land use procedures in accordance with the relevant provisions of the "Dalian City State-owned Land Use Rights Assignment and Transfer Management Measures" , receive the land use certificate. Article 17 Enterprises in resort areas may determine their own internal organizations, staffing levels, recruitment standards and wage distribution forms. Enterprises are not restricted by district boundaries in recruiting employees, and all employees are subject to a labor contract system. Article 18 Enterprises in resort areas should establish financial and accounting books. Enterprises operating a variety of businesses should establish separate accounting books according to business types. Special account books approved by the customs should be established for import and export tax-free goods and materials handled by the customs as bonded goods.

Enterprises should submit accounting statements to the resort’s finance, taxation, customs and other relevant departments in accordance with regulations and accept supervision. The company's annual accounting statements should be verified and certified by a Chinese registered accountant. Article 19 If an enterprise in the resort changes its name, business location, legal representative, economic nature, business scope, business method, registered capital, business period, division, merger, termination of business, etc., it shall apply for changes in accordance with relevant regulations. Register or unregister. Article 20 The profits earned by foreign investors from domestic and foreign-invested enterprises in resort areas, the salaries of foreign employees and their other legitimate income can be remitted abroad after paying taxes in accordance with the law. Article 21 All foreign exchange management of enterprises within the resort area shall be responsible for the designated Bank of China or other banks designated by the foreign exchange management department.
