Article 1 In order to standardize the identification and management of representative inheritors of intangible cultural heritage in Wuxi, and encourage and support representative inheritors of intangible cultural heritage in Wuxi to carry out inheritance activities, these Measures are formulated in accordance with the People's Republic of China (PRC) Intangible Cultural Heritage Law, the Measures for the Identification and Management of Representative Inheritors of National Intangible Cultural Heritage and other laws, regulations and normative documents. "Regulations on the Protection of Intangible Cultural Heritage in Jiangsu Province" and "Administrative Measures for the Identification of Representative Inheritors of Intangible Cultural Heritage in Jiangsu Province", combined with the actual situation of our city.
Article 2 The term "representative inheritor of Wuxi intangible cultural heritage projects" as mentioned in these Measures (hereinafter referred to as "representative inheritor of municipal intangible cultural heritage") refers to the inheritor who is responsible for the inheritance of Wuxi intangible cultural heritage representative projects, is representative in a specific field, has great influence in a certain area, and has been recognized by the Wuxi Municipal Department of Culture and Tourism Administration.
Article 3 The identification and management of representative inheritors of municipal intangible cultural heritage should be based on improving the inheritance system of intangible cultural heritage and enhancing the vitality of intangible cultural heritage, respecting the subject status and rights of inheritors, paying attention to the sense of identity of communities and groups, making efforts to cultivate a new generation of inheritors, gradually forming a protective inheritance group with optimized age level, reasonable echelon structure, wide coverage and full of inheritance vitality, and promoting the creative transformation and innovative development of intangible cultural heritage.
Representative inheritors of municipal intangible cultural heritage should temper their loyalty, persistence and simplicity, enhance their sense of mission and responsibility, improve their practical ability of inheritance, abide by the Constitution, laws and regulations, abide by social ethics, adhere to the correct view of history, nation, culture, and build a solid sense of Chinese national identity, and must not use intangible cultural heritage in a distorted or derogatory way.
Article 4 The Wuxi Municipal Department of Culture and Tourism Administration is responsible for the identification and management of the representative inheritors of municipal intangible heritage, and carries out the identification of the representative inheritors of municipal intangible heritage once every five years.
Article 5 The identification of representative inheritors of municipal intangible heritage shall adhere to the principles of openness, fairness and impartiality, and strictly perform the procedures of declaration, examination, evaluation, publicity, identification and publication.
Article 6 A representative inheritor who declares municipal intangible heritage shall meet the following conditions:
(a) patriotism, law-abiding, honest and trustworthy, moral and artistic accomplishment;
(two) clear pedigree, with a clear relationship between teachers and students;
(three) to master the knowledge and core skills of the representative intangible cultural heritage, and to engage in the practice of intangible cultural heritage inheritance for more than 20 years (inclusive);
(four) in the field of intangible cultural heritage, it is recognized as representative and has great influence in a certain area;
(five) living or working in the area where the municipal intangible cultural heritage is located for a long time, and actively carrying out inheritance activities, and adopting an effective model to train follow-up talents.
In accordance with the provisions of laws and regulations must have special qualifications, the representative inheritor shall obtain the corresponding qualification certificate.
If the municipal intangible cultural heritage inheritance project is endangered or lack of successors, the conditions for the identification of the municipal intangible cultural heritage inheritor of the project may be appropriately relaxed. Article 7 Persons who are engaged in the collection, collation and research of intangible cultural heritage materials and are not directly engaged in the inheritance of intangible cultural heritage projects may not declare the representative inheritors of municipal intangible heritage.
Eighth municipal intangible heritage representative inheritor's application, proposed by the individual voluntarily, recommended step by step. The applicant shall truthfully submit the following materials to the local county-level city or district administrative department of culture and tourism:
(a) the applicant's name, age, gender, nationality, working hours and other basic information;
(2) The pedigree or background, knowledge and practical experience of the applicant;
(three) the technical expertise, achievements, honorary awards and related certification materials of the intangible cultural heritage mastered by the applicant;
(four) the applicant's apprenticeship experience and participation in social welfare activities;
(5) Relevant objects and materials of intangible cultural heritage owned by the applicant;
(6) A statement that the applicant voluntarily engages in intangible cultural heritage inheritance activities and fulfills relevant obligations of representative inheritors;
(seven) other materials that help to explain the representativeness and influence of the applicant.
Article 9 After receiving the application materials, the municipal and district administrative departments of culture and tourism at the county level shall organize experts to conduct an audit, put forward the recommended candidates and audit opinions, and submit them together with the application materials and audit opinions to the Wuxi administrative department of culture and tourism.
Article 10 The Wuxi Municipal Department of Culture and Tourism Administration shall review the application materials in time after receiving them. Meet the requirements, enter the review process; Do not meet the requirements, return the materials and explain the reasons.
Eleventh Wuxi city cultural and tourism administrative departments shall form an expert review group and an expert review committee. The expert review group is responsible for the preliminary evaluation of the applicants who meet the conditions for the identification of the representative inheritors of municipal intangible heritage, and puts forward the candidates for preliminary evaluation. The initial evaluation shall include written evaluation and on-site evaluation. The expert review committee deliberates the preliminary evaluation candidates and proposes the candidates recommended by the municipal intangible heritage representative inheritors. The members of the expert review group and the expert review committee shall not be less than 5.
Twelfth Wuxi municipal administrative department of culture and tourism shall publicize the candidates recommended by the municipal representative inheritors recommended by the expert review committee to the public for 20 days.
Citizens, legal persons and other organizations have objections to the candidates recommended by the municipal non-legacy representative inheritors, and can put forward their real names to the Wuxi Municipal Department of Culture and Tourism Administration in writing during the publicity period. Wuxi municipal administrative department of culture and tourism shall organize an investigation. If the objection is not established, it shall inform the objector in writing within 30 days from the date of receiving the objection and explain the reasons; If the objection is established, it shall be re-evaluated in accordance with the provisions of Article 11 of these Measures.
Thirteenth Wuxi municipal administrative department of culture and tourism shall, according to the deliberation opinions and publicity results of the expert review committee, identify the list of municipal non-legacy representative inheritors, publish them and issue certificates.
Article 14 The preliminary evaluation and deliberation of the representative inheritors of municipal intangible heritage shall be subject to the withdrawal system. If the members of the expert review group and the expert review committee are interested in the applicant, they shall withdraw.
Fifteenth Wuxi city cultural and tourism administrative departments to establish a municipal intangible heritage representative inheritor files, and update the relevant information in a timely manner.
The contents of the archives mainly include the basic information of the municipal non-legacy representative inheritors, their participation in study and training, their inheritance activities, their participation in social welfare activities, and the evaluation of the cultural and tourism administrative departments.
Sixteenth cultural and tourism administrative departments at all levels shall, according to the present situation and actual situation of the project inheritance, take the following measures to support the municipal non-legacy representative inheritors to carry out activities such as inheritance and exchange:
(a) to provide or coordinate the necessary places for inheritance and dissemination;
(two) support them to carry out activities such as learning from teachers, art exchanges and exchanges;
(three) to guide and support them to carry out activities such as recording, sorting, archiving, research, publishing, exhibition and performance of intangible cultural heritage;
(four) to support their participation in learning and training;
(five) to support their participation in social welfare activities;
(six) to support the inheritance and dissemination of its intangible cultural heritage.
Seventeenth municipal non-legacy representative inheritors enjoy the following rights:
(a) to carry out inheritance and communication activities in the name of the representative inheritor of municipal intangible heritage;
(two) enjoy the provisions of the inheritor grant funds;
(three) according to the needs of inheritance practice, to obtain corresponding remuneration for inheritance, dissemination or other activities;
(four) other rights related to the protection of intangible cultural heritage.
Eighteenth municipal non-legacy representative inheritors shall bear the following obligations:
(a) to carry out inheritance activities and train successors;
(2) Properly protect and preserve relevant materials and articles;
(three) to cooperate with the Wuxi municipal administrative department of culture and tourism and other relevant departments to investigate, record and study the intangible cultural heritage;
(four) to cooperate with or carry out public welfare publicity activities of intangible cultural heritage;
(five) to accept the evaluation of the Wuxi municipal administrative department of culture and tourism and the performance appraisal of the matching funds;
(six) other obligations related to the protection of intangible cultural heritage.
Article 19 The administrative department of culture and tourism of Wuxi Municipality shall formulate the evaluation criteria for the performance of obligations by the representative inheritors of municipal intangible heritage, and organize experts to conduct a round of evaluation on the representative inheritors of municipal intangible heritage every three years. The evaluation results are the main basis for continuing to enjoy the qualifications and rights of representative inheritors and giving financial policy support and rewards.
Article 20 A representative inheritor who has made an important contribution to the inheritance of the project, but has lost the ability to inherit due to age, health and other reasons, and cannot continue to carry out the protection and inheritance work due to irresistible factors, is named as an honorary inheritor after his own application and expert review organized by the Wuxi Municipal Department of Culture and Tourism Administration.
Twenty-first municipal intangible cultural heritage after the death of the representative inheritor, the local cultural and tourism administrative departments shall promptly report to the Wuxi municipal cultural and tourism administrative departments for the record. The local administrative departments of culture and tourism should express their condolences in an appropriate way and publicize their outstanding contributions to the inheritance of intangible cultural heritage in various forms.
Twenty-second in any of the following circumstances, after verification by the administrative department of culture and tourism of Wuxi City, the qualification of the municipal intangible heritage representative inheritor shall be cancelled:
(1) Having lost China nationality;
(2) Obtaining qualifications by fraudulent or other improper means;
(3) Failing to perform obligations without justifiable reasons, and the inheritor fails to pass the examination to perform obligations, and still fails to pass the rectification within a time limit or fails to pass the cumulative examination twice;
(four) in violation of laws and regulations or social ethics, resulting in significant adverse social impact;
(five) voluntary abandonment or other circumstances that should cancel the qualification of the representative inheritor of intangible cultural heritage.
