Article 1: In order to meet the needs of Dalian’s economic and social development and opening to the outside world, rationally carry out commercial network planning, construction and management, enhance the city’s comprehensive service functions, ensure the living needs of urban residents, and improve people’s lives Quality, in accordance with laws, regulations and relevant national regulations, and in combination with the actual situation of this city, these regulations are formulated. Article 2 These Regulations shall apply to the planning, construction and management of commercial outlets in the urban area of ??Dalian City.
The term "commercial outlets" as mentioned in these Regulations refers to fixed places for business wholesale, distribution, retail, catering, services, etc.
The term "supporting commercial outlets" as mentioned in these Regulations refers to convenient commercial outlets that are constructed in accordance with relevant national regulations and are closely related to residents' daily lives.
The construction and management of urban fairs shall be carried out in accordance with the "Liaoning Province Urban and Rural Fairs Management Regulations". Article 3 The Dalian Municipal Commercial Commission is the administrative department of commercial outlets in Dalian; the commercial administration is affiliated to the county (city) and district people’s governments and the Dalian Economic and Technological Development Zone, Jinshitan National Tourist Resort, and High-tech Industrial Park Management Committees The department is the administrative department in charge of the commercial outlets within its jurisdiction (administration).
Commercial outlet management agencies affiliated to the commercial outlet administrative departments at all levels should do a good job in the daily management of commercial outlets within their jurisdiction (administration) in accordance with these regulations.
Planning, finance, state-owned assets, auditing, price, food, industry and commerce, planning land, real estate, environmental protection and other departments at all levels should coordinate the implementation of these regulations according to their respective responsibilities. Article 4 The construction of urban commercial outlets must formulate development plans and construction plans. The municipal, county (city), and district people's governments and the Dalian Economic and Technological Development Zone, Jinshitan National Tourism Resort, and High-tech Industrial Park Management Committees should incorporate the planning and construction of commercial outlets into the national economic and social development plans and urban overall plans.
The development plan and construction plan of urban commercial outlets shall be prepared by the administrative department of commercial outlets or entrusted with qualified institutions. After being reviewed and approved by the planning, land and planning departments according to procedures, they shall be submitted to the people's government at the same level for approval. The preparation of development plans for commercial outlets must comply with the city's overall plan.
The approved commercial outlet development plan and construction plan shall not be changed at will. If changes are really needed, they should be submitted for approval according to the original approval procedures. Article 5 The planning and construction of commercial outlets shall be in accordance with market requirements and coordinated with the overall urban architectural layout, adhering to the principles of unified planning, reasonable layout, supporting industry, complete functions, convenient life, prospering the market, protecting the environment, and beautifying the city. Article 6 Urban commercial outlets should be planned into commercial centers, commercial districts, and commercial streets according to different urban areas and locations, forming a distinctive, comprehensive, and modern group of commercial outlets. Article 7: The development of new urban areas, the renovation of old areas, and the construction of stations, docks, airports, tourist attractions, etc., shall simultaneously incorporate supporting commercial outlets into the planning and construction.
The first floors of newly built or renovated residences on both sides of the main and secondary arterial roads in urban areas should be reasonably planned and constructed with commercial outlets if conditions are met.
For residential areas developed and constructed in the early stage, the construction of commercial outlets without supporting facilities should also be included in the unified planning and the supporting construction should be done well.
The planning and design of commercial outlets in urban residential areas should strictly implement the national "Planning and Design Code for Urban Residential Areas". Article 8 The approval procedures for commercial outlet construction projects shall be implemented in accordance with national regulations. For large and medium-sized commercial outlet construction projects, the commercial outlet administrative department should participate in the planning and demonstration. Article 9 The construction of commercial outlets must be implemented in strict accordance with the plan. The construction of commercial outlets should be carried out in various forms such as unified construction with government investment, self-financed construction by units and individuals, and joint venture and cooperative construction. Encourage units and individuals from abroad or from other provinces and cities to invest in and build commercial outlets. Article 10: All units and individuals constructing residential buildings must implement the construction of commercial outlets in accordance with relevant national regulations and local planning requirements, and must not violate them. Newly built residences (including dormitories, apartments, and villas) must be planned to construct supporting commercial outlets according to 5% of the total area of ??the new residential buildings; if it is indeed impossible to plan and construct supporting commercial outlets, with the consent of the commercial outlet management agency, the total area of ??the new residential buildings can be The corresponding commercial outlet construction fee shall be paid to the commercial outlet management agency in the proportion of 5% of the area.
The construction unit shall construct supporting commercial outlets based on 5% of the total area of ??the new residential building and shall sign a construction contract with the commercial outlet management agency.
For those who have not paid the commercial outlet construction fee and have not signed a construction contract for the construction of supporting commercial outlets, the planning and land department will not issue a "Construction Project Planning Permit". Article 11 Due to the needs of urban construction, the demolition of commercial outlets that operate grain, oil, vegetables, non-staple food, daily groceries, hairdressing, baths, repairs, medicine, books and newspapers, etc. that are closely related to the daily life of residents should be strictly in accordance with the "Dalian Urban The House Demolition Management Regulations are implemented. Article 12 To collect commercial network construction fees, bills printed uniformly by the provincial financial department shall be used.
The full amount of commercial network construction fees should be stored in a special fiscal account and be arranged and used uniformly by the government. It is mainly used for the construction, reconstruction and expansion of commercial outlets that are closely related to residents' daily lives, with priority being used for convenient outlets in newly built residential communities and remote residential areas.
No unit or individual may appropriate, withhold or misappropriate commercial network construction fees.
