Regulations of Jiangxi Province on Tourism Management

Chapter I General Provisions Article 1 In order to strengthen tourism management, effectively protect and rationally develop and utilize tourism resources, standardize the order of the tourism market, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism, these Regulations are formulated in accordance with relevant national laws and regulations and in light of the actual situation of this province. Article 2 Organizations and individuals engaged in the development of tourism resources, the construction of tourism facilities, tourism management and tourism activities within the administrative region of this province, as well as the implementation of tourism management, shall abide by these regulations. Article 3 The development of tourism should follow the laws of market economy and the requirements of social development, and adhere to the principle of integrating economic benefits, social benefits and environmental benefits. Article 4 People's governments at or above the county level (including regional administrative offices, the same below) should strengthen their leadership over tourism, incorporate tourism as a new economic growth point into the national economic and social development plan at the corresponding level, broaden investment channels, increase investment in tourism infrastructure construction and projects, improve the tourism environment and promote the development of tourism. Article 5 Encourage and support the development of tourism education, train tourism talents in a planned and multi-channel way, and improve the quality of tourism education and tourism service. Article 6 The tourism administrative departments of the people's governments at or above the county level (hereinafter referred to as the tourism administrative departments) shall, in accordance with the principle of unified leadership and hierarchical management, implement industry management of tourism work within their respective administrative areas and perform management functions according to law.

The relevant departments and institutions of the people's governments at or above the county level, such as industry and commerce, public security, transportation, health, culture, price, technical supervision, forestry, construction, environmental protection and religion, shall, within the scope of their respective functions and duties, cooperate with the tourism management departments at the same level to do a good job in tourism management and service. Seventh tourism industry associations should carry out activities according to law, give full play to the functions of service, communication and supervision, improve the industry self-discipline system, accept the management and supervision of relevant government departments, and provide quality services to promote the development of tourism. Chapter II Development of Tourism Resources and Construction of Tourism Facilities Article 8 The development of tourism resources shall adhere to the principles of unified planning, rational development, scientific management, effective protection and sustainable utilization. The development and management of tourism projects shall not destroy tourism resources and ecological environment, and should adhere to the combination of natural landscape, human landscape, history and culture with modern science and technology.

Encourage the development of tourism commodities and souvenirs with local characteristics, scenic spots and cultural connotations. Ninth tourism management departments should do a good job in the survey and evaluation of tourism resources within their respective administrative areas, and formulate tourism development plans. Tourism development planning should be coordinated with the overall land use planning, the overall urban planning and the professional planning of scenic spots, nature reserves, forest parks, cultural relics protection and environmental protection.

The tourism development plan shall be reviewed by the tourism management department at the next higher level and approved by the people's government at the same level, and shall be organized and implemented by the tourism management department that compiled the plan. Article 10 The tourism administrative department shall publish information on the development of tourism resources, the construction of tourism facilities and tourism management within its administrative area through various forms, and guide various economic sectors at home and abroad to invest in tourism. Eleventh new construction, renovation and expansion of tourist attractions, tourist hotels and tourist ropeways shall conform to the tourism development plan and be submitted for approval according to the relevant construction procedures. The relevant departments shall solicit the opinions of the tourism management department in writing in advance when approving and reporting construction projects. Twelfth in the rich tourism resources, good tourism foundation, convenient transportation, suitable for centralized construction of supporting facilities, you can set up national and provincial tourist resorts with local characteristics.

The establishment of a national tourist resort shall be approved by the provincial people's government and reported to the State Council for approval. The establishment of provincial tourist resorts shall be approved by the provincial tourism management department and submitted to the provincial people's government for examination and approval. Chapter III Rights and Obligations of Tourists Article 13 The legitimate rights and interests of tourists are protected by law, and no unit or individual may infringe upon them. Fourteenth tourists enjoy the following rights in tourism activities:

(1) Requiring tour operators to comprehensively and truthfully introduce the contents, standards and fees of relevant services;

(two) to choose tourism operators and service methods independently, to choose tourism projects and commodities independently, and to refuse the compulsory trading behavior of tourism operators;

(three) require the tour operators to fully perform the contract and ensure the service content and quality;

(four) personal and property safety and health conditions are guaranteed;

(five) personal dignity, national customs and religious beliefs are respected according to law;

(six) other rights stipulated in the tourism contract.

When the legitimate rights and interests of tourists are damaged, they can ask the tour operators who have damaged their legitimate rights and interests to stop their breach of contract and infringement and compensate for the losses; You can also complain to the tourism management department or other relevant departments where the tourism operator is located or where the damage occurs, or bring a lawsuit directly to the people's court. Fifteenth tourists should abide by laws, regulations and social ethics in tourism activities, and safeguard national security; Respect the national customs and religious beliefs of tourist destinations; Protect tourism resources and ecological environment, and take good care of places of interest, cultural relics and tourist facilities; Abide by the regulations on tourism order, safety and health management, and fulfill the tourism contract.
