Chapter 1 General Provisions Article 1 In order to protect and rationally develop and utilize tourism resources, regulate the order of the tourism market, safeguard the legitimate rights and interests of tourists and tourism operators, and promote the development of the tourism industry, in accordance with relevant laws and regulations, This regulation is formulated based on the actual situation of this city. Article 2 Organizations and individuals that develop tourism resources and construct facilities, engage in tourism operations, participate in tourism activities, and implement tourism management within the administrative area of ??this city shall abide by these regulations. Article 3 The tourism management departments of the people's governments of cities, counties (cities), and Jiawang District (hereinafter referred to as the tourism management departments) are responsible for tourism management within their respective administrative regions. Other relevant administrative departments shall perform their respective duties in accordance with the law and cooperate with tourism management. The department shall do a good job in tourism management and service. Article 4 The municipal, county (city) and district people's governments shall incorporate tourism into the national economic and social development plan, formulate tourism plans and tourism development policies, strengthen the construction of tourism infrastructure, improve the tourism environment, cultivate and standardize the tourism market, and develop tourism economy. Article 5 The Municipal People's Government shall add tourism development funds and gradually increase them according to the needs of tourism development and financial resources. The county (city) and district people's governments may increase tourism development funds according to the needs of tourism development in the region.

Tourism development funds are used for tourism planning, public welfare tourism project construction, tourism resource protection and urban tourism promotion, etc., and the finance and audit departments supervise the use. Article 6 The municipal, county (city) and district people's governments shall encourage and support other investment entities to participate in the development and operation of tourism and tourism products with local characteristics in accordance with the principle of whoever invests gets the benefits. Chapter 2 Development and Protection of Tourism Resources Article 7 The development of tourism resources shall follow the principles of unified planning, rational development, environmental protection, and sustainable utilization, adhere to the combination of natural landscapes, cultural landscapes, history and culture with modern science and technology, and highlight tourism characteristics and develop the tourism industry. Article 8 The tourism management department shall, in conjunction with relevant departments, conduct an investigation of the tourism resources in its administrative region, and establish tourism resource files and a reserve database of key tourism projects. Article 9 The tourism management department shall work with relevant departments to prepare a tourism plan based on the local tourism resource status and the city's overall plan, solicit opinions from the superior tourism management department, and submit it to the people's government at the same level for approval before implementation.

After the county (city) and Jiawang District tourism planning is approved by the people's government at the same level, it shall be reported to the municipal people's government for filing. Article 10 The construction of tourism projects shall comply with the requirements of tourism planning. A feasibility study should be conducted before the construction of a tourism project, and the opinions of the tourism management department should be sought in writing when the project is approved.

No unit or individual may develop tourism resources in violation of tourism planning. Article 11 The tourism management department shall work with relevant departments to set up tourist routes, set up tourist maps and tourist propaganda boards in the city's main transportation distribution centers, and set up tourist guide signs on the main roads leading to scenic spots. Chapter 3 Tourism Operation and Management Article 12 Tourism operators shall obtain business qualifications in accordance with the law.

If employees in the tourism industry must have job or professional qualification certificates in accordance with national regulations, they can only work after obtaining the corresponding qualification certificates. Article 13 Tourism operators shall disclose tourism service items and service standards, implement clearly marked prices, and ensure service quality.

Tour operators shall not engage in the following acts that infringe upon the legitimate rights and interests of tourists:

(1) Failure to perform or incomplete performance of contracts signed with tourists;

(2) Not providing services in accordance with national standards and industry standards or providing services of inconsistent quality and price;

(3) Making false publicity about service scope, content, standards, etc.;

(4) Inducing or coercing tourists to purchase goods or accepting paid services without prior agreement;

(5) Selling counterfeit and shoddy goods;

(6) Endangering the personal safety and security of tourists Property safety;

(7) Other acts that infringe upon the legitimate rights and interests of tourists as stipulated by laws and regulations. Article 14 Tourism operators shall establish a safety management system. Necessary tourism safety facilities and equipment shall be configured to ensure the personal and property safety of tourists.

For areas and tourist facilities where danger may occur, tourism operators should set up obvious reminders or warning signs and take necessary safety protection measures.

When a dangerous situation is discovered or a tourist's personal or property is damaged, tourism operators should take timely rescue measures and report immediately to the local government or relevant management departments. Article 15 To establish a travel agency, an application shall be submitted to the municipal tourism management department in accordance with the provisions of the "Travel Agency Management Regulations" of the State Council, and the municipal tourism management department shall submit the application to the competent department for review and approval.

After obtaining the travel agency business license, the applicant can apply to the industrial and commercial administration department for a business license. Those who have not obtained a travel agency business license are not allowed to engage in tourism business.

Travel agencies shall carry out business activities in accordance with the business scope approved by the travel agency business license. Article 16 If a travel agency changes its business scope, it shall go through the change registration procedures with the industrial and commercial administrative department after being reviewed and approved by the original tourism management department.

If a travel agency changes its name, business location, legal representative, etc., or suspends or ceases operations, it shall go to the industrial and commercial administrative department to handle the corresponding change registration or deregistration. Report to the original approving tourism management department for filing within thirty days from the date of registration.
