Interim provisions on the management of national aquatic sports business activities

Chapter I General Provisions Article 1 In order to develop water sports, enrich people's cultural and sports life, enhance people's physique and strengthen the management of water sports business activities, these management regulations are formulated in accordance with the Sports Law of the People's Republic of China and the Notice on Further Strengthening the Management of Sports Business Activities. Second water sports business activities refer to; Water sports activities are for profit, with business activities as the content and means, including all kinds of water sports performances, training, fitness, entertainment, tourism and competitions. Third water sports business projects include:

(1) Water sports approved by international sports organizations and the State Sports General Administration (such as diving, motorboat, rafting, water skiing, surfing, fin swimming, rowing, kayaking, sailing and windsurfing).

(2) Traditional national and folk water sports with fitness and entertainment functions.

(three) all other water sports with fitness and entertainment functions. Article 4 All organizations and individuals engaged in water sports business activities within the territory of China shall abide by these provisions. Chapter II Management Article 5 The State General Administration of Sport authorizes the Water Sports Management Center of the State General Administration of Sport, in conjunction with relevant departments, to formulate policies and regulations on water sports management activities throughout the country; Supervise and manage the national water sports business activities. The sports administrative department of the local people's government at or above the county level or the institution authorized by the people's government at the corresponding level shall be in charge of the water sports business activities within their respective administrative areas.

The National Association of Single Water Sports shall, in accordance with its articles of association, assist the sports administrative department in the management of water sports business activities. Sixth whoever holds water sports business activities shall be reported to the local sports administrative department for approval. Holding international or national inter-provincial water sports business activities must be reported to the Water Sports Management Center of the State Sports General Administration for approval. Seventh whoever carries out water sports business activities must submit the following written materials to the local sports administrative department:

(1) an application;

(two) in line with the information technology standards of water sports venues;

(3) Facilities, equipment and materials that meet the standards stipulated by the National Single Water Sports Association;

(four) the qualification certification materials of professional and technical personnel and management personnel;

(5) Other relevant materials. Article 8 After receiving the application materials, the local sports administrative department shall carefully examine them and put forward the examination and approval opinions within 15 days. For those who meet all the conditions, a consent form for water sports business activities will be issued.

"Water sports business consent" is uniformly printed by the State Sports General Administration and authorized by the sports administrative department at or above the county level.

Approved to carry out water sports business activities, it shall hold a certificate of consent to carry out water sports business activities, and apply to the local administrative department for Industry and commerce for a business license before carrying out water sports business activities.

Do not engage in water sports business activities without approval. Ninth professionals engaged in water sports business activities, must undergo training, meet the standards of water sports professionals promulgated by the National Sports Association, and obtain the corresponding qualification certificates. The holder of the qualification certificate should be qualified and registered in the local sports administrative department. Article 10 Units and individuals engaged in water sports business activities without the approval of the sports administrative department shall be given a warning, corrected within a time limit, ordered to suspend business for rectification, confiscated of their illegal income, fined or even revoked of their business licenses by the local sports, industry and commerce, public security and health departments within their respective functions and powers.

Those who use water sports business activities to engage in activities that violate national laws, endanger people's health and endanger social security shall be punished by the public security organs in accordance with the regulations on administrative penalties for public security. Eleventh sports administrative departments at all levels can formulate corresponding measures for the management of water sports business activities according to these Provisions, and strengthen the management and supervision of water sports activities. Article 12 These Provisions shall come into force as of the date of promulgation.
