Canadian work visa application process

Canada's work visa processing process is divided into six steps:

Step 1: Contact the Canadian company (employer), and the employer will send you an Offer after deciding to hire you.

There are actually two types of work visas in Canada: open work visas and closed work visas. The difference between them is that the open work visa does not stipulate employers, and applicants with open work visas can work for any employers in Canada, while closed work visas are the opposite of open work visas, that is, applicants with closed work visas can only work for fixed employers. Once the working relationship is dissolved, the work visa will be invalid. Open-ended work visas can only be applied by overseas students who have graduated from Canada, spouses of closed-end work visas or some special short-term international cooperation projects in Canada, while most overseas people need a labor contract issued by their employers to apply for closed-end work visas if they want to get a Canadian work visa.

Legal basis:

Article 9 of the Law of the People's Republic of China on Exit and Entry Administration. China citizens shall apply for passports or other travel documents when leaving or entering the country. China citizens who want to go to other countries or regions also need to obtain visas or other entry permits. However, unless the China government has signed visa exemption agreements with other governments or the Ministry of Public Security and the Ministry of Foreign Affairs provide otherwise. China citizens who leave or enter the country as seafarers and work on foreign ships shall apply for a seaman's certificate according to law.

Conditions for applying for a work visa in Canada:

1. Meet the conditions for studying in Canada.

In other words, to apply for a Canadian work visa, you must first meet the conditions for entering Canada.

2. A temporary residence visa (Canadian visitor visa) is required when applying for a work visa.

3. Meet the requirements of the employer.

Your employer may need to obtain the Labour Market Opinion (LMO) from the Canadian Department of Human Resources and Social Development (HRSDC). LMO is used to confirm that employers can hire foreign workers to alleviate labor shortage. Of course, for some jobs, you can work in Canada without the LMO of HRSDC.

4. If you want your spouse (common-law partner or husband-wife partner) and dependent children to enter Canada together, you need to provide the information of your spouse and children when applying for a work visa in Canada. If you don't provide the information of your family members when applying for a work visa, family members will need to apply for a visit visa to enter Canada in the future.

5. In order to prove the relationship of family members, you need to provide marriage certificate (to prove the relationship between husband and wife) and/or birth certificate (to prove the direct relationship).
