Regulations of Guangxi Zhuang Autonomous Region on Tourism Management

Chapter I General Provisions Article 1 In order to strengthen tourism management, protect and rationally develop and utilize tourism resources, standardize tourism market behavior, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism, these Regulations are formulated in accordance with relevant national laws and regulations and in light of the actual situation of this autonomous region. Article 2 Those who engage in tourism activities and engage in tourism business within the administrative area of this autonomous region shall abide by these regulations. Article 3 The development of tourism should adhere to the principle of paying equal attention to socialist material civilization and spiritual civilization, and unifying social benefits, environmental benefits and economic benefits. Article 4 People's governments at all levels shall, based on local conditions, incorporate tourism into the national economic and social development plan, take effective measures to guide and increase investment in tourism, strengthen the construction of tourism infrastructure, and encourage and support the development of tourism. Fifth people's governments at or above the county level shall be responsible for the tourism management within their respective administrative areas.

Public security, industry and commerce, transportation, culture, health, environmental protection, planning, construction and other relevant administrative departments shall, within the scope of their respective duties, cooperate with the tourism authorities to do a good job in tourism management. Chapter II Development and Protection of Tourism Resources Article 6 The development and utilization of tourism resources must adhere to the principles of unified planning, rational development, strict protection, outstanding characteristics, scientific management and sustainable utilization. Article 7 The development of tourism resources and the construction of tourism facilities must conform to the requirements of overall land use planning, urban and rural construction planning, planning of scenic spots, overall planning of water resources and water utilization and the protection of cultural relics, and do a good job in protecting the environment and natural resources.

Encourage domestic and foreign enterprises, economic organizations or individuals to develop tourism resources, build tourism facilities and engage in business in various ways according to law. Article 8 The establishment of a national tourist resort shall be approved by the people's government of the autonomous region and reported to the State Council for approval; The establishment of autonomous region-level tourist resorts shall be examined by the competent tourism department of the autonomous region in conjunction with relevant departments and reported to the people's government of the autonomous region for approval. Ninth new construction, renovation and expansion of tourist attractions, should be in line with the overall planning of tourism development and tourism resources development planning in the autonomous region, in accordance with the relevant provisions of the state and the autonomous region to apply for project approval. When examining and approving the project application, the relevant competent departments shall solicit opinions from all sides, fully demonstrate, pay attention to rational layout and avoid redundant construction. The building scale and style should be in harmony with the surrounding environment. Tenth all units and individuals have the obligation to protect tourism resources, and may not build facilities that pollute the environment and destroy the landscape in tourist attractions.

Quarrying, mining, dredging, cutting down trees and other acts that damage the environment, cultural relics or natural resources in tourist attractions are prohibited. Chapter III Tourists and Tourism Management Article 11 Tourists shall enjoy the following rights in tourism activities:

(a) the true situation of the contents, standards and prices of the services required of tour operators;

(two) independently choose the tour operators and the service methods and contents they provide, and decide whether to accept or not to accept any services;

(three) in accordance with the provisions of the tourism contract, to obtain services that match the quality and price, and to refuse the compulsory trading behavior of the tourism operators;

(four) to obtain personal and property security;

(5) Respect personal dignity and national customs;

(six) when the legitimate rights and interests are infringed, get the corresponding compensation;

(seven) other relevant rights stipulated by laws and regulations. Twelfth tourists should fulfill the following obligations in tourism activities:

(1) Abide by laws, regulations and social ethics;

(two) consciously protect the tourism resources and environment, take good care of tourism facilities;

(3) Respecting the ethnic customs and religious beliefs of tourist destinations;

(four) comply with the provisions of the tourism order and safety and health;

(five) to fulfill the travel contract;

(six) other relevant obligations stipulated by laws and regulations. Thirteenth when the legitimate rights and interests of tourists are damaged, they can be dealt with in the following ways:

(1) To demand compensation from the infringer;

(2) Complaining to the tourism authorities or other relevant departments of industry and commerce where the infringer is located or where the infringement occurs;

(3) Bring a lawsuit directly to the people's court. Fourteenth any unit or individual engaged in China citizens abroad (border) tourism business, must be approved by the national tourism authorities; Do not engage in this business without approval. Fifteenth hotels engaged in foreign-related tourism business must be approved by the competent tourism authorities at or above the city (region) under the jurisdiction of the autonomous region, receive the "License for Foreign-related Tourism Business", and go through the relevant formalities according to the regulations.

Hotels rated as star-rated should be managed according to the standards set by the state. Star-rated hotels must provide corresponding services according to the assessed star-rated standards.

Hotels that have not yet been rated as stars shall be managed according to the standards set by the autonomous region. Hotels that have not been rated as stars shall not use the relevant star titles for advertising and attracting tourists. Measures for fixed-point operation shall be formulated separately by the people's government of the autonomous region. Seventeenth tour operators have the right to refuse any unit to forcibly sell goods or forcibly resettle personnel; Have the right to refuse all kinds of charges that violate the provisions of the state and the autonomous region; Have the right to refuse the inspection of personnel without law enforcement certificates.
