Chapter V Tourism Management and Service Regulations of Jiangxi Province
The legitimate rights and interests of tour operators are protected by law. Tourism operators have the right to refuse fees and apportionment in violation of laws and regulations; Have the right to refuse tourists' requests that violate laws, regulations or social morality. Tourism operators should strengthen vocational skills training and professional ethics education in tourism professionals, and improve the quality of tourism professionals.
Tourism professionals should participate in vocational skills training. If the state stipulates that it is necessary to have a professional qualification certificate, it shall obtain the corresponding qualification certificate before taking up the post. The tourism authorities of the people's governments at or above the county level, travel agencies and tour guide service companies shall strengthen the vocational skills training, professional ethics education and supervision and management of tour guides.
Tour guides should abide by professional ethics and respect the religious beliefs, national customs and living habits of tourists. When providing services for tourists, tour guides shall not change the travel contract without authorization, and shall not increase or decrease tourism projects or suspend tour guide activities without authorization. Interpreters of scenic spots in tourist attractions shall undergo vocational skills training and shall not serve across tourist attractions.
The tourism administrative department of the people's government at or above the county level shall strengthen the industry guidance, supervision and management of the scenic spot interpreters. Tourism operators should strictly implement the relevant state regulations on safety and health management, improve relevant management systems and emergency rescue plans for accidents, and equip them with tourism safety protection facilities to ensure the personal and property safety of tourists. Operating rock climbing, rafting, bungee jumping and other tourism projects shall have the technical conditions, equipment, necessary rescue facilities and rescue personnel to protect personal and property safety, and make a true explanation and a clear warning to tourists.
In the event of a tourism safety accident, the tourism operator shall actively organize rescue to prevent the accident from expanding, and immediately and truthfully report to the safety supervision, public security, tourism and other relevant departments of the local people's government at or above the county level in accordance with the relevant provisions of the state and the province. Tourism operators and their employees shall not have the following acts:
(1) The tourist service information provided to tourists contains false contents or makes false propaganda;
(2) Failing to perform the contractual obligations with tourists or performing contractual obligations that are not in conformity with the agreement;
(three) the quality of tourism services provided to tourists does not match the price;
(four) forcibly staying in the tourism team or leaving the group or leaving the guest during the trip;
(five) coercion, deception of tourists to buy goods, accept services, and ask tourists for extra fees;
(six) for the purpose of making profits, set up facilities in tourist attractions that affect tourists' free photography;
(seven) in the explanation and introduction of vulgar content;
(eight) other acts that damage the legitimate rights and interests of tourists. When organizing tourism activities, a travel agency shall sign a written travel contract with tourists according to law, and use the model text of the travel contract to clearly stipulate the itinerary, service items, service standards, service prices, liability for breach of contract and other matters. When arranging tourists to shop, they should clearly stipulate the shopping place, shopping times and staying time in the contract.
Where a travel agency transfers a tourist who has entered into a travel contract with it to another travel agency, it shall obtain the written consent of the tourist; If the tourists do not agree, they shall refund all the travel expenses paid by the tourists in advance; If losses are caused to tourists, compensation shall be made according to law. Tourist passenger transport operators shall provide transport services in accordance with the tourism transport contract. Travel agencies and tourists have the right to refuse to pay the increased transportation costs if they fail to transport according to the agreed route or change the means of transport without authorization; If the service standard is lowered, the overcharged fees shall be refunded.
If the tourist passenger transport is delayed due to force majeure, the tourist passenger transport operator shall inform the travel agency and tourists in time and settle it properly through consultation. Tourist attractions should be based on tourism needs, set up service facilities, guide signs and public security police room. Necessary protective measures should be taken in areas with certain risks, and obvious tips or warning signs should be set up.
Tourist attractions should determine the carrying capacity of tourists according to the requirements of tourism safety, environmental protection, cultural relics protection and service quality, implement time control, make publicity announcements in advance, and do a good job in guiding tourists in the tourist season. The ticket prices of tourist attractions based on national natural and cultural resources shall be set by the government or guided by the government. Not relying on the national natural resources and cultural resources, the ticket prices of artificial tourist attractions built by commercial investment are regulated by the market. The adjustment of ticket prices of tourist attractions that are subject to government pricing and government guidance prices shall be heard according to law.
While setting up a single ticket, tourist attractions can set up joint tickets with related tourist attractions for tourists to choose independently. The joint fare should be lower than the sum of the corresponding one-way ticket prices. It is forbidden to forcibly sell joint tickets to tourists.
Tourist attractions should be open to specific objects such as active servicemen, the elderly, the disabled and full-time students in accordance with relevant regulations, and obvious signs should be set up.
Tourist attractions can implement the system of monthly ticket, season ticket and annual ticket. Operators of tourist shopping places should operate in good faith and trade fairly.
When providing goods or services, tourist shopping places shall issue shopping vouchers or service documents to tourists in accordance with relevant state regulations.
If tourists buy fake, shoddy goods and invalid or deteriorated goods in shopping places arranged or agreed by travel agencies, travel agencies have the obligation to assist tourists in returning goods; If the damage is caused, the tourist has the right to ask the travel agency for compensation in advance; After compensation, the travel agency may claim compensation from the tourist shopping place. Tourism network operators should provide real tourism service information for tourists.
Tourism network operators should choose service providers from qualified tourism operators to provide tourists with intermediary services such as sightseeing, accommodation, transportation, catering, shopping and entertainment. Chapter VI Supervision and Management The people's governments at or above the county level shall strengthen supervision and management of the tourism market and establish and improve the comprehensive management mechanism of the tourism market.
The tourism authorities and relevant departments of the people's governments at or above the county level shall, in accordance with the division of responsibilities, strengthen the supervision and management of tourism resources protection, tourism planning implementation, tourism project construction, tourism market order, tourism safety and service quality. The people's governments at or above the county level shall formulate plans for the prevention and handling of major tourism safety accidents, and regularly organize relevant departments to conduct tourism safety supervision and inspection. If potential safety hazards are found, the relevant departments shall promptly notify and urge the rectification.
When a major tourism safety accident occurs, the local people's government shall immediately organize safety supervision, public security, health, tourism and other relevant departments to go to the scene to carry out rescue, organize the aftermath, and report to the people's government at a higher level in a timely manner according to regulations. The tourism administrative department of the people's government at or above the county level shall establish a tourism complaint system, publish complaint telephone numbers in tourist attractions, and accept and handle tourists' complaints according to law. The tourism administrative department shall make a decision on whether to accept or not within 5 working days from the date of accepting the tourists' complaints; If it is not accepted, it shall inform the complainant in writing of the reasons for not accepting it; If it belongs to other relevant departments after examination, it shall be transferred in time.
Complaints accepted by the tourism authorities shall be handled within 15 working days from the date of acceptance. If the situation is complicated, it may be extended with the approval of the person in charge of the department, but the longest period shall not exceed 30 days. In violation of the provisions of these regulations, if the tourism authorities or other relevant departments and their staff members are under any of the following circumstances, the directly responsible person in charge and other directly responsible personnel shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(a) the failure to implement the tourism development plan and the special tourism plan, resulting in the destruction of tourism resources and tourism environment;
(2) Failing to issue relevant tourism business licenses or qualification certificates according to law;
(3) illegally charging, apportioning or imposing penalties on tour operators;
(4) Failing to accept and handle tourism complaints within the statutory time limit or failing to transfer them to the relevant departments in accordance with regulations;
(5) Failing to perform supervisory duties according to law, resulting in heavy losses. In violation of the provisions of article thirty-sixth, tourism operators shall bear legal responsibility in accordance with the following provisions:
(a) the tourism service information provided to tourists contains false contents or makes false propaganda, which shall be punished by the administrative department for industry and commerce according to law;
(two) the quality of tourism services provided to tourists does not match the price, which shall be punished by the competent price department according to law;
(three) in the process of tourism, the tourism authorities shall order the tourists to make corrections and impose a fine of not less than 5,000 yuan but not more than 20,000 yuan on the tour operators;
(four) coercion, deception of tourists to buy goods, accept services or ask tourists for extra fees, by the tourism authorities at more than 2000 yuan 10000 yuan fine; If the circumstances are serious, a fine of 6,543,800 yuan and 30,000 yuan shall be imposed.
Where laws and administrative regulations provide otherwise, such provisions shall prevail. The meanings of the following terms in this Ordinance:
(1) Tourism refers to a comprehensive industry that uses tourism resources and facilities to provide tourists with services such as sightseeing, accommodation, transportation, catering, shopping and entertainment.
(2) Tourism resources refer to natural resources, human resources and other social resources that can be used to develop tourism and have ecological, economic and social benefits.
(3) Tourism operators refer to enterprises, individual industrial and commercial households and other organizations that have obtained business qualifications according to law, use tourism resources and facilities, engage in tourism solicitation and reception, and provide services such as sightseeing, accommodation, transportation, catering, shopping and entertainment for tourists. These Regulations shall come into force as of September 6, 2009. 1Adopted at the 13th meeting of the Standing Committee of the Ninth Jiangxi Provincial People's Congress on February 7, 999, and revised at the 27th meeting of the Standing Committee of the Ninth Jiangxi Provincial People's Congress on February 22, 2006, the Regulations on Tourism Management in Jiangxi Province shall be abolished at the same time.
