Interim Measures of Kunming tourism professionals Municipality on Qualification Management

Article 1 In order to strengthen the management of tourism professionals in Kunming, standardize the behavior of tourism professionals, improve the quality of tourism service and management level, and promote the development of tourism, economy and society in this city, these measures are formulated in accordance with the relevant laws and regulations of the state and the Regulations on Tourism Management in Yunnan Province, combined with the actual situation of our city. Article 2 The term "tourism professionals" as mentioned in these Measures refers to service personnel who are engaged in tourism business and mainly provide services such as transportation, sightseeing, catering, accommodation, shopping and entertainment for tourists with the approval of the tourism administrative department at or above the county level in this Municipality. Article 3 The tourism administrative department of Kunming Municipality shall be responsible for the registration, accreditation, supervision and management of tourism professionals within the administrative area of this Municipality. Article 4 All employees engaged in tourism operation, management and service within the administrative area of this Municipality shall abide by these Measures.

The tourism administrative department of the county (city) and District People's governments shall be responsible for the supervision and administration of tourism professionals in their respective areas. Article 5 This Municipality implements the management system of "tourism professionals Qualification Certificate" (hereinafter referred to as "Qualification Certificate") for tourism professionals. Those who have not obtained the Qualification Certificate shall not engage in tourism business and service activities in the tourism industry.

"Qualification Certificate" is issued by Kunming Tourism Administration Department in accordance with the unified regulations and standards of the Ministry of Labor and Personnel. Article 6 A person who meets the following conditions may apply to the tourism administration department for a Qualification Certificate:

L, with full capacity for civil conduct;

2, in good physical condition, and has a certificate issued by a medical institution recognized by the health administrative department at or above the county level;

3. Have a junior high school diploma or a vocational training certificate above junior high school;

4. Have the required professional skills and technical level;

5. Have my resident ID card, temporary residence permit, employment certificate for migrant workers and other valid documents. Seventh applicants must be organized by the municipal tourism administrative department or its authorized department to organize a unified examination, and those who pass the examination will be issued a "qualification certificate"; Anyone who has a relevant certificate issued by the National Tourism Administration or a junior college degree or above in the tourism industry only needs to apply for and provide relevant academic qualifications, degree certificates and the necessary certificates stipulated in Article 6 to obtain the Qualification Certificate. Article 8 The Qualification Certificate shall be reviewed by the issuing authority every three years. Those who fail to take the exam or fail to pass the exam within the time limit shall be suspended from their Qualification Certificate.

The Qualification Certificate shall not be altered, transferred or forged. If it is lost, the parties concerned should go to the original issuing authority to reissue it. Article 9. Personnel who need to engage in special services such as tour guides, motor vehicle passenger transport operations, food production and operation, etc., after obtaining the Qualification Certificate, shall also obtain the relevant certificates issued by the relevant administrative departments in accordance with the regulations before taking up their posts with certificates. Article 10 All tourism enterprises in Kunming shall recruit and employ employees according to the principles of facing the society, open recruitment, comprehensive assessment and merit-based recruitment. To recruit and employ employees, labor contracts must be signed in accordance with the relevant provisions of the labor department, and the labor contract system shall be implemented. Eleventh tourism enterprises shall, according to the characteristics of production and operation, formulate labor quotas and work rules, and establish labor management systems such as employee training, employee assessment and performance appraisal. Twelfth tourism professionals must abide by the following provisions:

1, implement national, provincial and municipal laws, regulations and rules, and accept the supervision and inspection of industry management departments and relevant management departments.

2. When traveling, show certificates, be dignified in appearance, be neat in clothes, be enthusiastic in service, be courteous to guests, and have good professional ethics.

3, abide by the principles of good faith, fair competition, business according to law, civilized and standardized services, sales of tourism goods and services should be truly marked with quality, price and public service items, so that the quality and price are consistent. Do not pester, force or force tourists to buy tourist goods or receive services in disguise.

4. Never ask for tips or collect kickbacks without permission.

5. Abide by the state secrecy provisions, and do not disclose state secrets and confidential matters within the enterprise.

6. Consciously abide by service standards and trade association contracts. Thirteenth without the "qualification certificate" and engaged in tourism business services, shall be given a warning by the tourism administrative department, ordered to make corrections within a time limit, fine 200 yuan and other penalties; Units that employ persons without "Qualification Certificate" to engage in tourism business services shall be ordered to repel undocumented persons within a time limit. Those who fail to repel or re-employ undocumented personnel within the time limit shall be fined 500 yuan for each person employed and 200 yuan for the person directly responsible.

Those who do not participate in the annual examination of the Qualification Certificate shall be ordered to make corrections within a time limit. If they do not make corrections within the time limit, their Qualification Certificate will automatically become invalid. Article 14 Tourism professionals who commit any of the following acts shall be given a warning by the tourism administrative department depending on the seriousness of the case, ordered to make rectification within a time limit, fined 200-5 10 yuan, and suspended the certificate until it is revoked, and shall not apply for a certificate within three years. In violation of the relevant laws and regulations of the state, the tourism administrative department shall hand it over to the relevant administrative departments for punishment according to law; If the case constitutes a crime, it shall be submitted to judicial organs for criminal responsibility according to law:

1, concealing the real situation and defrauding the Qualification Certificate, which has been verified;

2. Forging, trading or lending qualification certificates;

3, abuse, beating tourists, fraud, theft or corruption;

4, forcing or disguised forcing tourists to buy tourist goods and receive services, causing economic losses to consumers;

5. Ask tourists and related enterprises for tips and collect kickbacks privately;

6, in violation of management regulations and trade association contracts, using unfair competition to attract tourists is verified;

7, do not show certificates, do not provide services according to regulations, norms and contracts, tourists complain and verified by the tourism administrative department;

8, complaints by tourists accumulated to three times in a year, and verified by the tourism administrative department;

9, in violation of relevant safety laws and regulations, causing casualties of tourists;

10, refusing to accept the supervision and inspection of the tourism administrative department and relevant administrative departments.
