Tourism Regulations of Shanxi Province

Chapter I General Provisions

Article 1 In order to promote the development of tourism, rationally develop, utilize and protect tourism resources, standardize the order of the tourism market, and safeguard the legitimate rights and interests of tourists and tour operators, these Regulations are formulated in accordance with the provisions of relevant laws and administrative regulations and in light of the actual situation of this province.

article 2 all units and individuals who travel within the administrative area of this province, engage in tourism development, operation and management, and other personnel who enter tourist attractions shall abide by these regulations.

article 3 "tourism" as mentioned in these regulations refers to an industry that provides tourists with services such as sightseeing, transportation, accommodation, shopping, culture and entertainment by using tourism resources and facilities.

article 4 the development of tourism should adhere to the principles of rational development, utilization and protection of tourism resources, unity of environmental benefits, social benefits and economic benefits and sustainable development, give full play to the advantages of tourism resources, and highlight the historical culture, revolutionary tradition and natural eco-tourism characteristics of Shanxi.

article 5 the people's governments of provinces, cities (prefectures) and counties (cities, districts) with conditions for developing tourism should bring tourism into the national economic and social development plan, increase investment in tourism and speed up the construction of tourism infrastructure.

encourage and support domestic and foreign investors to invest in the development of tourism, and protect the legitimate rights and interests of investors according to law.

article 6 the people's governments of provinces, cities (prefectures) and counties (cities, districts) with conditions for developing tourism should strengthen their leadership over tourism, establish and improve the leadership and coordination mechanism for tourism, regularly study important issues in tourism development, and coordinate and handle major issues in tourism development.

Article 7 The tourism administration department of the people's government at or above the county level (hereinafter referred to as the tourism administration department) shall exercise the functions of tourism administration and be responsible for the supervision and management of the tourism industry in its administrative area, and its main duties are:

(1) to implement the laws and regulations related to tourism;

(2) to formulate and organize the implementation of tourism development plans and annual plans;

(3) to guide and coordinate the development, utilization and protection of tourism resources and the construction of tourism facilities;

(4) organizing tourism publicity and developing domestic and foreign tourist markets;

(5) to coordinate tourism transportation, improve the tourism environment, and guide the development of tourism commodity market and tourism safety work in conjunction with relevant departments;

(6) supervising and managing tourism business activities, accepting tourism complaints, and investigating or participating in the investigation of acts that infringe upon the legitimate rights and interests of tourists and tour operators;

(7) Organizing, managing and guiding education and training in tourism professionals;

(8) Other work to promote the development of tourism.

the relevant departments of the people's governments at or above the county level shall, according to their respective responsibilities, support and cooperate with the tourism management departments to do a good job in tourism.

article 8 the people's governments at or above the county level shall commend and reward the units and individuals that have made outstanding contributions to the development of tourism.

chapter ii tourism security

article 9 the people's governments at or above the county level shall speed up the greening and beautification of cities and tourist attractions and the control of environmental pollution, speed up the construction of tourist roads, passenger transportation, accommodation and other facilities, and create a good tourist environment.

people's governments at or above the county level can delimit certain areas in cities, tourist attractions and surrounding areas, provide necessary conditions, attract investment, and build a tourism economic park integrating vacation, leisure, sightseeing, entertainment, catering and shopping.

article 1 the people's governments of provinces, cities (prefectures) and counties (cities, districts) that have the conditions to develop tourism should arrange certain funds for tourism development, which will be mainly used for tourism promotion and opening up the tourism market inside and outside the province and abroad.

article 11 the people's governments of provinces, cities (prefectures) and counties (cities, districts) with conditions for developing tourism should speed up the development of tourism education, train and introduce tourism professionals, and improve the quality of tourism professionals.

the department in charge of tourism of the twelfth provincial people's government shall formulate and organize the implementation of the overall plan for the development of tourism markets inside and outside the province and abroad.

the departments in charge of tourism under the people's governments of cities (prefectures) and counties (cities, districts) shall, according to the overall plan of tourism market development at higher levels, formulate and implement the overall plan of tourism market development inside and outside the province and outside the country (territory) within their respective administrative areas.

article 13 the tourism administration department shall, jointly with the quality and technical supervision department and other relevant departments, organize the implementation of national standards and industry standards related to tourism.

tourism operators should apply for international environmental quality management system certification and international service quality management system certification in accordance with relevant state regulations.

article 14 the tourism management department shall establish and improve the tourism information network, and publish the information on the development of tourism resources, the construction of tourism facilities, the tourism operation status and tourism activities in the administrative area through various forms, so as to provide consulting services to the society.

article 15 the administrative department of economy and trade of the people's government at or above the county level shall, jointly with the relevant departments such as tourism, formulate a development plan for tourism commodities and guide the development of tourism commodities with historical and cultural connotations and local characteristics in Shanxi.

the administrative departments of cultural work of the people's governments at or above the county level shall, together with the tourism departments, guide the creation of healthy and civilized cultural tourism and entertainment projects with local characteristics.

chapter iii tourism resources

article 16 the tourism resources mentioned in these regulations refer to natural landscapes, cultural landscapes and folk customs which are of ornamental and sightseeing value and can be developed and utilized to produce economic and social benefits.

article 17 the tourism administration department shall, jointly with relevant departments, make a general survey and evaluation of tourism resources and establish tourism resources files.

article 18 the plan for the development, utilization and protection of tourism resources in the whole province shall be compiled by the tourism administration department of the provincial people's government in conjunction with relevant departments, and implemented after being submitted to the provincial people's government for approval. City (prefecture), county (city, district) tourism resources development, utilization and protection planning, should be in line with the province's tourism resources development, utilization and protection planning, reported to the people's government at the same level for approval and implementation.

the management institutions of tourist attractions and scenic spots shall, according to the development, utilization and protection plans of tourist resources in their respective administrative areas, work out the development, utilization and protection plans of these scenic spots and scenic spots, and organize their implementation after being reported to the relevant departments for approval according to regulations.

the planning for the development, utilization and protection of tourism resources should be reviewed and demonstrated before being approved for implementation, and the opinions of relevant departments and units should be solicited.

Article 19 The ownership and management rights of tourist attractions can be separated. The transfer of the right to operate tourist attractions and scenic spots shall conform to the relevant provisions of the state and the province, and shall be reported for approval according to the provisions.

Article 2 Domestic investors are encouraged to invest and set up large-scale tourism enterprises or set up travel agencies and branch of a travel agency in this province to engage in tourism development and business activities in accordance with the relevant provisions of the state and this province.

Encourage investors from Hong Kong Special Administrative Region, Macao Special Administrative Region, Taiwan Province region or foreign countries to set up travel agencies in this province to engage in tourism development and business activities in accordance with the relevant provisions of the state and this province.

article 21 the development of tourism resources and the construction of tourism facilities by domestic and foreign investors shall conform to the planning for the development, utilization and protection of tourism resources, which is conducive to the protection of ecology and environment, human landscapes and scenic spots.

article 22 tourist attractions should draw not less than 1% of their ticket income every year, and under the supervision of the departments of tourism, finance and development planning of the people's governments at or above the county level, they should be used exclusively for the promotion and protection of tourist resources of scenic spots and scenic spots and the improvement of tourist service facilities.

article 23 when building, rebuilding or expanding tourist attractions, scenic spots and tourist facilities, the written opinions of the tourism management department shall be sought and submitted for approval in accordance with the relevant provisions of the state and this province.

to build, rebuild or expand provincial key tourist attractions, scenic spots and tourist facilities, the written opinions of the departments in charge of tourism work of the provincial people's government shall be sought and submitted for approval in accordance with the relevant provisions of the state and this province.

when approving the construction, renovation and expansion of tourist attractions, scenic spots and tourist facilities, the relevant departments should fully demonstrate and pay attention to rational layout to avoid blind construction and repeated construction.

the people's governments at or above the county level shall make unified planning and take effective measures to gradually relocate or dismantle the existing tourist service facilities in tourist attractions that do not conform to the planning for the development, utilization and protection of tourist resources, and damage the tourist environment and tourism landscape.

article 24 encourages the construction of tourist resorts, pilot areas for poverty alleviation through tourism and eco-tourism demonstration areas in areas with prominent tourism resources, relatively concentrated tourist attractions and remarkable economic benefits.

the construction of provincial-level tourist resorts, experimental areas for poverty alleviation and eco-tourism demonstration areas must be reviewed and demonstrated, and then submitted to the provincial people's government for examination and approval by the municipal people's government with districts or the regional administrative office, and then submitted to the provincial people's government for approval.

Article 27 No unit or individual may be in a tourist attraction. Quarrying, mining, digging, sand mining, building graves, illegal logging, burning, hunting, dumping solid wastes, discharging sewage and harmful gases, setting up billboards at will, building enterprises or facilities that damage the ecological environment, destroying tourism resources and damaging the tourism landscape.

no unit or individual may build various economic development zones in national and provincial scenic spots, nature reserves and forest parks.

it is forbidden to build tourist facilities that propagate feudal superstitions, vulgarity and vulgarity, which are harmful to the physical and mental health of tourists.

It is forbidden to set up stalls or enclosure in tourist attractions and their surroundings without authorization; It is forbidden for vendors to trick or intimidate tourists into shopping.

chapter iv tour operators

article 28 tour operators shall obtain corresponding business licenses and business licenses in accordance with the provisions of relevant laws and administrative regulations before engaging in tourism business activities.

the term "tourism operators" as mentioned in these regulations refers to travel agencies, tour guide service enterprises, restaurants, shops, travel companies, tourism commodity production enterprises, holiday and amusement places, tourist attractions and scenic spots that are specialized in or mainly engaged in tourism business activities.

article 29 tourism operators may establish or join tourism industry associations according to law.

tourism industry associations should abide by laws and regulations, carry out activities in accordance with the provisions of the articles of association, and play the functions of guidance, communication and service to safeguard the legitimate rights and interests of tourism operators and tourists.

article 3 the relevant administrative departments shall not charge fees other than those approved by the state and provincial people's governments when handling the relevant certificates of tourism operation.

tour operators have the right to refuse the inspection of those who have no legal inspection certificates, the right to refuse the fees that violate the provisions of laws and regulations, the right to refuse the illegal fines or the withholding of business licenses, and the right to refuse the forced promotion of goods or the forced placement of personnel by various departments.

article 31 tour operators shall provide services for tourists according to national standards or industry standards.

the tourism management department shall organize the assessment and evaluation of the tourism business integrity units, and make an announcement to the public.

article 32 tour operators shall operate according to law, compete fairly, be honest and trustworthy, disclose service items and service prices, and provide services according to written contracts or agreed service items and standards.

article 33 a tour operator shall establish and improve a safety management system, equip with tourism safety prevention facilities, and ensure that the services provided meet the requirements of protecting tourists' personal and property arrangements.

tourism operators should make a true explanation and clear warning about matters that may endanger the personal and property safety of tourists, and take measures to prevent the occurrence of harm.

A tour operator can only operate thrilling tourism projects involving personal safety, passenger ropeways, cable cars and large and medium-sized amusement facilities after passing the inspection by a statutory inspection agency. Quality and technical supervision, public security, production safety and other departments should strengthen supervision and regular inspection.

if the services provided by tour operators or the safety measures taken are improper, which causes personal and property damage to tourists, they shall be compensated.

article 34 tourism operators shall provide legal education, professional ethics education and professional skills training for their employees.

tourism professionals must be qualified in tourism business training and hold relevant certificates, and provide services in strict accordance with national standards or industry standards.

article 35 when engaging in tourism business, tourism operators shall make and keep complete business files, submit statistical statements to tourism management departments in accordance with relevant state regulations, and shall not provide false data or forge statistical statements.

article 36 star rating shall be applied to hotels. The evaluation of star-rated hotels shall be organized and implemented by the tourism management department of the provincial people's government in accordance with national standards, and dynamic management shall be implemented.

star-rated hotels must provide services according to star-rated standards.

Non-star hotels are not allowed to use star names or titles for business activities.

article 37 when a travel agency establishes a branch and a sales department (sales department), it shall apply for registration and examination and approval in accordance with the relevant provisions of the state and this province. Travel agencies implement unified management and unified accounting for their branches.

article 38 foreign-invested travel agencies and travel agencies from other provinces (cities, districts) can organize domestic and foreign travel teams to directly carry out tourism activities in this province. The relevant departments of the people's governments at or above the county level and tour operators shall provide convenience for them in transportation, consultation, service or visa and filing.

article 39 a travel agency shall sign a written contract with the tourists when organizing tours. The contract shall specify the tour schedule and route, the scenic spots, places of entertainment and time, the standards of transportation, accommodation, the contents and standards of tour guide service, the tour price, the liability for breach of contract and other matters. When arranging tourists to shop, the place, frequency and time of shopping shall be specified.

encourage the use of model texts of tourism contracts recommended by the state.

travel agencies, tour guides, tour leaders and other employees should strictly perform the contract. If they want to change the contract, they must obtain the written consent of the tourists. If the tourists want to change the contract, the travel agency should negotiate with the tourists and specify it in the contract.

article 4 when organizing tours, a travel agency shall rent a vehicle and boat with a business license and a passenger transport business license, which meet the requirements for ensuring the personal and property safety of tourists.

Drivers engaged in tourism transportation for travel agencies should follow the travel routes and standard services agreed by travel agencies and obey the arrangements of tour guides.

article 41 when organizing tours, a travel agency shall not change the route, change the service items, lower the service standard or charge extra fees without the written consent of the tourists, except for force majeure. If the service items are reduced due to price reduction or force majeure, the travel agency shall refund the corresponding fees.

when organizing tours, travel agencies should take out travel agency liability insurance and recommend relevant personal insurance for tourists.

Article 42 To establish a tour guide service enterprise, it shall apply to the administrative department for industry and commerce for a business license and accept it.
