Interim Provisions of Shaanxi Province on Tourism Management

Article 1 These Provisions are formulated in order to strengthen tourism management, protect the legitimate rights and interests of tourists, improve service quality and promote the healthy development of tourism. Article 2 All tourism enterprises and institutions in this province, including travel agencies engaged in international and domestic tourism business, all kinds of foreign-related hotels, hotels, restaurants, coach companies, tourist attractions, tourist spots, tourist commodity dealerships and other units engaged in foreign-related tourism business, regardless of affiliation and ownership nature, must accept the industry management of the tourism administrative department.

Aviation, transportation, cultural relics, light industry, commerce, public security, industry and commerce, administration, price, taxation, foreign exchange management and other relevant departments shall, in accordance with their respective statutory duties, implement corresponding management of tourism. The tourism department should coordinate with the above departments. Third Provincial Tourism Bureau, as the tourism administrative department of the provincial people's government, unified management of the province's tourism industry. The tourism administrative departments of prefectures, cities and counties manage the tourism industry within their respective jurisdictions. Article 4 Provincial Tourism Bureau is responsible for the examination and approval of first-class travel agencies operating international tourism business, second-class travel agencies, unified examination of tour guide qualifications and issuance of tour guide certificates, examination and approval of business licenses of foreign-related hotels and star rating.

Foreign-related tourist shops, restaurants and automobile companies that apply for opening business shall be examined by the provincial, prefectural and municipal tourism administrative departments respectively according to their affiliation, and only after approval can they register with the administrative department for industry and commerce. Foreign-related shops, restaurants and automobile companies directly under Xi or affiliated to provincial units shall be examined by the Provincial Tourism Bureau. Xi's subordinate unit shall be audited by Xi Tourism Bureau. Fifth foreign-related hotels, shops and restaurants are subject to fixed-point management. Fixed-point standards are formulated and published by the Provincial Tourism Bureau.

After the qualification examination, the designated tourist hotels shall be examined and approved by the Provincial Tourism Bureau in conjunction with relevant departments. The location of foreign-related shops and restaurants shall be examined and approved by the local Municipal Tourism Bureau in conjunction with relevant departments, and reported to the Provincial Tourism Bureau for the record.

The approval certificate and designated signs of designated units shall be uniformly produced by the Provincial Tourism Bureau and issued by the approval authority.

The approving authority shall review the designated units once a year. Those who fail to meet the standards after review will be disqualified. Article 6 Travel agencies that receive foreigners, overseas Chinese and compatriots from Hong Kong, Macao and Taiwan shall plan and manage the shopping and catering of tourism teams. The shopping and catering plans of tourism teams must be made, incorporated into the activity plans of each tourism team, and strictly implemented. In violation of the plan management system of travel agencies, ranging from two thousand yuan to ten thousand yuan fine, and named the main person in charge of the informed criticism unit. For individuals who violate the plan management system, the travel agency will give economic punishment according to the seriousness of the case. Article 7 When a tour guide leads a tour group to shop in hotels and designated shops outside hotels, it shall respect the wishes of tourists. In principle, only once a day. If tourists complain that they have taken the tour group around the store many times at will, the travel agency will give the tour guide financial punishment or administrative disciplinary action depending on the seriousness of the case. Eighth tour guides and drivers are not allowed to lead or transport tour groups to non-designated units for shopping and dining. If there is any violation, the qualification of full-time tour guide will be revoked for one year, and the formal examination qualification of internship tour guide will be cancelled; Part-time tour guides are disqualified; Automobile drivers cancel foreign-related automobile driving qualifications; The meals of the tour leader (transport) team will not be paid. Ninth designated foreign-related tourist shops shall not contract or lease the counters to individual industrial and commercial households. Offenders are disqualified from fixed-point work.

Only one designated foreign-related tourist shop can be opened in each scenic spot that is open to the outside world, unless it is specially approved.

Foreign tourist restaurants should focus on catering. Without approval, it is not allowed to go beyond the business of goods unrelated to catering. Violators shall be fined by the administrative department for industry and commerce in accordance with the relevant provisions, suspend business for rectification, and even revoke their business licenses.

Individual industrial and commercial households must obtain the approval of the local tourism authorities before they can sell goods to foreign tourists in Shaanxi, and they must set up fixed sales booths and operate aboveboard. It is strictly forbidden to operate without a license or sell goods by force. Offenders shall confiscate their illegal income until their business licenses are revoked. Article 10 The foreign exchange payment quota of foreign-related tourism business units shall be determined by the foreign exchange administration department in conjunction with the tourism authorities. If the target of foreign exchange settlement is not reached, the proportion of foreign exchange retention may be reduced or the license for quasi-receipt of foreign exchange certificates may be revoked according to the specific circumstances.

The amount of foreign exchange paid by foreign-related individual industrial and commercial households shall be determined by the foreign exchange administration department and the administrative department for industry and commerce. If the foreign exchange settlement target is not reached, the administrative department for industry and commerce shall, according to the actual situation, give a warning, impose a fine, cancel the business qualification of foreign-related commodities, and even revoke the business license. The administrative department for industry and commerce may withdraw a certain proportion of foreign exchange quota from the foreign exchange turned over. The specific proportion shall be formulated separately by the Provincial Administration of Foreign Exchange in conjunction with the Provincial Administration for Industry and Commerce. Eleventh it is strictly forbidden to accept kickbacks and tips in tourism business. From1August 1987 17, the State Council approved the National Tourism Administration to issue the Provisions on Prohibiting Taking Rebates and Tips in Tourism Business. If it is found that shops, restaurants, automobile companies and other business units that receive foreigners, overseas Chinese and compatriots from Hong Kong, Macao and Taiwan pay less than 1000 yuan in private, they will be mainly responsible for the unit in addition to being punished according to the regulations. If the total amount of kickbacks paid to private individuals exceeds 1,000 yuan, the designated qualification of the unit shall be cancelled, and a fine of five to twenty times the amount of kickbacks shall be imposed.

All travel agencies are not allowed to take kickbacks from restaurants in any form. Offenders shall be punished according to the regulations, and both units shall be fined ten to twenty times the amount deducted. And named the main leaders of both sides in informed criticism.

Staff in the tourism industry who withdraw deductions and tips without permission will be disqualified from foreign-related services from1August 1987 17, unless the accumulated private income is found to be between 500 yuan and 1000 yuan. If the accumulated private income exceeds 1000 yuan, the illegal income shall be confiscated and the public office shall be dismissed. If the circumstances are serious and violate the criminal law, they shall be transferred to judicial organs for criminal responsibility according to law.

If the staff of foreign-related tourism enterprises and institutions recover the deductions and tips privately, the person in charge of the unit shall be informed criticism until the administrative responsibility is investigated.
