Shandong Province Interim Management Measures for Domestic Vessels Calling Foreign Vessels
Article 1: In order to strengthen the management of domestic ships docking with foreign ships, adapt to the needs of reform and opening up, and safeguard national sovereignty and dignity, these Measures are formulated in accordance with relevant national laws and regulations and in conjunction with the actual conditions of our province. Article 2 The term "domestic ships" as mentioned in these Measures refers to domestic traffic ships, supply ships, tugboats, barges, fishing boats and other civilian ships sailing in our province's open ports; "foreign ships" refers to foreign ships visiting our province's open ports. Nationality: merchant ships, tourist ships, research ships, exploration ships and other civilian ships. Article 3 The border inspection stations established by the state at all ports open to the outside world are the competent authorities for the management of domestic ships docking with foreign ships.
Units and individuals that own and use domestic ships should strengthen the management and education of ship employees and assist border inspection stations in the management of domestic ships docking with foreign ships. Article 4 Domestic ships that need to berth with foreign ships due to business needs must obtain approval from the border inspection station and apply for a "Permit for berthing with foreign ships" (hereinafter referred to as the "Chip Permit"), and the berthing certificate is required.
Transportation vessels (including tugboats used to pick up and drop off pilots and foreign ships docking and leaving the dock) of the agencies required by the state to participate in joint inspections (i.e., port supervision, customs, border inspection stations, health and quarantine stations), There is no need to apply for a "reliance certificate". Article 5 To apply for a "Docking Permit", the ship-using unit or individual ship owner shall apply to the border inspection station. When a ship berths with a foreign vessel, it must submit a "Docking Permit" to the officer on duty at the border inspection station.
The validity period of the "Carriage Permit" is determined by the border inspection station and cannot exceed one year. It will be returned to the issuing authority upon expiration. Article 6 Domestic ships and employees who are approved to board foreign ships must comply with the following regulations:
(1) Submit to the management of the personnel on duty at the border inspection station;
(2) Only board By the foreign ship specified on the "berthing certificate";
(3) No unrelated persons are allowed to board the foreign ship;
(4) When the ship needs to be boarded or disembarked by the foreign ship, the ship should The officers on duty at the border inspection station will issue a crew list. Employees on board the ship should take the initiative to hand over their identity documents and are not allowed to stay on board the outer ship. Article 7 Before the entry border inspection, after the exit border inspection and during the inspection, except for the traffic ships carrying out the joint inspection, other domestic ships are not allowed to dock, regardless of whether they hold a "berthing permit" or not. Article 8 Anyone who violates the provisions of these Measures and commits any of the following circumstances shall, depending on the severity of the case, be given a warning, prohibited from docking, and fined not less than RMB 50 but not more than RMB 5,000 by the border inspection station. Anyone who violates criminal laws will be held criminally responsible in accordance with the law:
(1) Passing aboard a foreign ship without authorization without holding a "Call Permit";
(2) Before the foreign ship's entry border inspection, exit border inspection After the inspection and during the inspection, berthing with the foreign ship;
(3) berthing with the foreign ship not specified on the "Balking Permit" or carrying unrelated persons on board the foreign ship;
( 4) Violate other provisions of these Measures. Article 9 Any unit or individual who is dissatisfied with the punishment imposed by the border inspection station may appeal to the superior authority of the border inspection station within five days after receiving the penalty notice, and the superior authority of the border inspection station will make a termination decision. Article 10 The Provincial Public Security Department is responsible for the interpretation of these Measures. Article 11 These Measures shall come into effect from the date of promulgation.
