Qinghai Tourism Regulations (revised in 2020)

Chapter I General Provisions Article 1 In order to protect the legitimate rights and interests of tourists, tour operators and tourism professionals, standardize the order of the tourism market, protect and rationally utilize tourism resources, and promote the sustained and healthy development of tourism, these Regulations are formulated in accordance with the Tourism Law of the People's Republic of China and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the protection and utilization of tourism resources, tourism activities, tourism management and services and the implementation of tourism supervision and management within the administrative area of this province. Article 3 The development of tourism should conform to the requirements of ecological civilization construction, highlight the regional characteristics of Qinghai, and follow the principles of government guidance, market operation, social participation and industry self-discipline, so as to achieve the unity of social, economic and ecological benefits. Article 4 People's governments at or above the county level shall strengthen the organization and leadership of tourism development, incorporate tourism development into the national economic and social development plan, establish and improve the comprehensive coordination mechanism, market supervision mechanism and evaluation mechanism for tourism development, increase capital investment and policy support for tourism, strengthen the construction of tourism public service system, optimize the tourism development environment, and promote the integrated development of tourism and related industries.

Township (town) people's governments and subdistrict offices shall assist the people's governments at or above the county level and their relevant departments to do a good job in the protection and utilization of tourism resources, tourism development, tourism safety supervision and tourism environmental order maintenance within their respective administrative areas. Article 5 The competent departments of culture and tourism of the people's governments at or above the county level shall be responsible for the guidance, coordination, management, supervision and related public services of the tourism industry within their respective administrative areas.

Departments of development and reform, ethnic religion, public security, finance, natural resources, ecological environment, housing and urban construction, transportation, agriculture and rural areas, water conservancy, forestry and grassland, commerce, health, market supervision, sports and emergency management shall, according to their respective functions and duties, do a good job in promoting the development, supervision and management of tourism.

Relying on national parks, scenic spots, nature reserves and other resources to carry out tourism activities, the management institutions established according to law should do a good job in tourism management within the scope of their duties. Article 6 The people's governments at or above the county level and their relevant departments shall strengthen the publicity and education on public welfare of civilized tourism, guide tourists, tour operators and residents of tourism professionals and tourist destinations to enhance their awareness of ecological environmental protection, and advocate healthy, civilized and environmentally friendly tourism modes.

Tourism operators and tourism professionals should publicize the knowledge of ecological environment protection to tourists in tourism business activities, and promptly discourage tourists from destroying the ecological environment and violating social morality in tourism activities. Article 7 A tourism industry organization established according to law shall improve the self-discipline mechanism of the industry, strengthen the credit construction of its members, standardize and guide the honest service of its members, and safeguard the legitimate rights and interests of the industry and the order of fair competition. Chapter II Tourism Planning and Resource Protection and Utilization Article 8 The people's governments at or above the county level shall, according to the requirements of the national economic and social development plan, organize the formulation of tourism development plans in their respective administrative areas. Tourism development planning shall be compiled by the competent department of culture and tourism in conjunction with relevant departments and implemented after being approved by the people's government at the corresponding level.

When using tourism resources that are suitable for overall utilization across administrative regions, the people's government at a higher level shall organize the preparation of a unified tourism development plan or the relevant local people's governments shall negotiate and coordinate to solve major problems in the implementation of the tourism plan.

The people's governments at or above the county level may, according to the tourism development plan, formulate special plans for the development and utilization of key tourism resources and organize their implementation. Article 9 The compilation of tourism development plans and special plans for the development and utilization of key tourism resources should reflect local characteristics, ethnic characteristics, cultural connotations, ecological environment protection concepts and regional functional advantages, and combine the requirements of building regional tourism brands, integrating routes and helping the poor, and build a scientific protection and rational utilization mechanism for superior resources such as natural landscape, ecological environment, history and culture, folk customs and customs, so as to prevent disorderly development and repeated construction. Article 10 The compilation of tourism development plans and special plans for the development and utilization of key tourism resources shall be linked with the overall land use planning, urban and rural planning, environmental protection planning and other plans for the protection and utilization of human resources such as natural resources and cultural relics.

When preparing or adjusting the national economic and social development plan, the overall land use plan, urban and rural planning and other special plans involving tourism, the relevant departments shall consider the actual needs of tourism development and solicit the opinions of the competent departments of culture and tourism of the people's governments at the corresponding levels. Eleventh the preparation of tourism development planning and special planning for the development and utilization of key tourism resources shall implement the relevant national and provincial planning and design standards and norms, and solicit the opinions of the competent department of culture and tourism of the people's government at the next higher level.

Before the planning is submitted for approval, the opinions of relevant departments, experts, scholars and the public should be listened to by holding demonstration meetings, evaluation meetings and public comments.

The approved plan shall be announced to the public. Twelfth approved tourism development plans and special plans for the development and utilization of key tourism resources shall not be changed or adjusted without authorization; If it is really necessary to change or adjust, it shall be reported to the original examination and approval authority for approval. Thirteenth the use of natural resources to develop tourism projects should protect natural resources, biodiversity and the integrity of the ecosystem; The use of human resources to develop tourism projects shall maintain its traditional pattern, historical features and national characteristics, and shall not be rebuilt, expanded or demolished without authorization; The use of resources such as industry, agriculture, animal husbandry, culture and sports to develop tourism projects should keep the content in harmony with the landscape, environment and facilities.
