Chapter 1 General Provisions Article 1 In order to regulate the road transport market order, ensure road transport safety, protect the legitimate rights and interests of road transport parties, and promote the healthy development of the road transport industry, in accordance with relevant laws and administrative regulations, combined with This regulation is formulated based on the actual conditions of this province. Article 2 These regulations apply to activities engaged in road transportation operations and road transportation-related businesses within the administrative region of this province. Article 3 Those engaged in road transportation operations and road transportation-related businesses must operate in accordance with the law, be honest and trustworthy, compete fairly, and provide safe, convenient, and high-quality services to service recipients. Article 4 People's governments at or above the county level shall formulate road transportation development plans based on the needs of national economic and social development and organize their implementation.

People's governments at or above the county level should develop rural road transportation and take measures to increase the shuttle bus opening rate in townships (towns) and administrative villages. Article 5 The transportation administrative departments of the people's governments at or above the county level are responsible for organizing and leading the road transportation management work within their respective administrative regions, and their affiliated road transportation management agencies are responsible for the specific implementation of road transportation management work.

Relevant departments such as public security, industry and commerce, construction, taxation, price, and quality supervision should do a good job in road transportation management in accordance with their respective responsibilities. Chapter 2 Road Transport Operations Section 1 Passenger Transport Operations Article 6 Passenger transport operators shall obtain a road transport operation license and a vehicle operation certificate in accordance with the law, and apply for an industrial and commercial business license with the road transport operation license.

When issuing a road transport operating license, the road transport management agency shall issue a line passenger transport sign board to the passenger vehicles that the line passenger transport operator has obtained a license for.

If there are more than three applicants for the same passenger line, the road transport management agency may make the licensing decision through bidding. The bidding methods for passenger transport operating licenses shall be formulated by the transportation administrative department of the Provincial People's Government in accordance with relevant national regulations. Article 7 Passenger transport operators shall put into operation within 6 months after obtaining the road transport operation license. If it fails to put into operation after the expiration date without justifiable reasons, or if it is suspended for more than 6 months continuously after operation, it will be deemed to have automatically terminated its operation, and its road transportation operating license will be canceled by the original licensing authority.

If a passenger transport operator needs to terminate its passenger transport operation, it shall notify the original licensing authority within 30 days before the termination, and return the road transport operation license to the original licensing authority within 10 days after the termination of operation, and handle the relevant cancellation procedures. .

If the capacity of the originally licensed passenger transport line is insufficient due to the suspension or termination of operation by the passenger transport operator, which affects the life and production of urban and rural residents, the road transport management agency shall promptly arrange for the passenger transport line to supplement the transport capacity. Article 8 The operating period of passenger transport on expressways shall be in accordance with the following provisions: (1) The operating period of passenger transport on expressways is 6 years; (2) The province on other roads The operation period of international passenger lines is 5 years, and the operation period of intra-provincial passenger lines is 4 years. Article 9 If a passenger transport operator needs to extend the passenger transport operation period of a line obtained in accordance with the law, he shall apply to the original licensing authority 30 days before the expiration of the operation period; if the following conditions are met, the original licensing authority shall grant priority permission:

(1) There are no serious transportation safety accidents during the operation of passenger transport on this line;

(2) There are no serious service quality incidents during the operation of passenger transport on this line;

< p>(3) During the period of operating the passenger transport line, there were no serious operating violations;

(4) The obligation of universal service was fulfilled in accordance with regulations. Article 10: Line passenger transport operators shall operate in accordance with the permitted routes, published shifts and departure times, and shall not change operating routes and departure times without justifiable reasons. Line passenger transport operators shall stop at specified stations to pick up and disembark passengers, and shall not pick up passengers outside the station or solicit passengers along the route, except for rural roads where there are no stations.

Chartered passenger transport operators shall travel according to the agreed time, starting point, destination and route. They shall not operate at fixed points and routes according to the bus mode, and shall not solicit passengers outside the chartered bus contract.

Tourist passenger transport is divided into fixed-line tourist passenger transport and non-fixed-line tourist passenger transport according to the operation mode. Fixed-line tourist passenger transport shall be managed according to regular line passenger transport, and non-fixed-line tourist passenger transport shall be managed according to chartered passenger transport. Article 11 Passenger transport operators shall print the name or logo of the company at an appropriate location on the exterior of the passenger vehicle, and publicize the supervision telephone number, fare and odometer of the road transport management agency in a conspicuous position inside the carriage. Article 12 Passenger transport operators shall provide passengers with a good riding environment, ensure that the vehicle equipment and facilities are complete and effective, keep the vehicles clean and hygienic, and take necessary measures to prevent violations of the personal and property safety of passengers during transportation. Behavior.

When public security violations that infringe on the personal and property safety of passengers occur during transportation, passenger transport operators shall promptly report to the public security organs and cooperate with the public security organs to promptly terminate the public security violations. Article 13 Passenger transport operators shall not engage in the following acts:

(1) Using deceptive means to recruit passengers or forcing passengers to ride; (2) Dumping passengers midway, extorting passengers, or Handing over passengers to others for transportation;

(3) Changing passenger vehicles without authorization;

(4) Impeding the normal business activities of other operators;

(5) Other behaviors that infringe upon the legitimate rights and interests of passengers.

If a passenger vehicle is damaged and cannot run normally, the passenger transport operator shall not charge repeatedly when replacing the passenger vehicle or handing over passengers to others for transportation.
