The contents of the general aviation flight control regulations

Chapter I General Provisions General aviation activities within the People's Republic of China must abide by these Regulations.

the relevant provisions of these regulations shall apply to the activities of raising and releasing unmanned free balloons and tethered balloons within the territory of the People's Republic of China. According to the division of responsibilities, the flight control department is responsible for the management of general aviation flight activities and providing air traffic control services. Relevant flight support units shall actively coordinate and cooperate, do a good job in relevant service support, and create convenient conditions for general aviation flight activities.

chapter ii designation and use of flight airspace

if a unit or individual applying for general aviation flight activities needs to designate temporary flight airspace according to the requirements of flight activities, it shall apply to the relevant flight control department for designation of temporary flight airspace.

The application for designation of temporary flight airspace shall include the following contents:

(1) The horizontal range and height of temporary flight airspace;

(2) methods of flying into and out of the temporary flight airspace;

(3) the time of using the temporary flight airspace;

(4) the nature of flight activities;

(5) Other relevant matters. The designation of temporary flight airspace shall be approved in accordance with the following provisions:

(1) The designation within the airport area shall be approved by the department in charge of flight control of the airport;

(2) if it is designated in a flight control zone beyond the airport area, it shall be approved by the department in charge of flight control in that zone;

(3) if it is designated in a flight control zone beyond the flight control zone, it shall be approved by the department in charge of flight control in the control zone;

(4) those designated in flight control zones shall be approved by the China People's Liberation Army Air Force.

the department that approves the designation of temporary flight airspace shall report the designated temporary flight airspace to the flight control department at the next higher level for the record and notify the relevant units. The application for designation of temporary flight airspace shall be submitted to the relevant flight control department seven working days before the proposed use of temporary flight airspace; The flight control department responsible for approving the temporary flight airspace shall make a decision on approval or disapproval three working days before the proposed use of the temporary flight airspace, and notify the applicant.

the use period of the temporary flight airspace shall be determined according to the nature and needs of general aviation flight, and usually shall not exceed 12 months.

if it is necessary to extend the use period of temporary flight airspace due to the requirements of flight tasks, it shall be reported to the flight control department that approved the temporary flight airspace for approval.

after the general aviation mission is completed, the units and individuals engaged in general aviation flight activities shall promptly report to the relevant flight control departments, and the temporary flight airspace they applied for will be revoked. The designated temporary flight airspace can also be used by other units and individuals engaged in general aviation flight activities with the consent of the flight control department that approved the designation of the temporary flight airspace.

Chapter III Management of Flight Activities

The application for flight plan implemented by units and individuals shall include the following contents:

(1) Flight unit;

(2) the nature of the mission;

(3) the name, code (call sign) and number of aircrew members of the captain (pilot);

(4) Type and number of aircraft;

(5) communication method and code of secondary radar transponder;

(6) Take-off, landing at airports and alternate airports;

(7) Estimated flight start and end times;

(8) flight meteorological conditions;

(9) flight route, flight altitude and flight range;

(1) other special security needs. Units and individuals engaged in general aviation flight activities must submit valid mission approval documents when applying for flight plans under any of the following circumstances:

(1) flying out of or into China's airspace (except for official flights);

(2) entering the air restricted area or flying over the area between the national (border) line and our side for 1 kilometers;

(3) conducting aerial geophysical exploration or aerial photography activities within the territory of China;

(4) flying beyond the territorial sea (coast) line;

(5) foreign aircraft or foreigners use Chinese aircraft to carry out general aviation flight activities in China.

the flight plan of temporary flight airspace applies for using airport flight airspace, air routes and air routes for general aviation flight activities, and its flight plan application is approved by the local flight control department or reported by the local flight control department to the higher flight control department for approval.

For general aviation flight activities using temporary flight airspace and temporary routes, the application for flight plan shall be approved in accordance with the following provisions:

(1) In the airport area, it shall be approved by the department in charge of flight control at the airport;

(2) If it is beyond the airport area and within the flight control zone, it shall be approved by the department in charge of flight control in the zone;

(3) If it is beyond the flight control zone and is within the flight control zone, it shall be approved by the department in charge of flight control in this area;

(4) Those who exceed the flight control zone shall be approved by the China People's Liberation Army Air Force. The application for flight plan shall be made before 15: one day before the planned flight; The flight control department shall make a decision on approval or disapproval before 21: one day before the planned flight, and notify the applicant.

those who perform emergency rescue, emergency rescue and disaster relief, weather modification or other emergency tasks may apply for a temporary flight plan. An application for a temporary flight plan shall be made at the latest 1 hour before the planned flight; The flight control department shall make a decision on approval or disapproval 15 minutes before the planned departure time, and notify the applicant. The flight control department may order an aircraft that violates flight control regulations to correct or stop its flight according to the situation.

Chapter IV Flight Support

Units and individuals engaged in general aviation flight activities shall establish reliable communication with relevant flight control departments.

when engaging in general aviation flight activities within the designated temporary flight airspace, the air-ground contact should be kept smooth. The flight control department shall provide air traffic control services for general aviation flight activities in accordance with the division of responsibilities or agreements.

the general aviation flight support charges for the use of military airports shall be implemented in accordance with the relevant national domestic airport charges.

Chapter V Provisions on Lifting and Tethering Balloons The lifting and tethering of unmanned free balloons or tethered balloons shall not affect flight safety.

the unmanned free balloon as mentioned in these regulations refers to an inflatable object that is unpowered, unmanned, lighter than air, and has a total mass greater than 4kg and drifts freely.

tethered balloons as mentioned in these regulations refer to inflatable objects that are tethered to ground objects and have a diameter greater than 1.8 meters or a volume capacity greater than 3.2 cubic meters and are lighter than air. The activities of raising and releasing unmanned free balloons or tethering balloons must be approved by the competent meteorological department at or above the municipal level in conjunction with relevant departments. The specific measures shall be formulated by the competent meteorological department of the State Council.

application for lifting and releasing unmanned free balloons, the application for lifting and releasing unmanned free balloons shall generally include the following contents:

(1) the unit, individual and contact method for lifting and releasing;

(2) Type, quantity, use and identification marks of balloons;

(3) lifting place and planned recovery area;

(4) estimated time of lifting and recycling (end);

(5) Estimated drift direction, rising speed and maximum height. The unmanned free balloon shall be hoisted and released in accordance with the approved application, and the dynamics of hoisting and releasing shall be reported to the relevant flight control department in time; When canceling the lifting, it shall promptly report to the relevant flight control department.

requirements for lifting and releasing tethered balloons. When lifting and releasing tethered balloons, it shall be ensured that they are firmly tethered and shall not be released without authorization.

The height of the tethered balloon shall not be higher than 15m above the ground, except that it is lower than the top of the building within 5m from its horizontal distance.

if the height of the tethered balloon is more than 5 meters above the ground, a quick deflation device must be installed and an identification sign must be set. When the following situations that may endanger flight safety occur in the unmanned free balloons or tethered balloons, the lifting units and individuals shall promptly report to the relevant flight control departments and local meteorological authorities:

(1) the unmanned free balloons are not operating normally;

(2) the tethered balloon accidentally leaves the tether;

(3) Other abnormal conditions that may affect flight safety.

when the tethered balloon with quick deflation device is accidentally detached from the tether, the unit or individual who lifts the tethered balloon shall start the deflation device quickly under the condition of ensuring the safety of people and property on the ground. It is forbidden to raise and release unmanned free balloons or tethered balloons within the airport designated according to law and the airport clearance protection area, except as otherwise provided by the state.

chapter VI legal responsibilities if any unit or individual engaged in general aviation flight activities violates the provisions of these regulations and has any of the following circumstances, the relevant department shall order it to make corrections and give a warning according to the division of responsibilities; If the circumstances are serious, a fine of not less than 2, yuan but not more than 1, yuan may be imposed, and the punishment may be ordered to stop flying for 1 month to 3 months, temporarily detained until the business license and flight license are revoked; Those who cause serious accidents or serious consequences shall be investigated for criminal responsibility according to the provisions of the Criminal Law on the crime of serious flight accidents or other crimes: < P > (1) Flying without approval;

(2) Failing to fly according to the approved flight plan;

(3) failing to report or omit flight dynamics in time;

(4) flying into an air restricted zone or an air danger zone without approval. In violation of the provisions of these regulations, if any of the following circumstances occurs, the competent meteorological department or the relevant department shall order it to make corrections and give a warning according to the division of responsibilities; If the circumstances are serious, a fine of 1 thousand yuan or more and 5 thousand yuan or less shall be imposed; Those who cause serious accidents or serious consequences shall be investigated for criminal responsibility according to the provisions of the Criminal Law on the crime of serious accidents or other crimes: < P > (1) those who are promoted without approval;

(2) Failing to upgrade according to the approved application;

(3) failing to set the identification mark as required;

(4) Failing to report the lifting and releasing dynamics in time or failing to report in time according to the regulations when the tethered balloon is accidentally detached;

(5) lifting and releasing in the specified forbidden area. Fines imposed in accordance with these regulations shall be turned over to the finance in full.

Chapter VII Supplementary Provisions These Regulations shall come into force as of May 1, 23.
