Clearance protection measures of Chongqing military airport

Article 1 In order to strengthen the protection of the clearance area of military airports in this Municipality and ensure the safety of military aviation activities, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Military Facilities, the Measures for the Implementation of the Law of People's Republic of China (PRC) on the Protection of Military Facilities and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the protection of the clearance area of military airports within the administrative area of this Municipality.

Where laws and regulations provide otherwise, such provisions shall prevail. Article 3 The term "military airport clearance area" as mentioned in these Measures refers to the space area around the military airport where the height of objects is restricted to ensure the safety of flight activities such as take-off, landing and go-around.

The scope of military airport clearance area shall be implemented in accordance with the regulations of the State Council and the Central Military Commission (CMC) on military airport clearance. Article 4 The people's governments of districts and counties where military airports are located shall be fully responsible for the clearance protection of military airports within their respective administrative areas, and formulate effective measures to ensure the clearance safety of military airports.

The Township People's Government where the military airport is located is responsible for the daily protection of the clearance area of the military airport within its administrative area.

The relevant administrative departments of the municipal, district and county people's governments shall, according to their respective functions and duties, be responsible for the protection of the clearance area of military airports. Article 5 No unit or individual may interfere with the security of the clearance area of a military airport, and has the right to report, expose and accuse acts that undermine or endanger the security of the clearance area of a military airport. Article 6 The municipal, district and county people's governments shall commend and reward the units and individuals that have made remarkable achievements in the clearance protection of military airports. Article 7 It is forbidden to engage in the following activities that may affect flight safety in the clearance area of military airports:

(1) Setting off fireworks and firecrackers;

(2) Raising and flying pigeons or flying other birds;

(3) flying kites;

(4) discharging a large amount of smoke, fire and waste gas into the atmosphere;

(5) Setting up lights or objects that affect the use of navigation AIDS in military airports or the sight of pilots;

(six) planting plants that affect the use of navigation AIDS in military airports;

(seven) the construction of shooting range, explosives warehouse;

(eight) blasting operations that exceed the requirements of clearance protection height;

(nine) other activities that violate laws, regulations and rules and affect flight safety. Article 8 When building tall buildings, structures or other facilities that may affect flight safety in the clearance area of a military airport, the opinions of the competent military department of the military airport shall be sought in accordance with the provisions of the Measures for the Implementation of the Law on the Protection of Military Facilities.

Tall buildings, structures or other facilities in the clearance area of a military airport shall set up flight obstacle signs in accordance with the provisions of the Regulations on Clearance of Military Airports and keep them in a normal display state. Article 9 It is forbidden to raise and release unmanned free balloons and tethered balloons in the clearance area of military airports, unless otherwise stipulated by the state.

Flying airships, hot air balloons, gliders and powered parachutes in the clearance area of military airports shall go through the examination and approval procedures in accordance with the provisions of the Regulations on General Aviation Flight Management of the State Council and the Central Military Commission, and report the flight situation in a timely manner. Article 10 Anti-aircraft guns and rockets shall be used for weather modification in the clearance area of military airports in accordance with the regulations of the State Council Municipality on weather modification. Article 11 The electromagnetic environment protection in the clearance area of a military airport shall be implemented in accordance with the Measures for the Implementation of the Law on the Protection of Military Facilities. Twelfth in violation of the provisions of article seventh (1) (2) (3) (4) (5) (6) of these measures, the local township people's government shall take effective measures to stop it. In violation of other laws, regulations and rules at the same time, the relevant administrative departments of the people's governments at or above the county level shall be punished according to law. Thirteenth in violation of these measures seventh (seven), eighth (nine), ninth, by the relevant administrative departments of the people's governments at or above the county level shall be dealt with according to law. Fourteenth if a party refuses to accept the administrative punishment made by the relevant administrative departments, it may apply for administrative reconsideration or bring an administrative lawsuit according to law. Article 15 If the staff of relevant administrative organs violate the provisions of these measures, neglect their duties, abuse their powers, engage in malpractices for selfish ends or commit other illegal acts, they shall be given administrative sanctions by the relevant competent authorities; If losses are caused to the parties concerned, they shall bear corresponding liability for compensation according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article sixteenth these Measures shall come into force as of April 6, 2007.
