Measures of Chongqing Municipality on the Administration of Weather Modification

Article 1 In order to strengthen the management of weather modification, prevent and mitigate meteorological disasters, and ensure the safety of the public and people's lives and property, these Measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Regulations on the Management of Weather Modification, the Chongqing Meteorological Regulations and other laws and regulations. Article 2 Whoever engages in weather modification activities within the administrative area of this Municipality shall abide by these Measures. Article 3 The term "weather modification" as mentioned in these Measures refers to the activities that, in order to avoid or mitigate meteorological disasters and make rational use of climatic resources, artificially affect the physical and chemical processes of local atmosphere through scientific and technological means under appropriate conditions to achieve the purposes of increasing rain and snow, hail suppression, rain elimination, fog elimination and frost prevention. Article 4 The people's governments of counties (autonomous counties) shall strengthen their leadership over weather modification work within their respective administrative areas, establish and improve the command and coordination mechanism of weather modification work, strengthen the construction of weather modification work teams, and ensure the smooth development of weather modification work. Article 5 The competent meteorological departments of cities, districts and counties (autonomous counties) shall be responsible for the organization, implementation, guidance and management of weather modification work within their respective administrative areas under the leadership and coordination of the people's governments at the corresponding levels.

City and county (Autonomous County) agriculture, forestry, water conservancy, environmental protection, public security, safety supervision and other departments in accordance with their respective responsibilities, cooperate with the weather modification work. Article 6 The competent meteorological departments of cities, districts and counties (autonomous counties) shall, according to the needs of disaster prevention and mitigation, ecological environment construction and the development and utilization of cloud and water resources in the air, consult the relevant departments at the same level to prepare the annual weather modification work plan, and report it to the people's government at the same level for approval before implementation, and report it to the competent meteorological department at the next higher level for the record. Seventh city, county (Autonomous County) people's government approved the weather modification work, the required funds included in the financial budget of the people's government at the corresponding level. Eighth weather modification operations are determined by the people's governments of cities, districts and counties (autonomous counties), and the units (hereinafter referred to as operation units) that meet the conditions stipulated in these Measures are implemented.

The use of aircraft to carry out weather modification operations shall be carried out by municipal operation units.

Using anti-aircraft guns, rockets or other ground devices to carry out weather modification operations shall be carried out by district/county (autonomous county) operating units. Ninth operating units must meet the following conditions, and after passing the examination by the municipal competent meteorological department, they can engage in weather modification operations after issuing the qualification certificate for weather modification operations:

(1) Having anti-aircraft guns, rocket launchers or other weather modification equipment that meet the national technical standards and requirements;

(2) Having facilities such as operation equipment warehouse and ammunition warehouse that meet the national technical standards and requirements;

(3) Having business commanders and operators who have passed the training and examination by the municipal competent meteorological department and obtained post certificates;

(4) Having a sound operational airspace declaration system, operational safety management system and operational equipment maintenance, transportation, storage and custody system;

(five) other conditions stipulated by the municipal competent meteorological department.

The operators specified in Item 3 of the preceding paragraph shall not be less than 2 persons, each rocket launcher shall not be less than 3 persons, and each anti-aircraft gun shall not be less than 4 persons.

The list of operators of anti-aircraft guns and rocket launchers shall be copied by the local competent meteorological department to the local public security organ for the record. Article 10 The municipal competent meteorological department shall examine the qualifications of the operating units every year. After verification, it does not meet the conditions stipulated in Article 9 of these Measures, and shall be ordered to make rectification within a time limit; If it fails to make rectification within the time limit or fails to meet the requirements after rectification, its business qualification shall be cancelled. Article 11 The layout of anti-aircraft guns and rocket operation sites for weather modification shall be proposed by the competent meteorological departments of counties (autonomous counties) according to the layout and operation of large-scale projects such as regional climate, geography, transportation, communication, population density and water conservancy, and shall be reported to the competent meteorological department of the city with the consent of the people's government at the same level, and shall be determined by the competent meteorological department of the city jointly with the flight control department according to law.

The confirmed business premises shall not be changed without authorization. If it is really necessary to change, it shall be re-determined in accordance with the provisions of the preceding paragraph of this article. Twelfth the construction of weather modification workplaces shall be organized and implemented by the competent meteorological departments of counties (autonomous counties), and the required sites shall be provided by the local people's government.

Fixed anti-aircraft guns and rockets for weather modification operations shall be equipped with operation equipment warehouses, ammunition warehouses, launch platforms and operation duty rooms that meet relevant standards. Thirteenth city, county (Autonomous County) meteorological authorities should establish a fully functional weather modification command system to meet the needs of the operation. Fourteenth in any of the following circumstances, with the approval of the people's government at the same level, the competent meteorological department shall timely organize the implementation of weather modification operations:

(1) A drought has occurred, and it is expected that the drought will be aggravated;

(two) there may be hail weather that seriously harms crops;

(3) Forest and grassland fires occur or forest and grassland are in a period of high fire risk for a long time;

(4) There is a serious shortage of water resources and the ecological environment is deteriorating;

(five) other circumstances that require the implementation of weather modification operations. Fifteenth anti-aircraft guns and rocket launchers are used to carry out weather modification operations, and the competent meteorological departments of counties (autonomous counties) in the operation area shall apply to the relevant flight control departments for airspace and operation time limit. When using aircraft to carry out weather modification operations, the municipal competent meteorological department shall apply to the relevant flight control department for airspace and operation time limit.

The operation unit must operate in strict accordance with the operation norms and procedures within the approved airspace and operation time limit, and accept the command, management and supervision of the competent meteorological department to ensure the safety of operation.
