Notice on the Prohibition of Fireworks and Firecrackers in 2023

In order to strengthen the safety management of fireworks and firecrackers, reduce environmental pollution, ensure public safety and personal and property safety, protect citizens' physical and mental health, and create a good working and living environment, according to the provisions of the People's Republic of China (PRC) Public Security Management Punishment Law, the Regulations on the Safety Management of Fireworks and Firecrackers, the Regulations on the Management of Fireworks and Firecrackers in Sichuan Province and other laws and regulations, and the relevant documents of Mianyang Ecological Environment Protection Committee Office, combined with the actual situation of our city, we are now.

First, the time and scope of the ban.

(1) The whole area of Zhongba Street, Sanhe Town, Taiping Town, Zhangming Town, Longfeng Town, qinglian town Town and Fangshui Town, during the Spring Festival of 2023 (from 20231October 65438+ to 20231October 27 65438+) and the Lantern Festival (2003)

(2) Zhongba Street, sanhe town, Taiping Town and Zhangming Town (the intersection of Xihuan Road and Pingjiang Road, bounded by Xihuan Road and Tonghe River, including Xishan Park; South to Pingtong River to Hexi Bridge, cross the intersection along Mianjiang Road to Fangte Interchange, cross the Fifth Bridge of Fujiang River along the South First Ring Road, and cross Jiangyou Avenue to Dongshan Road. East is bounded by Dongshan intersection, along Dongshan Road to the intersection with Guanzhong Road; North to Guanzhong Road Crossing Xicheng High-speed Railway Overpass to Zhongyan Road, Zhongyan Road to Wu Bo Road, Wu Bo Road to Fujiang Sixth Bridge, and Fujiang Sixth Bridge to the intersection of Xihuan Road and Pingjiang Road): Since the date of announcement, fireworks and firecrackers are prohibited throughout the year.

Second, according to Article 10 of the Regulations on the Administration of Urban Fireworks and Firecrackers in Sichuan Province, if fireworks and firecrackers are set off in prohibited areas, the Municipal Public Security Bureau shall order them to stop, confiscate their fireworks and firecrackers and impose a fine. Units that set off fireworks and firecrackers in violation of regulations shall be fined above 500 yuan 1000 yuan, and the person directly responsible or the person in charge of the unit shall be fined above 500 yuan 2000 yuan; Individuals who set off fireworks in violation of regulations shall be fined above 500 yuan 100 yuan.

Three, because of the fireworks in violation of public security management, in accordance with the provisions of the "People's Republic of China (PRC) Public Security Management Punishment Law", the Municipal Public Security Bureau to give public security punishment.

Four, in the forbidden area of any mobile stalls and unauthorized shops selling fireworks, by the Municipal Emergency Management Bureau, the Municipal Public Security Bureau, the Municipal Market Supervision Bureau, the Municipal Comprehensive Administrative Law Enforcement Bureau and other departments investigated and dealt with according to law.

5. According to the provisions of Article 42 of the Regulations on the Safety Management of Fireworks and Firecrackers, if the operating units and workers who hold large-scale fireworks display activities such as fireworks evening without permission, or violate the fireworks display safety regulations and the discharge operation plan, the Municipal Public Security Bureau shall order them to stop the discharge, and impose a fine of 6.5438+0 million yuan to 50,000 yuan on the responsible units.

Six, who hinder law enforcement officers from performing official duties according to law, which constitutes a violation of public security management, shall be punished in accordance with the "People's Republic of China (PRC) Public Security Management Punishment Law"; If the circumstances are serious, they shall be detained for more than five days and less than ten days; If the case constitutes a crime, criminal responsibility shall be investigated according to law; If property losses or personal injuries are caused to the state, collectives or individuals, they shall be liable for compensation according to law.

Seven, illegal storage of fireworks and firecrackers in the forbidden area or unauthorized transportation of fireworks and firecrackers to the forbidden area, shall be confiscated by the public security organs, refused to cooperate, shall be punished in accordance with the provisions of Article 30 and Article 50 of the People's Republic of China (PRC) Public Security Management Punishment Law.

Eight, the guardian did not fulfill the responsibility of management and education, resulting in the ward in violation of these provisions, and ordered the guardian to educate the ward; If property losses are caused to the state, collective or individual or personal injuries are caused to others, his guardian shall bear civil liability for compensation according to law.

Nine, party member, cadres in violation of the provisions of the discharge, storage, transportation of fireworks, in addition to giving public security punishment, shall be handed over to the Municipal Commission for Discipline Inspection, Supervision Bureau according to law.

Ten, in violation of the provisions of the act, any unit or individual has the right to discourage, stop and report. The Municipal Public Security Bureau shall investigate the legal responsibility of the person or informant according to the acts and consequences of retaliation.
