Legal basis: Article 7 of the "Administrative Measures for Heatstroke Prevention and Cooling Measures"

Employers shall implement the following labor protection measures for high-temperature operations:

(1) Prioritize adoption New technologies, new processes, new materials, and new equipment that are conducive to controlling high temperatures can reduce or eliminate high temperature hazards from the source. For high temperature hazards that cannot be completely eliminated during the production process, comprehensive control measures should be taken to make them comply with national occupational health standards.

(2) For construction projects with high-temperature occupational disease hazards, it should be ensured that their design complies with relevant national occupational health standards and hygiene requirements. High-temperature protection facilities should be designed, constructed, and put into production and use at the same time as the main project. .

(3) Employers with high-temperature occupational disease hazards shall implement daily high-temperature monitoring with dedicated personnel, and conduct detection and evaluation of occupational disease hazard factors in accordance with relevant regulations.

(4) Employers shall, in accordance with relevant regulations, organize occupational health examinations for workers engaged in operations exposed to high temperature hazards before, during and after employment, and store the examination results in occupational health surveillance files and write them in writing Inform workers. The cost of occupational health examination shall be borne by the employer.

(5) Employers shall not arrange pregnant female employees and underage workers to engage in high-temperature work above Level 3 in the "Occupational Classification of Occupational Disease Hazards in the Workplace Part 3: High Temperature" (GBZ/T229.3) Site work.

Which groups of people can receive high temperature subsidies

1. If workers are engaged in open-air work and the employer cannot take effective measures to reduce the temperature of the workplace to below 33 degrees, the employer shall Pay high-temperature allowances to workers every month, and list the specific items and amounts in the wage list;

2. The employer arranges for workers working in high-temperature jobs to temporarily engage in non-high-temperature jobs for no more than 4 working days in the month. , the employer shall pay the high-temperature allowance in full for the month; if it is more than 5 working days, the employer may convert the high-temperature allowance based on the number of days the employee engaged in high-temperature operations in the month;
