Regulations of Hulunbeier Municipality on the Prevention and Control of Air Pollution

Chapter I General Provisions Article 1 In order to protect and improve the atmospheric environment, prevent and control atmospheric pollution, safeguard public health, promote the construction of ecological civilization and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Law on Prevention and Control of Air Pollution of People's Republic of China (PRC) and the Regulations on Prevention and Control of Air Pollution of Inner Mongolia Autonomous Region, and in combination with the actual situation of Hulunbeier City. Article 2 These Regulations shall apply to the prevention and control of air pollution and its supervision and management within the administrative area of this Municipality. If the superior law has already made provisions, its provisions shall prevail. Article 3 The prevention and control of air pollution shall adhere to the principles of planning first, prevention first, protection first, source control, combination of prevention and control, public participation and liability for damage, and establish a comprehensive control mechanism of government-led, departmental supervision, enterprise due diligence and social supervision. Article 4 The people's governments of cities and counties (urban areas) shall be responsible for the quality of the atmospheric environment in their respective administrative areas, increase financial input for the prevention and control of atmospheric pollution, strengthen measures for the prevention and control of atmospheric pollution, adjust industrial structure, energy structure, traffic structure and land use structure, optimize industrial layout, establish a coordination mechanism for the prevention and control of atmospheric pollution, make overall plans to solve major problems in the prevention and control of atmospheric pollution, and gradually improve the quality of atmospheric environment. Fifth city and county (urban) people's government departments in charge of ecological environment in the administrative area of air pollution prevention and control of unified supervision and management.

Development and reform, industry and information technology, public security, finance, natural resources, housing and urban and rural construction, transportation, water conservancy, agriculture and animal husbandry, commerce, emergency management, market supervision and management, forestry and grassland and other related business management departments shall supervise and manage the prevention and control of air pollution within their respective functions and duties.

The hematoxylin (township) people's government shall, in accordance with the work arrangements of the people's governments at higher levels and relevant departments, do a good job in the prevention and control of air pollution. Article 6 All units and individuals have the right and obligation to protect the atmospheric environment, and have the right to report and accuse the acts of polluting the atmospheric environment and the acts of departments and their staff who are responsible for the supervision and management of air pollution prevention and control and fail to perform their duties according to law.

The competent department of ecological environment of the Municipal People's Government shall publish the telephone number and e-mail address of the report to facilitate the public to report. Chapter II Supervision and Management Article 7 The Municipal People's Government implements the system of total emission control of key air pollutants and atmospheric environmental quality control, and decomposes and implements the total emission control indicators of key air pollutants and binding indicators of ambient air quality issued by the people's government of the autonomous region to the people's government of Qi (city). Article 8 The people's governments of cities and counties (urban areas) shall implement the target responsibility system and assessment system for the prevention and control of air pollution, and incorporate the improvement targets of atmospheric environmental quality and the completion of key tasks for the prevention and control of air pollution within their respective administrative areas into the government performance appraisal, and the assessment results shall be made public. Article 9 The competent department of ecological environment of the people's governments of cities and counties (urban areas) and other departments responsible for the supervision and management of air pollution prevention and control shall incorporate the illegal information of atmospheric environment of enterprises, institutions and other producers and operators into a unified credit information system, and regularly publish the list of violators to the society. Article 10 The people's governments of cities and counties (urban areas) shall, in accordance with the requirements of circular economy and clean production, promote the construction of eco-industrial parks, rationally plan the industrial layout, newly-built industrial projects that discharge air pollutants shall enter the industrial parks, and enterprises with serious pollution in urban built-up areas shall move or transform within a time limit. Article 11 The competent department of industry and informatization of the Municipal People's Government shall, jointly with the municipal development and reform, ecological environment and other departments, establish a negative list of key industries that seriously pollute the atmospheric environment and eliminate backward production capacity according to the industrial structure adjustment guidance catalogue. Strictly control the new capacity of industries with overcapacity, and new construction, reconstruction and expansion projects should be replaced with the same capacity or reduced capacity. Twelfth city, flag (urban) people's government should strictly control the new construction, renovation and expansion of industrial construction projects that emit industrial waste gas or toxic and harmful atmospheric pollutants. Thirteenth pollutant discharge units that discharge pollutants into the atmosphere shall perform the following obligations:

(a) in accordance with the provisions of the state and the autonomous region, set up air pollutant discharge ports and their signs, permanent monitoring points and sampling monitoring platforms;

(two) take the initiative to accept and cooperate with the competent department of ecological environment or other supervision and management departments to carry out supervisory monitoring;

(three) the establishment of monitoring data files, and save the original monitoring records. Article 14 Key pollutant discharge units shall, in accordance with the relevant provisions of the state and the autonomous region and the requirements of monitoring specifications, install automatic monitoring equipment for air pollutant discharge, connect with the monitoring system of the competent department of ecology and environment, ensure the normal operation of the monitoring equipment, disclose the name, discharge mode, discharge concentration and total amount, excessive discharge and the construction and operation of pollution prevention facilities according to law, and be responsible for the authenticity and accuracy of the automatic monitoring data.

The valid data of automatic monitoring equipment for air pollutant emission certified by measurement can be used as the basis for environmental law enforcement and management. Article 15 The competent department of ecological environment of the Municipal People's Government shall, jointly with the competent meteorological departments, establish a monitoring and early warning mechanism for heavy polluted weather in this administrative region.

Heavy pollution weather forecast and early warning information shall be uniformly released by the Municipal People's Government, and no other unit or individual may release it without authorization.
