Provisions of Jinan Municipality on Prevention and Control of Dust Pollution

Article 1 In order to prevent and control dust pollution, improve the quality of air environment and protect human health, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the prevention and control of dust pollution within the administrative area of this Municipality. Article 3 The Municipal People's Government shall exercise unified leadership over the prevention and control of dust pollution in this Municipality.

County (city) and District People's governments are responsible for the prevention and control of dust pollution within their respective jurisdictions.

The municipal environmental protection administrative department (hereinafter referred to as the municipal environmental protection department) is responsible for the supervision and management of the prevention and control of dust pollution in this Municipality.

Construction, city appearance and sanitation, municipal utilities, landscaping, transportation, land and resources, public security, urban management administrative law enforcement and other relevant administrative departments shall, in accordance with their respective responsibilities and the division of labor of the Municipal People's government, do a good job in the prevention and control of dust pollution. Article 4 The municipal environmental protection department shall, jointly with relevant departments, formulate an implementation plan for the prevention and control of dust pollution, and organize the implementation after the approval of the Municipal People's Government. Article 5 The municipal environmental protection department shall establish an environmental monitoring network for dust pollution, strengthen the monitoring and control of dust pollution, and regularly release information on dust pollution. Article 6 When examining and approving the environmental impact assessment documents of construction projects, the environmental protection department shall also review the prevention and control scheme of dust pollution of construction projects. Article 7 When bidding for a project that may produce dust pollution, the tendering unit shall require the tendering unit to submit a dust pollution prevention and control plan for the project.

When signing a construction contract, the construction unit shall specify the responsibility of the construction unit for the prevention and control of dust pollution in the process of construction and transportation of materials and dregs, and include the required funds in the project budget. Article 8 The competent department of city appearance and environmental sanitation shall require the applicant to submit a plan for the prevention and control of dust pollution when issuing the vehicle transport permit for construction waste. Ninth administrative departments in the dust pollution law enforcement inspection, the inspected units or individuals shall actively cooperate and truthfully provide relevant information, and shall not refuse or obstruct the inspection. Tenth any unit or individual has the right to report dust pollution.

The relevant administrative departments shall accept the public's reports and complaints about dust pollution, and deal with them in a timely manner according to the division of responsibilities.

The people's governments at all levels shall commend and reward the units and individuals that have made remarkable achievements in the prevention and control of dust pollution. Eleventh engineering construction shall meet the following prevention and control requirements:

(1) A continuous closed fence should be set around the construction site. Signs with a height of more than 2.5 meters shall be set at the construction site boundaries of urban main road sections, urban landscape roads, densely populated areas and airports, stations, squares and other areas, and the height of other areas shall not be less than 1.8 meters;

(2) During the construction period, a dense mesh dust-proof net (not less than 2000 mesh/100 cm 2) or dust-proof cloth shall be set outside the scaffold on the construction site;

(3) Dust suppression measures such as hardening should be taken for roads on the construction site. The exposed ground should be paved with reef slag, fine stones or other materials with equivalent functions, or take measures such as covering dust-proof cloth or dust-proof net and greening vegetation;

(4) During excavation, transportation, earthwork filling and other construction operations, measures such as sprinkling water and dust suppression should be supplemented; In case of gale weather above level 4, earthwork construction should be stopped and dust-proof nets should be covered in the workplace;

(five) the use of building materials that are easy to produce dust in the construction process shall be sealed, fenced or stacked, covered with dust-proof cloth or other dust-proof measures shall be taken;

(six) the construction waste generated by the construction project shall be removed in time, and if it is not removed in time, effective dust prevention measures shall be taken;

(7) During the construction period, a car washing platform must be set on the inner side of the exit of materials, muck and garbage transport vehicles to ensure the cleanliness of the vehicles. The clay visible on the paved road at the exit of the construction site shall not exceed10m, and shall be cleaned and washed in time;

(eight) in and out of the site materials, muck, garbage transport vehicles, should use closed hopper. If there is no closed hopper, the highest point of loading height shall not exceed the upper edge of the car trough by 40 cm, and the edges on both sides shall be lower than the upper edge of the car trough 10 cm. The car body should be covered with tarpaulin, and the edge of tarpaulin should cover at least 15cm below the upper edge of the groove.

(9) The removal and transportation of loose materials, dregs or wastes on the upper floors of buildings shall be sealed and shall not be thrown into the air. Twelfth pipeline and road engineering construction, in addition to the provisions of article eleventh, should also meet the following requirements:

(a) construction machinery in the implementation of excavation, loading, piling, road cutting, rolling and other operations, should take water and other measures to prevent dust pollution;

(two) when using pneumatic drill to dig the ground or clean the construction site, it should be supplemented by dust suppression measures such as sprinkling water;

(three) for the trench that has been backfilled, measures such as sprinkling water and covering should be taken to reduce dust. Thirteenth houses or other buildings and structures, in addition to complying with the provisions of Article 11 of these Provisions, the construction unit shall also take water spraying or spray dust removal measures. Fourteenth landscaping projects shall meet the following requirements in addition to the provisions of article eleventh:

(a) after the completion of planting tree holes and green belts, the backfill soil of tree holes and green belts should be lower than the edge 10 cm, and the tree holes should be covered with pebbles, baffles and turf;

(two) after the completion of all kinds of pipeline laying projects in the green space, it shall be restored to its original appearance within 5 days from the date of completion, and shall not leave bare ground;

(three) the garbage generated by greening should be removed in time.
