Interim Measures of Harbin Municipality for the Prevention and Control of Urban Dust Pollution

Article 1 In order to control dust pollution, improve the quality of urban atmospheric environment and protect human health, these measures are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution and the Regulations of Harbin Municipality on the Protection of Living Environment of Urban Residents, and in combination with the actual situation of our city. Article 2 These Measures shall apply to the prevention and control of dust pollution in the built-up areas of this Municipality. Article 3 The municipal environmental protection administrative department shall exercise unified supervision and management over the prevention and control of dust pollution.

The District People's Government shall be responsible for the organization, implementation, supervision and management of dust pollution prevention and control within its jurisdiction.

Construction, urban management, real estate, district environmental protection and other administrative departments shall, in accordance with their respective responsibilities and the provisions of these measures, supervise and manage the prevention and control of dust pollution. Article 4 Any unit or individual has the right to report acts of dust pollution caused by violation of these measures. Article 5 The District People's Government and the relevant municipal and district departments shall, in accordance with the planning, build windbreak and sand-fixing forest nets and forest belts, form an urban green ecological corridor system, strengthen the protection and management of existing water surfaces within their respective jurisdictions, improve the atmospheric environment purification capacity, and reduce and control dust pollution. Sixth buildings, structures demolition units should be in accordance with the provisions of the demolition site around the enclosure; In the process of demolition, effective dust prevention measures such as wet operation should be taken. Article 7 The construction unit shall, in accordance with the regulations, set up enclosures around the construction site and cover the construction roads on the construction site with hard cover; Sandstone, lime soil and other materials should be effectively sealed, covered and other dust-proof measures.

Effective dustproof measures such as wet operation should be taken when mixing concrete, loading and unloading dust-producing substances, cleaning the ground and leveling the site. Eighth construction units shall use ready-mixed concrete in accordance with the relevant provisions, and shall not mix concrete at the construction site without authorization. Ninth construction waste and residual soil generated in the process of demolition construction shall be removed in time. For construction waste and residual soil that cannot be removed immediately, effective dustproof measures such as sealing and covering should be taken.

Fifteenth existing bare ground, should be in accordance with the following division of labor and the unified standards and time limit stipulated by the Municipal People's government for greening or hard coverage:

(a) the bare ground of municipal roads, squares and public green spaces shall be completed by the relevant municipal authorities or the District People's Government in accordance with the division of management;

(two) the bare ground of the unit resident, completed by the unit;

(three) the bare ground of the residential area is completed by the property owner or other management unit;

Nineteenth coal-fired boilers, power plants, cement plants and other dust collectors. Closed ash collection and storage devices shall be provided to ensure normal and effective operation. Article 20 It is forbidden to engage in production and business activities such as sawing, grinding, polishing and crushing in the open air that produce dust pollution. Twenty-first in violation of the provisions of these measures, one of the following acts shall be ordered by the competent administrative department of environmental protection to stop the illegal act, make corrections within a time limit, and be punished in accordance with the following provisions:

(a) demolition of buildings and structures outside the house, without taking effective dust prevention measures such as wet operation, resulting in dust pollution, and a fine of 10000 yuan to 20000 yuan;

(2) Failing to take effective dust prevention measures such as covering and stockpiling coal, coal gangue, cinder, coal ash, sand and gravel, lime soil and other materials, and causing no dust pollution, and imposing a fine of more than 2,000 yuan in 500 yuan; If dust pollution is caused, a fine ranging from 10000 yuan to 50000 yuan shall be imposed;

(three) the dust collector used in coal-fired boilers is not equipped with a closed ash collection and storage device, causing dust pollution, and a fine of more than 5000 yuan 1000 yuan is imposed;

(four) the dust collectors used in power plants and cement plants are not equipped with closed ash collection and storage devices, resulting in dust pollution, and a fine of 10000 yuan to 20000 yuan is imposed;

(five) engaged in sawing, grinding, grinding and other production and business activities that produce dust pollution in the open air, and fined 5000 yuan to 20000 yuan.
