Measures of Guizhou Province for the Administration of Ship Safety in Villages and Towns

Chapter I General Provisions Article 1 In order to strengthen the safety management of ships in villages and towns, prevent and reduce accidents, and ensure the safety of people's lives and property, these measures are formulated in accordance with the provisions of the Regulations on the Safety Management of Inland River Traffic, the Regulations on the Administration of Waterway Traffic in Guizhou Province and other laws and regulations, combined with the actual situation in our province. Article 2 These Measures shall apply to the construction, use and management of township ships with the captain less than 10 meter within the administrative area of our province.

The term "township ships" as mentioned in these Measures refers to non-business transport ships used by farmers or other personnel living in towns and villages for agricultural production and daily life. Article 3 The people's governments at or above the county level shall establish and improve the responsibility system for ship safety management in villages and towns, and strengthen the leadership over ship safety management in villages and towns. Article 4 The safety management of township ships shall be territorial management, and the township (town) people's government shall be responsible for it.

Village (neighborhood) committees shall assist in the safety management of ships in villages and towns. Fifth people's governments at or above the county level safety production supervision and management departments, transportation departments and maritime and navigation management agencies shall guide the safety management of township ships.

The safety of water traffic in navigable waters shall be uniformly supervised and managed by the maritime administrative agency. Chapter II Construction and Navigation Article 6 Township ships purchased and built shall meet the relevant national and provincial safety technical standards.

Encourage the use of drawings provided by the township (town) people's government free of charge to build township ships. Seventh township (town) people's government shall provide laws, regulations, rules and technical advice for individuals who decide to buy or build ships for their own use in towns and villages. Eighth township ship owners should strengthen the maintenance of the ship, eliminate hidden dangers in time, and keep the ship seaworthy. Ninth township ships shall meet the following conditions before sailing:

(1) Having passed the inspection;

(2) Holding the registration certificate of the township self-use ship;

(three) equipped with qualified drivers. Tenth township ships sailing shall abide by the navigation rules, prohibit the following acts:

(1) Sailing beyond the approved number of crew members or the approved load line;

(two) life-saving equipment and navigation and mooring equipment are not fully equipped;

(3) Outside the approved active waters or at a speed greater than 3? Sailing in the waters of 5m/s;

(four) beyond the forbidden water level or sailing in prohibited waters;

(5) Night flight without night flight facilities;

(6) drunk driving;

(seven) sailing in strong winds, fog, heavy rain and other bad weather. Eleventh township ships are prohibited from engaging in commercial transportation. Chapter III Inspection, Registration and Certification Article 12 The owner of a township ship shall apply to the local township (town) people's government for ship inspection and registration, and submit the following materials:

(1) An application form for registration of ship inspection in villages and towns;

(2) the identity certificate of the owner;

(3) Purchase invoice, construction agreement or certificate of legal origin of the ship issued by the village (neighborhood) committee. Thirteenth Township People's Government shall, within 3 days from the date of receiving the application, review the materials specified in Article 12. If the materials are complete and true, they shall be inspected, registered and issued the "Registration Certificate for Township Self-use Ships in Guizhou Province" within 7 days from the date of accepting the application; Those who refuse to inspect, register and issue certificates if they do not meet the requirements shall notify the shipowner in writing within 7 days from the date of receiving the application and explain the reasons. Fourteenth township ship inspection in accordance with the following standards:

(1) The width of the ship shall not be less than 1? 1 meter. The maximum propulsion power of motor boats shall not exceed 20kW;

(2) The hull structure shall be firm and watertight, free from bumps, cracks and other obvious defects;

(3) The lowest freeboard of a ship: if the captain is less than 7 meters (including 7 meters), it is 150 mm when sailing in lakes and reservoirs, and 170 mm when sailing in rivers and waters; If the captain is more than 7 meters, sailing in lakes and reservoirs is 170 mm, and sailing in rivers and waters is 210 mm;

(4) On each side of the hull, clearly mark the load line with a length of 400 mm and a width of 25 mm; Indicate the name of the ship, the number of people with limited capacity and the words "No operation" in a prominent position;

(five) according to the approved number of passengers equipped with life-saving equipment; Equipped with necessary navigation and mooring equipment and drainage tools. Fifteenth township ships carrying passengers (including drivers) according to the following provisions:

(1) The ship width is less than 1? 2 meters approved for 2 people;

(2) Is the ship width greater than 1? 2 meters (including 1? 2 meters), less than 1? 5 meters approved 3 people;

(3) Is the ship width greater than 1? 5 meters (including 1? 5 meters), less than 1? 7 meters approved 4 people;

(4) The width of the ship is greater than 1? 7 meters (including 1? 7 meters) approved 5 people.

Before the implementation of these measures, the width of the existing township ships is less than 1? 1 m, approved 1 person (driver). Sixteenth township ship drivers shall meet the following conditions:

(a) At least 65-438+08 years old, but not more than 65 years old;

(2) Being in good health;

(three) by the township (town) people's government to organize safety knowledge and ship operation skills training.
