Xi Regulations on Prevention of Meteorological Disasters (202 1 Revision)

Chapter I General Provisions Article 1 In order to prevent meteorological disasters, avoid and reduce losses caused by meteorological disasters, ensure the safety of people's lives and property, and promote economic and social development, these Regulations are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Meteorological Regulations of Shaanxi Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 Meteorological disasters mentioned in these Regulations refer to disasters caused by disastrous weather such as rainstorm, high temperature, low temperature, drought, strong wind, thunder and lightning, hail, heavy snow, fog, frost (ice), cold wave, sandstorm, dry hot wind and continuous rain, and derivative disasters such as landslides, mudslides, fires, floods and air pollution caused by the above meteorological factors.

Meteorological disaster prevention as mentioned in these Regulations refers to activities such as monitoring, forecasting, early warning, defensive measures and emergency response to meteorological disasters. Article 3 These Regulations shall apply to meteorological disaster prevention activities within the administrative area of this Municipality. Article 4 The municipal, district and county people's governments shall strengthen their leadership over meteorological disaster prevention, incorporate meteorological disaster prevention into the national economic and social development plan at the same level, and establish and improve the command and coordination mechanism for meteorological disaster prevention. Article 5 The competent meteorological departments of cities, districts and counties shall be responsible for the management of disastrous weather monitoring, forecasting, early warning, weather modification and lightning disaster prevention within their respective administrative areas. Article 6 The relevant departments of the municipal, district and county people's governments, such as development and reform, housing and construction, urban management, industry and information technology, finance, resource planning, public security, transportation, water affairs, agriculture, ecological environment, emergency, civil affairs, health, cultural tourism and electric power, shall, according to their respective functions and duties, do a good job in meteorological disaster prevention. Seventh meteorological disaster prevention, adhere to the principle of prevention first, overall planning, division of labor and cooperation, grading responsibility. Article 8 Encourage and support scientific and technological research on meteorological disaster prevention, popularize advanced meteorological disaster prevention technologies and publicize meteorological disaster prevention knowledge.

The municipal, district and county people's governments shall commend and reward the units and individuals that have made outstanding contributions in the prevention of meteorological disasters. Chapter II Defense Planning and Facilities Construction Article 9 The municipal, district and county people's governments shall organize competent meteorological departments and relevant departments to formulate defense plans for meteorological disasters within their respective administrative areas, and take effective measures to improve their ability to defend against meteorological disasters. Tenth meteorological disaster prevention planning shall include the following contents:

(a) the guiding ideology, principles and objectives of meteorological disaster prevention;

(2) Forecast and evaluation of the present situation and development trend of meteorological disasters;

(3) Meteorological disaster-prone areas and key defense areas;

(four) the main tasks of meteorological disaster prevention;

(five) meteorological disaster prevention construction projects;

(six) meteorological disaster prevention measures;

(seven) other contents stipulated by laws and regulations. Eleventh major construction projects within the administrative area of this Municipality shall meet the requirements of meteorological disaster prevention planning. Twelfth municipal, district and county people's governments shall strengthen the construction of meteorological disaster prevention infrastructure such as meteorological disaster monitoring and early warning system, early warning information release system and emergency meteorological service system. The specific plan shall be compiled by the competent meteorological departments at all levels in conjunction with relevant departments and implemented after being approved by the people's government at the same level.

The construction scheme of the city-wide meteorological detection facilities, meteorological special transmission facilities, large-scale meteorological special technical equipment and other important meteorological facilities shall be compiled by the municipal competent meteorological department jointly with the relevant competent departments. Thirteenth city, district and county people's governments shall set up facilities to broadcast meteorological disaster warning signals in prominent positions and crowded places in cities and towns. Airports, railway stations, tourist attractions, highways, water conservancy projects and other places should build facilities for broadcasting meteorological disaster warning signals. Fourteenth any organization or individual shall protect meteorological disaster monitoring and prevention facilities and early warning signal broadcasting and receiving facilities according to law, and shall not occupy, destroy or move them without authorization.

When meteorological disaster monitoring and prevention facilities and early warning signal broadcasting and receiving facilities are damaged due to force majeure, the local people's government shall take emergency measures to promptly organize efforts to repair and ensure the normal operation of the facilities. Chapter III Monitoring, Forecasting and Early Warning Article 15 The competent meteorological departments of cities, districts and counties shall, according to the needs of preventing meteorological disasters, establish an inter-departmental joint monitoring network, organize comprehensive monitoring and forecasting of disastrous weather, and provide decision-making basis for the people's governments at the corresponding levels to organize prevention of meteorological disasters.

The member units of the joint monitoring network are proposed by the municipal competent meteorological department and reported to the Municipal People's government for approval. Sixteenth members of the joint monitoring network shall provide real and accurate meteorological information and monitoring information such as rain, water and drought to the municipal competent meteorological department in a timely manner.

The municipal competent meteorological department shall, according to the monitoring information provided by the members of the joint monitoring network, make a forecast and early warning of disastrous weather, and promptly notify the members of the joint monitoring network. The forecast and early warning of disastrous weather shall be reported to the Municipal People's Government in a timely manner. Article 17 Meteorological offices and stations subordinate to the municipal competent meteorological department shall strengthen scientific research on the occurrence and development law of meteorological disasters, consult with superiors and adjacent meteorological departments in time, and improve the analysis and prediction ability and prediction accuracy of meteorological disasters. Eighteenth severe weather forecast and warning, by the meteorological offices and stations under the competent meteorological departments in accordance with the division of responsibilities, through newspapers, radio, television, telephone, public networks and other media in a timely manner to the public.

The forecast and early warning of meteorological derived disasters shall be jointly released to the public by the competent meteorological departments of cities, districts and counties and relevant departments.

Radio, television, short message platforms, public networks and other media shall timely broadcast or insert forecasts, warnings, supplements and corrections of meteorological disasters that may have a significant impact on industrial and agricultural production and people's lives.
