Does going to work on a hot day count as overtime?

The state has not stipulated that work should be stopped at high temperature. Because the national regulations on heatstroke prevention and cooling were only promulgated in the early 1960s, the Ministry of Health, the Ministry of Labor and the All-China Federation of Trade Unions jointly issued the Interim Measures for heatstroke prevention and cooling. However, there is no specific stipulation on how many degrees it will be stopped.

The Interim Measures have been implemented for nearly 46 years. Not only are few people aware of it, but many of its provisions have long been inappropriate and need to be revised urgently. However, various provinces and cities in China have issued many local laws and regulations according to the actual situation.

Regional regulations

1, when the temperature or workplace temperature exceeds 39 degrees Celsius, the daily working hours of employees shall not exceed 4 hours; When the temperature or workplace temperature exceeds 38 degrees Celsius, overtime is prohibited; Employees who work in hot weather and cause heatstroke are regarded as work-related injuries.

2. Chongqing, Nanjing and other cities known as stoves also have unwritten rules. When the local temperature reaches above 40℃, workers don't have to go to work, but only work for half a day at 39℃.

3. According to the relevant laws and regulations of our country, heatstroke at work under high temperature is regarded as work-related injury. Front-line workers work in a high temperature environment, and once heatstroke occurs, employees or on-site personnel should immediately report to the employer; The employing unit shall report to the local labor and social security department within 24 hours and apply for work-related injury identification. After heatstroke workers are identified as work-related injuries, they can enjoy work-related injury treatment in accordance with relevant laws and regulations.
