Regulations of Jixi Municipality on the Prevention and Management of Lightning Disaster

Article 1 In order to prevent lightning disasters, protect people's lives and property, and promote economic and social development, these Regulations are formulated in accordance with the relevant provisions of the Meteorological Law of People's Republic of China (PRC) and the Regulations on the Prevention of Meteorological Disasters, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to lightning disaster prevention and related management activities within the administrative area of this Municipality. Article 3 The lightning disaster prevention shall follow the principles of safety first, prevention first, combination of prevention and control, government leading, departmental linkage and multi-party participation. Article 4 The people's governments of cities and counties (cities) shall strengthen the organization and leadership of lightning disaster prevention, establish and improve the coordination mechanism, urge the relevant departments and units to perform their duties of lightning disaster prevention and management according to law, incorporate lightning disaster prevention into the supervision and management of public security and safety, and incorporate the required funds into the fiscal budget at the corresponding level.

Township (town) people's governments and sub-district offices shall strengthen the supervision and inspection of the safety situation of production and business units in their respective administrative areas to prevent lightning disasters, and assist the relevant departments of the people's governments at higher levels to perform their duties of supervision and management of lightning disasters according to law. Article 5 The municipal competent meteorological department shall be responsible for organizing, managing, guiding and supervising the lightning disaster prevention in the whole city. County (city) meteorological authorities are responsible for organizing and managing the lightning disaster prevention work within their respective administrative areas.

City, county (city) meteorological authorities shall strengthen lightning monitoring, forecasting and early warning, lightning disaster investigation and identification, and be responsible for the supervision and management of lightning disaster prevention in construction projects and places in flammable and explosive fields.

Development and reform, housing construction, transportation, water affairs and other departments are responsible for the supervision and management of lightning disaster prevention of construction projects in corresponding fields within their respective administrative areas. Emergency, urban management, education, cultural tourism, health, market supervision, agriculture and rural areas, science and technology departments shall, in accordance with their respective responsibilities, do a good job in lightning disaster prevention. Sixth city, county (city) meteorological authorities and relevant departments should use various mass media to publicize and popularize the knowledge of lightning disaster prevention to the society, and enhance the public's awareness of lightning disaster prevention and their ability of self-help and mutual rescue.

Schools should incorporate lightning disaster prevention knowledge into education content, and cultivate and enhance students' awareness of lightning disaster prevention and their ability of self-help and mutual rescue. Education, meteorology, science and technology departments should give guidance and supervision.

Encourage legal persons and other organizations to carry out lightning disaster prevention knowledge popularization activities in combination with the actual situation. Seventh city and county (city) people's government should make overall planning, rational layout, establish and improve the lightning monitoring station network. The competent meteorological departments and relevant departments shall effectively use the resources of the station network to realize information sharing.

City, county (city) meteorological authorities should strengthen the construction of lightning monitoring and early warning system, improve the lightning disaster monitoring and early warning and lightning disaster prevention service capabilities. Eighth city and county (city) meteorological offices and stations subordinate to the competent meteorological departments shall strengthen the weather monitoring of lightning disasters, and timely release the lightning disaster forecast and early warning information. No other organization or individual may announce it to the public in any form.

Newspapers, radio, television and other media shall timely, accurately and freely announce to the public the lightning disaster forecast and early warning information provided by the meteorological offices and stations affiliated to the competent meteorological departments, and the relevant media shall timely insert or increase the supplementary forecast and early warning information broadcast on major lightning weather. Ninth all kinds of buildings (structures), places and facilities to install lightning protection devices shall comply with the provisions of the relevant national lightning protection standards. Lightning protection devices for newly built, rebuilt and expanded buildings, places and facilities shall be designed, constructed and put into use at the same time as the main project.

The design and construction of lightning protection devices for new construction, reconstruction and expansion projects can be undertaken by units such as construction, highway, water transport, railway, civil aviation, water conservancy, electric power, nuclear power and communication that have obtained corresponding engineering design and construction qualifications. Tenth city and county (city) meteorological authorities shall be responsible for the design review and completion acceptance of lightning protection devices in the following projects and places according to law:

(a) oil depots, gas depots, ammunition depots, chemical warehouses, fireworks, petrochemical and other flammable and explosive construction projects and places;

(2) Mining areas, tourist attractions or buildings put into use in lightning-prone areas.

Buildings, facilities and other places where lightning protection devices need to be installed separately;

(three) large-scale projects with high lightning risk and no lightning protection standards and norms, which need special demonstration.

Without design review or unqualified design review, lightning protection devices shall not be constructed; Without completion acceptance or unqualified completion acceptance, it shall not be delivered for use.

The design review and completion acceptance of lightning protection devices for housing construction projects and municipal infrastructure projects shall be supervised by the housing construction department. The lightning protection management of professional construction projects such as highway, waterway, railway, civil aviation, water conservancy, electric power, nuclear power and communication shall be the responsibility of various professional departments. Eleventh lightning protection device testing institutions shall obtain the corresponding qualification certificates according to law, and undertake the corresponding lightning protection device testing work according to the qualification grade. Technical personnel engaged in the detection of lightning protection devices shall have corresponding detection capabilities and carry out detection work in accordance with relevant national standards and technical specifications.

It is forbidden for unqualified institutions and personnel who do not have the corresponding detection ability to engage in the detection of lightning protection devices. Article 12 The owners or managers of lightning protection devices that have been put into use shall bear the main responsibility for the management of lightning protection devices, conduct routine maintenance of lightning protection devices, entrust units with corresponding lightning protection device testing qualifications to conduct regular testing in accordance with regulations, keep records of maintenance, testing and rectification, and maintain good safety protection performance.

Lightning protection devices in places where inflammable and explosive articles are produced and stored are tested once every six months; Other lightning protection devices should be tested once a year.

The production and business operation entities that install lightning protection devices shall specify the relevant contents of lightning disaster prevention in the emergency rescue plan for production safety accidents, organize at least one drill containing the emergency contents of lightning disaster prevention every year, and establish and improve the investigation and management system for hidden dangers of lightning disaster prevention safety accidents.
