Regulations of Suzhou Municipality on Prohibiting Fireworks and Firecrackers

In order to ensure the safety of citizens' lives and property and improve the air quality in our city, according to the Regulations of the State Council on the Safety Management of Fireworks and Firecrackers and the Notice of Suzhou Municipal People's Government on Prohibiting and Restricting the Discharge of Fireworks and Firecrackers (No.2 of Sudian [2017]), the relevant matters concerning the prohibition and restriction of the discharge of fireworks and firecrackers in the main city of our city are hereby notified as follows:

1. Areas where emissions are prohibited and restricted. All cultural relics protection units, stations and other transportation hubs and railway line safety protection areas, inflammable and explosive goods production and storage units, power transmission and transformation facilities safety protection areas, medical institutions, schools (including kindergartens), nursing homes, libraries, archives, museums, cultural centers, shopping malls, theaters, scenic spots, woodlands, parks, green spaces, nurseries, indoor houses and their offices.

_ Dongguan, Beiguan, Nanguan, Xiguan, _ Qiaoqiao, Lisan, Tuohe, Chengdong, Daodong Office, Development Zone and Sanba Office (east of Beijing-Taiwan Expressway) in Qiaoqiao District are restricted discharge areas.

The county people's government shall, in light of local conditions, determine the areas where fireworks and firecrackers are prohibited and restricted, and publish them in a timely manner.

Two, prohibit and limit the discharge time. It is forbidden to set off fireworks and firecrackers all the time in the forbidden area. In the restricted discharge area, fireworks and firecrackers are prohibited at other times except on Lunar New Year's Eve, the first to fifth day of the first month, the fifteenth day of the first month, weddings and funerals. In heavily polluted weather, fireworks and firecrackers are prohibited in restricted discharge areas, Suma Park and Fuli Town.

III. Types of prohibited and restricted emissions. Fireworks and firecrackers as mentioned in this circular refer to fireworks and firecrackers products that can produce light, color and sound, and civil black powder, pyrotechnics, fuses and other items used to produce fireworks and firecrackers. It is forbidden to sell or set off Kongming lanterns at any time and any place.

Four, the villages and towns (offices), community (village) committees, organs, organizations, enterprises and institutions should prohibit and restrict the discharge of fireworks into grid management, actively carry out publicity activities to prohibit and restrict the discharge of fireworks, educate and guide the public to abide by this notice.

Five, in the city's forbidden and restricted areas, without the approval of the public security organs to hold large-scale fireworks and firecrackers, the public security organs shall order it to stop the discharge, and impose a fine of 10000 yuan to 50000 yuan on the responsible unit; Individuals who set off fireworks and firecrackers at the time and place where the discharge is prohibited shall be ordered by the public security organ to stop the discharge, and a fine of more than 500 yuan 100 yuan shall be imposed; If it constitutes a violation of public security administration, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Six, since the date of this circular, in the restricted area to stop the establishment of new fireworks sales outlets, has been set to suspend the renewal of business licenses, and by the safety supervision department shall be ordered to move out of the restricted area within a time limit; Illegal operation, storage and discharge of fireworks and firecrackers in forbidden and restricted areas shall be severely punished by public security, safety supervision, urban management, market supervision and other departments in accordance with relevant regulations.

Seven, guardians and education departments should strengthen the education and guidance of minors; Minors who violate this circular shall be strictly disciplined by their guardians; Causing personal and property damage to the state, the collective and others, administrative punishment shall be given according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law; Guardians and other units and individuals with guardianship responsibilities shall bear relevant civil legal responsibilities according to law.

Eight, the general public should consciously abide by the provisions prohibiting and restricting the discharge of fireworks. Operators who undertake various festivals or other activities in the forbidden and restricted areas shall post this notice in a prominent position, inform consumers of the provisions on the prohibition and restriction of release, and actively discourage and report illegal discharge.
