The temperature is over 40 degrees. What kind of protection does the law give everyone?

Measures for the administration of heatstroke prevention and cooling measures

1. When the highest temperature reaches above 40℃ on that day, stop the outdoor operation on that day.

2. When the highest temperature reaches 37℃ or above and 40℃ or below, the employing unit shall arrange the laborers to work outdoors all day, which shall not exceed 6 hours in total. The continuous operation time shall not exceed the national regulations, and outdoor open-air operation shall not be arranged within 3 hours of the maximum temperature period.

If the working hours are stopped or shortened due to the hot weather, the employer shall not deduct or reduce the wages of the workers.

Workers engaged in high-temperature operations can receive high-temperature allowances according to law. The All-China Federation of Trade Unions has issued a notice demanding that the high-temperature allowance be paid according to regulations, and it is not allowed to use heatstroke prevention drinks and basic drugs to meet the high-temperature allowance.

Workers who suffer from heatstroke due to high-temperature operation or high-temperature weather operation and are diagnosed as occupational diseases shall be treated as industrial injury insurance.

Article 88 of People's Republic of China (PRC) Labor Contract Law

In any of the following circumstances, the employer shall be given administrative punishment according to law; If it constitutes a crime, the responsibility for publishing matters shall be investigated according to law; If it causes damage to workers, it shall be liable for compensation. (4) Poor working conditions and moderate environmental pollution have caused serious damage to the physical and mental health of workers.
