Measures of Xizang Autonomous Region Municipality on the Administration of Weather Modification

Article 1 In order to prevent and mitigate meteorological disasters, make rational use of climate resources, strengthen the management of weather modification, and promote economic development, these measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Regulations on the Management of Weather Modification, the Meteorological Regulations of Xizang Autonomous Region and other laws and regulations, combined with the actual situation of the autonomous region. Article 2 Whoever engages in weather modification activities within the administrative area of the autonomous region shall abide by these measures. Article 3 The term "weather modification" as mentioned in these Measures refers to the activities that, in order to avoid or mitigate meteorological disasters, artificially affect local atmospheric physical and chemical processes by means of science and technology under appropriate weather conditions to achieve the purposes of increasing rain and snow, hail suppression, rain and snow elimination, fog elimination and frost prevention. Article 4 The competent meteorological departments at or above the county level, under the leadership of the people's governments at the corresponding levels, are responsible for organizing, implementing, guiding and managing weather modification within their respective administrative areas.

The people's governments at or above the prefecture (city) level and the people's governments at the county level that carry out weather modification operations shall set up a leading group for weather modification, and their offices (weather modification offices) shall be located in the competent meteorological departments at the same level; Without the establishment of the competent meteorological departments at the county level, the office (weather modification office) can be located in the agriculture and animal husbandry department at the same level. The weather modification office shall establish effective communication with the flight control department and formulate a collaborative notification system.

Development and reform, finance, public security, transportation, agriculture and animal husbandry, water conservancy, forestry, safety supervision, civil aviation, communications, news media, flight control and other departments and units shall, according to their respective functions and duties, cooperate with the weather modification work. Article 5 Weather modification approved by the people's governments at or above the county level belongs to local meteorological undertakings of public welfare.

The people's governments at or above the county level shall incorporate the cause of weather modification into the national economic and social development plan at the same level, and the funds needed for weather modification shall be included in the financial budget of the people's government at the same level. Article 6 The competent meteorological departments at or above the county level shall, jointly with relevant departments, formulate a work plan for weather modification and report it to the people's government at the corresponding level for approval; If the competent meteorological department at the county level has not been established, the weather modification office at the county level shall, jointly with relevant departments, formulate a work plan for weather modification, report it to the people's government at the same level for approval, and report it to the competent meteorological department at the next higher level for the record.

The competent meteorological departments at or above the county level shall strengthen the scientific and technological experiments, effect evaluation and analysis of weather modification, and expand the application fields of weather modification.

Meteorological offices (stations) subordinate to the competent meteorological departments shall do a good job in various meteorological support work required for weather modification operations, and provide radar, satellite, meteorological and other detection data and information in a timely and free manner. Article 7 The news media shall promptly announce to the public the implementation of weather modification operations provided by the competent meteorological department or the weather modification office; The flight control department shall make a timely decision on the airspace application put forward by the competent meteorological department or the weather modification office; Agriculture, animal husbandry, water conservancy, forestry and other departments shall provide timely and free information on disaster, hydrology, fire and other information needed for the implementation of weather modification operations. Article 8 People's governments at or above the county level and relevant departments shall commend and reward units and individuals that have made outstanding contributions in weather modification. Article 9 Units engaged in weather modification operations (hereinafter referred to as operation units) shall meet the following conditions:

(a) qualified weather modification equipment;

(2) Having warehouses, batteries and necessary working facilities for storing weather modification equipment;

(3) Having communication tools that are in smooth contact with the weather modification office and the flight control department;

(4) There are a certain number of weather modification operators who have obtained qualification certificates according to regulations;

(5) Having a sound operation safety management system, a system for maintenance, transportation, storage and safekeeping of operation equipment, and clear emergency measures;

(six) other conditions stipulated by the competent meteorological department of the autonomous region.

Without the approval of the competent meteorological department of the autonomous region, no unit or individual may engage in weather modification operations. Tenth operating units shall strictly implement the operational norms and operating procedures stipulated by the competent meteorological department of the State Council, and shall not use unqualified, expired or scrapped special equipment for weather modification operations; Accept the command, management and supervision of the competent meteorological departments at or above the county level, and sign the responsibility book for production safety as required.

The operating unit shall handle the personal accident insurance for the personnel who carry out weather modification operations. Eleventh personnel engaged in weather modification operations shall meet the following conditions:

(1) Having full capacity for civil conduct;

(2) Being in good health;

(3) Having a junior high school education or above;

(four) by the competent meteorological departments of the autonomous region training.

The competent meteorological department of the autonomous region shall send a copy of the list of qualified personnel for weather modification operations to the public security department for the record. Article 12 The competent meteorological department of the autonomous region shall, according to the climate characteristics, geographical conditions and the needs of disaster prevention and mitigation, and in accordance with the relevant provisions of the Civil Aviation Law of People's Republic of China (PRC) and the Basic Rules of Flight of the People's Republic of China, determine the weather modification operation point in conjunction with the flight control department. The operating point shall not be located in densely populated areas, and there are no important facilities and tall buildings.

Without the consent of the competent meteorological department of the autonomous region, no unit or individual may set up or move the identified weather modification operation points without authorization.
