On the eve of the formal implementation of the new environmental protection law, our bureau specially reminded the managers of enterprises and institutions to study this new law seriously in the form of an open letter, and hoped that after the implementation of the new environmental protection law, the sewage units with problems would no longer be held accountable.

The newly revised "People's Republic of China (PRC) Environmental Protection Law" has added the following six penalties to the sewage units:

One is the daily penalty. Enterprises, institutions and other producers and operators who illegally discharge pollutants are fined, ordered to make corrections, and refuse to make corrections. The administrative organ that has made the punishment decision according to law may impose continuous penalties on a daily basis according to the original amount of punishment from the day after the date of ordering corrections.

The second is to seal up and detain. Where enterprises, institutions and other producers and operators illegally discharge pollutants, causing or likely to cause serious pollution, the environmental protection department and other departments responsible for environmental protection supervision and management may seal up and detain the facilities and equipment that cause pollutant discharge.

The third is to limit production and stop production for rectification. Enterprises, institutions and other producers and operators that discharge pollutants exceeding the pollutant discharge standards or exceeding the total emission control targets of key pollutants may be ordered by the environmental protection department to take measures such as limiting production and stopping production for rectification; If the circumstances are serious, it shall be reported to the Municipal People's Government for approval and ordered to suspend business or close down.

Fourth, direct punishment for unapproved construction. If the construction unit fails to submit the environmental impact assessment documents of the construction project according to law or starts construction without approval, the department responsible for environmental protection supervision and management shall order it to stop construction, impose a fine, and may order it to be restored to its original state.

The fifth is administrative detention. Enterprises, institutions and other producers and operators who commit one of the following acts, which does not constitute a crime, shall be punished in accordance with the provisions of relevant laws and regulations, and shall be transferred to public security organs by the competent environmental protection department of the people's government at or above the county level or other relevant departments, and the directly responsible person in charge and other directly responsible personnel shall be detained for more than 15 days; If the circumstances are relatively minor, they shall be detained for not less than five days but not more than ten days: (1) The construction project fails to conduct environmental impact assessment according to law and is ordered to stop construction and refuses to implement it; (two) in violation of the law, without obtaining a sewage permit, was ordered to stop sewage, refused to implement; (three) illegal discharge of pollutants by means of concealed pipes, seepage wells, seepage pits, perfusion or tampering with or forging monitoring data, or the pollution prevention and control facilities are not operating normally to escape supervision; (four) the production and use of pesticides prohibited by the state, after being ordered to correct, refused to correct.

Sixth, civil liability. If damage is caused by environmental pollution or ecological destruction, it shall bear tort liability in accordance with the relevant provisions of the Tort Liability Law of People's Republic of China (PRC).
