Provisions of Guangdong Province on the Prevention and Management of Lightning Disaster

Chapter I General Provisions Article 1 In order to strengthen the lightning disaster prevention, avoid and reduce the lightning disaster losses, and ensure the safety of people's lives and property, these Provisions are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Regulations on Meteorological Disaster Prevention and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Provisions shall apply to lightning disaster prevention activities within the administrative area of this province. Article 3 The lightning disaster prevention shall adhere to the principles of people-oriented, safety first, prevention first, and combination of prevention and control. Article 4 People's governments at all levels shall bring the lightning disaster prevention work into the scope of public safety supervision and management, strengthen the organization and leadership of the lightning disaster prevention work, establish and improve the coordination mechanism, and gradually increase the investment in the lightning disaster prevention work. Article 5 The competent meteorological departments at all levels shall be responsible for the management, guidance and supervision of lightning disaster prevention within their respective administrative areas, and organize lightning monitoring, forecasting and early warning, delineation of prone areas, risk assessment of lightning disasters, investigation and identification of lightning disasters, and detection and management of lightning protection devices.

The departments of housing and urban construction, transportation, water conservancy, agriculture and rural areas, education, emergency management, electric power and communications of the people's governments at or above the county level shall do a good job in lightning disaster prevention within their respective functions and duties. Article 6 People's governments at or above the county level shall encourage and support the research and development of lightning disaster prevention science and technology, popularize and apply advanced lightning disaster prevention technology, and promote the establishment of an advanced lightning disaster prevention standard system.

The competent meteorological departments at all levels and relevant government departments shall strengthen the standardization construction of lightning disaster prevention and organize the publicity and implementation of lightning disaster prevention standards.

Encourage and support qualified regions and units to build lightning science experimental sites and carry out research on new technologies for lightning disaster prevention. Seventh lightning disaster prevention industry associations should strengthen industry self-discipline, standardize industry behavior, and improve industry technical ability and service level.

Encourage lightning disaster prevention industry associations to promote the standard construction of lightning disaster prevention groups and provide information, training and other services. Article 8 Citizens, legal persons and other organizations shall cooperate with and participate in lightning disaster prevention activities, make timely emergency preparations according to lightning disaster early warning information, obey the command of relevant departments according to law, and carry out self-help and mutual rescue. Ninth people's governments at all levels and relevant departments should use various media to publicize and popularize the laws, regulations and scientific knowledge of lightning disaster prevention, and improve the public's awareness and ability of lightning protection and disaster reduction.

The education administrative department of the people's government at or above the county level shall urge schools to incorporate lightning disaster prevention knowledge into relevant courses or extracurricular education content, and cultivate and improve students' awareness of prevention and self-help and mutual assistance. Chapter II Risk Prevention, Monitoring and Early Warning Article 10 The competent meteorological departments at all levels shall, according to the topography, geology, landforms and lightning activities in their respective administrative areas, delimit lightning-prone areas and their armor class, and make them known to the public. Eleventh large-scale construction projects, key projects, explosion and fire dangerous environment, crowded places and other projects should be carried out lightning disaster risk assessment to ensure public safety.

Free trade pilot zones, development zones, industrial parks, new areas and other conditional areas should carry out lightning disaster risk assessment of regional engineering construction projects. The qualified engineering construction projects are no longer subject to lightning disaster risk assessment alone.

Regional lightning disaster risk assessment shall be organized and implemented by the institution undertaking regional management responsibilities or the department designated by the people's government at or above the county level. Twelfth to encourage the establishment of lightning disaster insurance system.

Encourage large-scale construction projects, key projects, explosive and fire dangerous environments, crowded places and other projects to purchase lightning disaster insurance to reduce the losses caused by lightning disasters. Thirteenth competent meteorological departments at all levels shall, in accordance with the principles of reasonable layout, information sharing and effective utilization, build a lightning monitoring network, improve the lightning monitoring and early warning system, and ensure the normal operation of the monitoring and early warning system.

Meteorological offices and stations subordinate to the competent meteorological departments at all levels shall strengthen the monitoring of lightning disaster weather, and timely release the weather forecast and early warning of lightning disaster to the society. Fourteenth lightning disaster weather occurs, the relevant units shall, according to the actual situation, in accordance with the defense guidelines or standards to take corresponding emergency measures. Chapter III Lightning Protection Devices Article 15 Newly-built, rebuilt and expanded buildings, places and facilities shall be equipped with lightning protection devices in accordance with relevant standards and regulations, and shall be designed, constructed and put into use at the same time as the main project.

Rural areas, schools, bus shelters, cultural and sports venues and other public places, as well as villagers' concentrated residential areas and breeding areas with high lightning disaster risk levels, should install lightning protection devices in accordance with relevant standards. The installation and maintenance of lightning protection devices should be included in the construction plan of rural social welfare undertakings. Article 16 The design and construction of lightning protection devices for new construction, reconstruction and expansion projects can be undertaken by units that have obtained corresponding engineering design and construction qualifications for buildings, highways, waterways, railways, civil aviation, water conservancy, electric power, nuclear power and communications. Article 17 The construction, design, construction, supervision and testing units of lightning protection devices in new construction, reconstruction and expansion projects shall be responsible for the quality and safety of lightning protection devices in construction projects according to their corresponding responsibilities.

Construction engineering design units in the preparation of engineering design documents, should be synchronized with the preparation of lightning protection device design documents, the implementation of mandatory standards for engineering construction, and be fully responsible for the design of lightning protection devices for construction projects.

The construction unit of lightning protection device shall carry out the construction in accordance with the design documents and construction technical standards that have passed the examination.

Lightning protection device testing units shall, in accordance with the relevant national standards and norms, conduct sub-item testing according to the construction progress, issue testing opinions, and be responsible for the authenticity of the testing data.

The construction project supervision unit shall supervise the construction quality of lightning protection devices according to the construction progress, and assume the supervision responsibility for the construction quality.
