Regulations of Lanzhou Municipality on Meteorological Disaster Prevention

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Regulations on the Prevention of Meteorological Disasters and the Regulations on the Prevention of Meteorological Disasters in Gansu Province, and in light of the actual situation of this Municipality, in order to strengthen the prevention of meteorological disasters, avoid and mitigate the losses caused by meteorological disasters and ensure the safety of people's lives and property. Article 2 These Regulations shall apply to meteorological disaster prevention activities within the administrative area of this Municipality.

Meteorological disasters as mentioned in these Regulations refer to disasters such as drought, strong wind, sandstorm (blowing sand and floating dust), rainstorm (snow), lightning, hail, fog, haze, cold wave, frost, low temperature and high temperature.

The provisions of relevant laws and regulations shall apply to the prevention of derivative and secondary disasters caused by meteorological factors such as floods and droughts, geological disasters, forest and grassland fires, pests and diseases, environmental pollution and epidemics. Article 3 Meteorological disaster prevention shall follow the principles of people-oriented, scientific defense, prevention first, combination of prevention and control, and comprehensive disaster reduction, and adhere to the working mechanism of government-led, departmental linkage, graded responsibility and social participation. Article 4 The municipal and county (district) people's governments shall strengthen the organization and leadership of meteorological disaster prevention, establish and improve the linkage and coordination mechanism of meteorological disaster prevention, incorporate meteorological disaster prevention into the national economic and social development plan at the corresponding level, incorporate the funds and staff allowances required for meteorological disaster prevention into the fiscal budget at the corresponding level, and ensure the expenditure on the construction of meteorological disaster prevention facilities, the release of meteorological monitoring, forecasting and early warning information, weather modification and popular science education on meteorological disaster prevention. Article 5 The competent meteorological departments of cities and counties (districts) shall be responsible for the monitoring, forecasting and early warning of severe weather, as well as the prevention and management of meteorological disasters such as meteorological disaster risk assessment, climate feasibility demonstration, lightning disaster prevention and weather modification.

The District People's Government without a competent meteorological department, Lanzhou New District, Lanzhou High-tech Development Zone and Lanzhou Economic and Technological Development Zone shall clearly define the departments and staff who undertake meteorological disaster prevention work.

The relevant departments of the people's governments of cities and counties (districts) shall, within their respective functions and powers, do a good job in the prevention of meteorological disasters within their respective administrative areas. Article 6 Township (town) people's governments and sub-district offices shall determine meteorological disaster prevention assistants, incorporate meteorological disaster prevention into the community safety construction and grid management system, and do a good job in meteorological disaster prevention in conjunction with the competent meteorological departments and emergency management departments. Seventh village (neighborhood) committees, enterprises and institutions shall assist the township (town) people's government, street offices to do a good job in meteorological disaster prevention and avoidance knowledge propaganda, disaster hidden danger investigation, early warning information transmission, emergency drills and disaster reports. Article 8 People's governments at all levels and relevant departments shall organize and popularize meteorological disaster prevention knowledge in various forms, so as to improve the public's awareness of disaster prevention and mitigation and their ability of emergency avoidance.

Schools should take meteorological disaster prevention knowledge as the content of school safety education, and cultivate and improve students' awareness of meteorological disaster prevention and their ability of self-help and mutual rescue. Education, meteorology and other departments shall guide and supervise the meteorological disaster prevention education carried out by schools. Ninth to encourage the development of meteorological disaster mechanism and meteorological disaster monitoring, forecasting, early warning, defense, risk management and other research, to encourage technological innovation; Support the popularization and application of advanced technologies for meteorological disaster prevention, strengthen technical exchanges and cooperation at home and abroad, and improve the scientific and technological level of meteorological disaster prevention. Tenth city and county (District) people's governments and relevant departments shall, in accordance with the relevant provisions of the state, province and city, commend and reward organizations and individuals that have made outstanding contributions in the prevention of meteorological disasters. Chapter II Preventive Measures Article 11 The municipal and county (district) people's governments shall establish a meteorological disaster information sharing system and strengthen the comprehensive development and utilization of meteorological disaster information resources.

The competent meteorological department is responsible for organizing the compilation of meteorological disaster information catalogue and establishing a meteorological disaster information sharing platform; Departments of development and reform, education, industry and informatization, public security, natural resources, ecological environment, housing construction, transportation, water supply, agriculture and rural areas, cultural tourism, emergency, forestry, urban management, and railway, highway, civil aviation, communications, electric power and other units shall provide flood and drought disasters, urban and rural waterlogging, geological disasters, environmental pollution, traffic monitoring, power grid failure and forest fires.

Meteorological disaster information shall be disclosed to the public in a timely manner according to law. Article 12 The people's governments of cities and counties (districts) shall organize competent meteorological departments and relevant government departments to conduct meteorological disaster investigation on the types, frequencies, intensities and losses caused by meteorological disasters within their respective administrative areas every five years, establish and improve the meteorological disaster database, conduct meteorological disaster risk assessment, delimit meteorological disaster risk areas according to the results of meteorological disaster risk assessment, and announce them to the public.

Meteorological disaster risk assessment shall include the following contents:

(a) the distribution characteristics of the historical and regional impacts of meteorological disasters;

(2) Analysis of the types and risk levels of meteorological disasters that may be suffered;

(three) meteorological disaster risk management countermeasures and active intervention measures and their technical and economic analysis;

(4) The conclusion of meteorological disaster risk assessment.
