Provisions of labor law on bad weather

The Labor Law of People's Republic of China (PRC) stipulates that workers have the right to refuse work in extreme weather. If an employee fails to arrive at his post on time due to bad weather, resulting in late work, the employer shall not treat him as late or absent from work, deduct wages and benefits, compensate him with legal holidays and rest days, and shall not give disciplinary punishment or terminate labor relations to the employee who is late for work. If the employer stops working and shortens working hours due to extremely cold weather, the wage payment shall be determined through consultation with the workers with reference to the relevant provisions of the state and the province on wage payment during shutdown.
