Meteorological regulations of People's Republic of China (PRC)
The State Council authorized the competent meteorological agency (hereinafter referred to as the competent meteorological agency of the State Council) to be in charge of the national meteorological work. The competent meteorological departments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for meteorological work within their respective administrative areas. The local competent meteorological departments at all levels shall implement the management system of dual leadership of the superior competent meteorological department and the people's government at the same level, with the leadership of the superior competent meteorological department as the main one.
Other departments with meteorological institutions in the State Council are responsible for the management of their own meteorological work according to the division of labor, and are subject to the industry management of the competent meteorological departments in the State Council. Article 4 People's governments at all levels shall strengthen their leadership over meteorological work and support the construction of meteorological infrastructure. Local people's governments at or above the county level may, according to the layout principle of national meteorological modernization and the needs of local social and economic development, build local meteorological projects mainly serving local economic construction, and the required capital construction investment and related business funds shall be included in the national economic and social development plan and financial budget at the corresponding level respectively. Fifth meteorological services belong to the scope of meteorological public services and should be provided free of charge; Belong to the scope of professional meteorological services, can be provided free of charge. Article 6 The State encourages citizens, legal persons and other organizations to engage in research activities on meteorological observation and weather forecasting technology in accordance with the provisions of these Regulations, and their legitimate rights and interests are protected by the State. Seventh foreign organizations or individuals engaged in meteorological activities in People's Republic of China (PRC) and other sea areas under the jurisdiction of People's Republic of China (PRC) must be approved by the competent meteorological department of the State Council in conjunction with the relevant competent departments, and abide by the relevant laws and regulations of People's Republic of China (PRC). Chapter II Meteorological Exploration Article 8 The layout of the national meteorological observatory network shall be uniformly planned by the competent meteorological department of the State Council. Article 9 The detection sites, instruments, facilities, signs, circuits, channels and facilities of meteorological stations are protected by the state, and no unit or individual may move or damage them without authorization. Article 10 It is forbidden to carry out engineering construction or other activities that adversely affect meteorological observation within the scope of environmental protection for meteorological observation; If it is necessary to carry out such activities due to special circumstances, the consent of the competent meteorological department must be obtained.
Measures for the protection and management of meteorological observation environment shall be formulated by the competent meteorological department of the State Council in conjunction with the relevant competent departments of the State Council. Article 11 The layout of the sites and facilities of meteorological offices and stations shall remain stable for a long time. The state protects and manages the detection sites, facilities and environmental conditions of meteorological stations by classification. If it is necessary to relocate general meteorological stations or their facilities due to the needs of engineering construction and urban planning, the construction unit must report to the competent meteorological departments of provinces, autonomous regions and municipalities directly under the Central Government for approval one year in advance; If it is really necessary to relocate the national benchmark weather station or basic weather station, the construction unit must report to the competent meteorological department of the State Council for approval two years in advance. The relocation expenses of meteorological stations or their facilities shall be borne by the construction unit. Article 12 When meteorological stations detect that the environment and its facilities are damaged by natural disasters or wars, the local people's governments shall take emergency measures and organize forces to repair them to ensure the normal operation of meteorological work. Thirteenth data obtained by foreign organizations or individuals in People's Republic of China (PRC) and other sea areas under the jurisdiction of People's Republic of China (PRC) alone or in cooperation with relevant departments and individuals in People's Republic of China (PRC) belong to People's Republic of China (PRC); The provider of test data has the right to use these data. Chapter III Forecasts and Alerts Article 14 The State implements a unified release system for meteorological forecasts and severe weather warnings.
Meteorological forecast and severe weather warning shall be publicly released by meteorological offices and stations at all levels subordinate to the competent meteorological department of the State Council in accordance with their duties, and other organizations and individuals shall not publicly release them to the public through the propaganda media. The measures for the release of meteorological forecast and severe weather warning shall be formulated by the competent meteorological department of the State Council.
Meteorological offices and stations subordinate to other relevant departments in the State Council can issue professional weather forecasts of their own departments. In remote areas with few national meteorological stations, with the consent of the competent meteorological departments of provinces, autonomous regions and municipalities directly under the Central Government, meteorological forecasting services can also be provided to the relevant local competent departments. Article 15 Meteorological offices and stations at all levels subordinate to the competent meteorological departments in the State Council shall, according to the needs of local economic construction and disaster prevention and mitigation, timely and accurately produce and issue meteorological forecasts and severe weather warnings, and timely issue supplementary or revised forecasts and warnings according to weather changes. Sixteenth post and telecommunications departments at all levels shall, in accordance with the relevant provisions of the state, closely cooperate with meteorological agencies at the same level to ensure smooth meteorological communication and complete the transmission of meteorological information, meteorological forecast and severe weather warning quickly and accurately.
The state encourages other departments and units to use their communication tools to transmit meteorological information.
