Regulations of Shandong Province on Environmental Protection of Meteorological Facilities and Meteorological Detection

article 1 in order to protect meteorological facilities and meteorological observation environment, ensure the representativeness, accuracy, continuity and comparability of meteorological observation information, and improve the level of meteorological monitoring and forecasting, these regulations are formulated in accordance with the Meteorological Law of the People's Republic of China, Regulations of the State Council on Environmental Protection of Meteorological Facilities and Meteorological Observation, and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the environmental protection, supervision and management of meteorological facilities and meteorological observation and related activities within the administrative area of this province.

the meteorological facilities mentioned in these regulations refer to meteorological detection facilities, special transmission facilities for meteorological information and large-scale meteorological special technical equipment, etc. belonging to the competent meteorological department; Meteorological observation environment refers to the environmental space formed by the minimum distance necessary to avoid all kinds of interference and ensure meteorological observation facilities to obtain meteorological observation information accurately. Article 3 The people's governments at or above the county level shall strengthen the organization, leadership and overall coordination of meteorological facilities and environmental protection for meteorological observation within their respective administrative areas, and include the funds required for environmental protection for meteorological facilities and meteorological observation into the fiscal budget at the corresponding level. Article 4 The competent meteorological departments at all levels shall, under the leadership of the competent meteorological departments at higher levels and the people's governments at the corresponding levels, be responsible for the protection, supervision and management of meteorological facilities and meteorological observation environment within their respective administrative areas.

relevant departments such as development and reform, economy and informatization, land and resources, housing and urban-rural construction, urban-rural planning, environmental protection, etc. shall do a good job in the environmental protection of meteorological facilities and meteorological observation according to the division of responsibilities. Fifth people's governments at all levels and their relevant departments should strengthen publicity and education, and enhance the awareness of the whole society to protect meteorological facilities and meteorological observation environment.

all units and individuals have the obligation to protect meteorological facilities and the environment for meteorological observation, and have the right to report the damage. Article 6 The competent meteorological departments at all levels shall, jointly with urban and rural planning, land and resources and other relevant departments, formulate special plans for meteorological facilities and environmental protection for meteorological observation, which shall be incorporated into urban and rural planning and overall land use planning after being approved by the people's government at the corresponding level.

if the adjustment of urban and rural planning and overall land use planning involves the special planning of meteorological facilities and environmental protection for meteorological observation, the urban and rural planning, land and resources departments shall solicit the opinions of the competent meteorological departments. Article 7 The following meteorological facilities and meteorological observation environments shall be protected:

(1) Meteorological facilities and meteorological observation environments of ground meteorological observation stations such as national reference weather stations, national basic weather stations, national general weather stations and regional meteorological observation stations;

(2) Meteorological facilities and meteorological observation environment of meteorological stations such as high-altitude meteorological observation stations, weather radar stations and meteorological satellite receiving stations;

(3) Meteorological facilities and meteorological detection environment of meteorological stations such as solar radiation observation station, acid rain monitoring station, eco-meteorological monitoring station (including agricultural meteorological station), sandstorm monitoring station, atmospheric composition observation station and space weather observation station;

(4) unattended automatic weather stations, lightning monitoring stations, ground-based global positioning system meteorological detection facilities, wind energy resource detection stations, marine meteorological observation facilities and other meteorological facilities;

(5) Special meteorological channels, frequencies, lines, networks and their facilities;

(6) other meteorological facilities and meteorological observation environment that should be protected. Eighth meteorological facilities are basic public service facilities, and the people's governments at or above the county level shall incorporate them into the management of infrastructure and public service facilities.

the people's governments at or above the county level and their relevant departments shall, in accordance with the requirements of the planning for the construction of meteorological facilities, rationally arrange the land for the construction of meteorological facilities to ensure the smooth progress of the construction of meteorological facilities.

competent meteorological departments at all levels should equip meteorological facilities, set up necessary protective devices, establish safety management systems, and set up protective signs in prominent positions near meteorological facilities to indicate protection requirements in accordance with relevant quality standards and technical requirements. Ninth unattended meteorological facilities, by the competent meteorological departments entrusted to the township people's government, street offices or enterprises and institutions, village (neighborhood) committees to protect; The entrusting party and the entrusted party shall sign an entrustment agreement to clarify their respective rights and obligations. Article 1 The people's governments at or above the county level shall, according to the statutory standards for the scope of environmental protection for meteorological observation, delimit the specific scope of protection in their respective administrative areas and make it known to the public.

the specific protection standards and requirements for meteorological observation environment shall be implemented in accordance with the relevant provisions of the state. Article 11 The competent meteorological departments at all levels shall notify the relevant departments of development and reform, economy and informatization, land and resources, urban and rural housing construction, urban and rural planning and environmental protection at the same level of the protection scope, protection standards and specific requirements of the environment detected by meteorological stations within their respective administrative areas.

if the protection scope, protection standards and specific requirements of the meteorological observation environment change, the relevant competent meteorological departments shall promptly notify the relevant departments listed in the preceding paragraph. Article 12 The departments of development and reform, economy and informatization, land and resources, housing and urban-rural construction, urban-rural planning, environmental protection, etc. at or above the county level shall include in the review the project establishment, planning permission, environmental impact assessment, etc. within the scope of meteorological observation environmental protection, whether the project meets the requirements of meteorological observation environmental protection stipulated by laws and regulations.

the urban and rural planning department shall solicit the opinions of the competent meteorological departments at the same level in writing when implementing planning permission for construction projects within the scope of meteorological observation environmental protection.
