Measures of Shanxi Province for the Administration of Weather Modification

Article 1 In order to strengthen the management of weather modification and give full play to the role of weather modification in defense, mitigation of meteorological disasters and economic construction, these measures are formulated in accordance with the Meteorological Law of People's Republic of China (PRC), the Regulations on the Management of Weather Modification, the Meteorological Regulations of Shanxi Province and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to weather modification activities within the administrative area of this province. Article 3 The term "weather modification" as mentioned in these Measures refers to the activities that, in order to avoid or mitigate meteorological disasters and make rational use of climatic resources, artificially affect the physical and chemical processes of local atmosphere through scientific and technological means under appropriate conditions, so as to achieve the purposes of increasing rainfall, increasing snow, hail suppression, frost prevention, rain elimination and fog elimination. Article 4 People's governments at or above the county level shall strengthen their leadership over weather modification work, incorporate weather modification work into the national economic and social development plan, incorporate the funds needed for weather modification work into the fiscal budget at the same level, and gradually increase capital investment. Fifth people's governments at or above the county level shall be responsible for guiding and coordinating the weather modification work within their respective administrative areas, and shall commend and reward the units and individuals that have made outstanding contributions in the weather modification work. Sixth provincial people's government development and reform, finance, public security, transportation, science and technology, agriculture, civil affairs, water conservancy, forestry, safety supervision, price, communication and civil aviation, flight control, radio management and other units shall do a good job in weather modification within the scope of their respective duties. The competent meteorological department of the seventh provincial people's government is the competent authority of weather modification, and its specific responsibilities are:

(a) the preparation of the province's weather modification work plan and plan;

(2) Formulating management rules and regulations;

(three) to organize the implementation of the province's key weather modification projects and weather modification operations;

(four) to be responsible for the examination of the organization of weather modification operations and the qualifications of operators;

(five) responsible for the province's weather modification technical training and scientific experiments, technology development and equipment supply;

(six) to carry out major weather modification projects, the development and application of new technologies and academic exchanges at home and abroad;

(seven) to study the influence of weather modification on climate and evaluate the effect of weather modification;

(eight) the planning and layout of weather modification equipment. Article 8 The competent meteorological departments of the people's governments at or above the county level shall expand the application fields of weather modification, and organize weather modification operations such as artificial precipitation enhancement by water storage of large-scale water conservancy and hydropower projects, artificial rain removal by major social activities, artificial fog removal by airports and expressway, and artificial rain and snow enhancement in tourist attractions. Article 9 The competent meteorological departments of the people's governments at or above the county level shall build special warehouses for explosives, vehicle-mounted rocket houses and duty rooms, equipped with communication facilities, and establish weather modification command systems, communication systems and weather monitoring and early warning systems. The required funds are included in the local financial budget.

The explosive materials needed for weather modification operations are stored by the local people's armed forces department, and the required funds are included in the local financial budget. Tenth units engaged in weather modification operations must meet the following conditions:

(1) Having the qualification of a legal person;

(2) Anti-aircraft guns and rocket launchers meet the relevant mandatory technical standards and requirements of the state;

(3) Infrastructure such as explosive equipment warehouse meets relevant safety management regulations;

(four) the operation commanders and operators have passed the training and examination by the provincial meteorological authorities and reached the required number;

(5) It has a sound system of airspace declaration, operational safety management and operational equipment maintenance, transportation, storage and custody. Eleventh weather modification operation organizations and operators to implement the qualification system.

Weather modification operation organizations and weather modification operators shall, in accordance with the relevant provisions, be certified by the competent meteorological department of the provincial people's government and obtain the qualification certificate before engaging in weather modification operations. Twelfth provincial weather modification organizations are responsible for weather modification operations such as aircraft in the province; City and county weather modification agencies are responsible for formulating plans and implementing local weather modification operations such as anti-aircraft guns and rockets. Thirteenth the implementation of weather modification operations shall meet the following conditions:

(1) Having suitable weather and cloud conditions;

(2) Obtaining the approval of the airspace control department;

(3) The operation site is a non-densely populated area, with no important tall building facilities and perfect safety measures;

(four) the communication between the operating point and the superior weather modification command center and the airspace control department is smooth;

(5) Having operating units and commanding operators who have obtained corresponding qualification certificates;

(six) the operating equipment is in good quality, meets the requirements of use, and has passed the annual inspection;

(seven) other conditions stipulated by laws and regulations. Fourteenth organizations that carry out weather modification operations shall strictly implement the operational norms and procedures stipulated by the competent meteorological departments in the State Council, and accept the command, management and supervision of the competent meteorological departments at or above the county level. Article 15 The competent meteorological departments at the city and county levels shall, according to the local climatic characteristics and geographical conditions, set up anti-aircraft guns, rockets and other weather modification ground operation stations (points), which shall be submitted to the competent meteorological department of the province for examination and approval with the consent of the people's government at or above the county level.

The approved operating stations (points) shall not be changed at will. If it is really necessary to change, it shall be re-submitted for approval in accordance with the provisions of the preceding paragraph of this article.
