According to Chapter V of the Postal Law of People's Republic of China (PRC), the provisions on loss compensation are as follows:
Article 45 the provisions of this chapter shall apply to the compensation for the loss of mail and remittance within the scope of postal universal service business.
The provisions of relevant civil laws shall apply to the compensation for postal losses beyond the scope of universal postal services.
The loss of mail refers to the loss, damage or absence of internal parts of mail.
Forty-sixth postal enterprises are not responsible for the loss of ordinary mail. However, ordinary mail losses caused by intentional or gross negligence of postal enterprises are excluded.
Article 47 Postal enterprises shall compensate for the loss of vouched mail in accordance with the following provisions:
(a) if the insured mail is lost or completely damaged, it shall be compensated according to the insured amount; In case of partial damage or shortage of internal parts, the actual loss of the mail shall be compensated according to the ratio of the insured amount to the total value of the mail.
(2) If the uninsured vouched mail is lost, damaged or the internal parts are short, compensation shall be made according to the actual loss, but the maximum amount shall not exceed three times the charge; If the registered letter is lost or damaged, it shall be compensated at three times the charge.
Postal enterprises shall state the provisions of the preceding paragraph in the notices of business premises and the mail receipts provided to users in a way that can attract the attention of users.
Postal enterprises that intentionally or grossly neglect to cause loss of vouched mail or fail to fulfill the obligations specified in the preceding paragraph have no right to invoke the provisions in the first paragraph of this article to limit their liability for compensation.
Forty-eighth postal enterprises shall not be liable for the loss of vouched mail due to one of the following reasons:
(1) Force majeure, except for the loss of insured mail due to force majeure;
(2) Natural attributes or reasonable wear and tear of the posted articles;
(3) The fault of the sender and the receiver.
Article 49 After delivering registered mail, users should make inquiries with postal enterprises within one year from the date of delivery of domestic mail and 180 days from the date of delivery of international mail.
When inquiring about international mail or mail in remote areas specified by the State Council postal administration, postal enterprises shall inform users of the inquiry results within 60 days from the date of inquiry; If other mails are inquired, postal enterprises shall inform users of the inquiry results within 30 days from the date of inquiry. If the mail has not been found at the expiration of the reply period, the postal enterprise shall make compensation in accordance with the provisions of Article 47 of this Law.
If the user fails to make an inquiry to the postal enterprise within the inquiry period specified in the first paragraph of this article and fails to make a claim for compensation, the postal enterprise shall no longer be liable for compensation.
Article 50 The remitter of postal remittance may, within one year from the date of remittance, hold a receipt to inquire about postal enterprises. Postal enterprises shall inform the remitter of the inquiry results within 20 days from the date of user inquiry. If the remittance is not found at the expiration of the inquiry period, the postal enterprise shall refund the remittance and remittance handling fee to the remitter.
