Legal analysis: When a customer falls, the first thing to look at is what caused the customer to fall. If the stair design is unreasonable and irregular, or the ground is slippery due to hotel reasons, the operator should bear certain compensation responsibilities. In terms of compensation items, victims who have suffered personal injuries can claim compensation for all kinds of medical expenses and reduced income caused by missed work, including medical expenses, missed work expenses, nursing expenses, transportation expenses, accommodation expenses, hospital food subsidies and necessary nutrition expenses. If the victim is disabled due to injury, the compensation obligor shall also compensate the necessary expenses incurred due to the increase of daily needs and the income loss caused by the loss of working ability, including disability compensation, disability AIDS, living expenses of the dependents, and necessary rehabilitation expenses, nursing expenses and follow-up treatment expenses actually incurred due to rehabilitation nursing and continuing treatment. However, if the fall is due to the customer's own reasons, for example, the ground is slippery because the customer spilled a drink, causing the customer to fall, the hotel generally does not assume responsibility.

Legal basis: Article 1 198 of the Civil Code of People's Republic of China (PRC). Operators, managers or organizers of mass activities in hotels, shopping malls, banks, stations, airports, stadiums, entertainment places and other business places shall bear tort liability if they fail to fulfill their security obligations and cause damage to others. If the behavior of a third party causes damage to others, the third party shall bear the tort liability; Operators, managers or organizers who fail to fulfill their security obligations shall bear corresponding supplementary responsibilities. Operators, managers or organizers may claim compensation from a third party after assuming supplementary responsibilities.
