Regulations of Weifang Municipality on the Administration of Fireworks and Firecrackers (revised in 2020)

Article 1 In order to strengthen the management of fireworks and firecrackers, ensure the personal and property safety of the public and citizens, reduce environmental pollution, and advocate a healthy and civilized lifestyle, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the discharge of fireworks and firecrackers and their supervision and management activities within the administrative area of this Municipality.

Fireworks and firecrackers as mentioned in these Regulations refer to all kinds of fireworks, firecrackers, fireworks and other products that can produce smoke and sound. Article 3 The people's governments of cities and counties (cities, districts) shall, according to the actual situation, reasonably determine the areas where fireworks and firecrackers are prohibited according to law and announce them to the public.

Gradually and reasonably expand the prohibited discharge area according to law.

No unit or individual may set off fireworks and firecrackers in areas where fireworks and firecrackers are prohibited. Fourth in the area where fireworks are prohibited, the following places are prohibited from setting off fireworks:

(a) the office area of state organs;

(2) cultural relics protection units;

(3) Units that produce and store inflammable and explosive articles;

(four) power transmission and transformation, gas, fuel and other energy facilities safety protection zones;

(5) Radio stations, television stations, medical institutions, schools, kindergartens, nursing homes and places for religious activities;

(six) forest, public green space, martyrs cemetery and other key fire prevention areas;

(seven) shopping malls, bazaars, theaters, dance halls, Internet cafes and other crowded places;

(eight) transportation hubs such as stations, docks, airports and railway line safety protection zones;

(9) Parking lots, urban bridges and underground spaces;

(ten) other places as prescribed by laws and regulations.

Other places where fireworks and firecrackers are prohibited shall be reasonably determined by the people's governments of cities and counties (cities, districts) according to the actual situation.

Where fireworks and firecrackers are prohibited, obvious warning signs shall be set up. Fifth in the early warning period of heavy pollution weather, fireworks and firecrackers are completely prohibited within the administrative area of this Municipality.

Relevant departments and news media should remind the public not to set off fireworks and firecrackers when releasing air quality and meteorological information during the early warning period of heavy pollution weather. Article 6 Where it is necessary to hold a fireworks party or fireworks display on a major festival, an application shall be filed with the public security organ according to the provisions on hierarchical management. The public security organ shall conduct a review in accordance with the law, and issue a license for setting off fireworks and firecrackers to those who meet the requirements. Article 7 These Regulations shall be implemented by the people's governments of cities and counties (cities, districts).

The public security organ is responsible for the safety management of fireworks and firecrackers.

Education, housing and urban construction, urban management, ecological environment, market supervision, emergency management and other departments shall, in accordance with the division of responsibilities, do a good job in the management of fireworks and firecrackers. Eighth town people's government, street offices should do a good job in the management of fireworks and firecrackers within their respective jurisdictions.

Village (neighborhood) committees, owners' committees, property service enterprises, hotels, hotels and other organizations and units assist in the management of fireworks and firecrackers. Ninth city and county (city, district) people's government should strengthen the publicity and education work of prohibiting the discharge of fireworks and firecrackers.

Radio, television, newspapers, internet and other news media should do a good job in public welfare propaganda to prohibit the discharge of fireworks and firecrackers.

Schools and kindergartens shall educate students and children on the safety of fireworks and firecrackers, and it is forbidden to set off fireworks and firecrackers. Tenth in the area where fireworks are prohibited, the village (neighborhood) committees and owners' committees shall incorporate the prohibition of fireworks into the management statute.

Outside the area where fireworks and firecrackers are prohibited, the village (neighborhood) committees, the owners' committees and the realty service enterprises shall delimit the places for the safe discharge of fireworks and firecrackers within the scope of their duties and guide the fixed-point discharge.

Illegal discharge of fireworks and firecrackers within the scope of responsibility, the village (neighborhood) committees, owners' committees, property service enterprises and hotels should be stopped in time; If the stop is ineffective, it shall report to the public security organ in time. Eleventh fireworks wholesale enterprises and retail outlets shall not be added in the prohibited discharge area, and the existing wholesale enterprises and retail outlets shall gradually withdraw from the prohibited discharge area. Specific measures shall be formulated by the Municipal People's Government. Twelfth in areas and places where fireworks are prohibited, fireworks shall not have the following acts:

(a) to the crowd, vehicles, buildings, aircraft, public green space, underground pipe network projection, throwing;

(2) Projecting, throwing or hanging articles on buildings, roofs and balconies;

(3) obstructing the safe passage of pedestrians, vehicles and aircraft;

(four) other acts endangering public security and the personal and property safety of citizens. Thirteenth any unit or individual has the right to report the illegal production, storage, transportation, sale and discharge of fireworks and firecrackers to the public security organs and other administrative departments. Article 14 Whoever, in violation of the provisions of this Ordinance, sets off fireworks in areas or places where fireworks are prohibited, or sets off fireworks in a way that endangers public safety and citizens' personal and property safety, shall be ordered by the public security organ to stop the discharge, and shall be imposed with a fine of 100 yuan but not more than 300 yuan; If the circumstances are serious, a fine of more than 300 yuan and less than 500 yuan shall be imposed.

In violation of the provisions of this Ordinance, fireworks and firecrackers are set off during the early warning period of heavy pollution weather, and the public security organ shall order them to stop setting off, and impose a fine of more than 300 yuan and less than 500 yuan.
